A. APPLICATION
1. Executive Order No. 74 shall apply to all reclamation projects, including those
initiated by LGUs and all other agencies, government-owned or controlled
corporations or any government entity allowed under existing laws to reclaim
land, for which there are no contracts/agreements yet executed between the
government entity concerned and a private sector proponent prior to its effectivity
(Section 9, E.O No. 74)
2. Administrative Order No. 2019-4 (IRR) shall apply to all applications for
reclamation projects and reclamation components of development/infrastructure
projects, and shall specify and enumerate the requirements, rules, and
regulations for the approval thereof by the PRA Governing Board (Section 1,
IRR)

Within the same period and prior to the submission of the application to
the PRA Board for approval, PRA shall secure the advisory opinions of the DOF,
DENR, and NEDA for guidance in its evaluation and approval of the proposed
reclamation project.
Within ninety (90) calendar days from the date of the issuance of NOFC
and the submission of the Completed Staff Work (CSW), the PRA Governing
Board shall take appropriate action on the application to reclaim.
1. ADVISORY OPINION
(Section 3, E.O No. 74)
The above agency advisory opinions must be conveyed to the PRA within
thirty (30) days from their receipt from the PRA of all documents reasonably
necessary for their respective evaluation.
3. COMPETITIVE BIDDING
(Section 5, E.O. No. 74)
Subject to relevant laws and regulations, the PRA shall ensure that all
reclamation projects undergo competitive public bidding consistent with the
government’s thrust to promote transparency and competitiveness.
4. RECLAMATION AND DEVELOPMENT PLAN (RDP)
(Section 7, E.O. No. 74)
The PRA, in coordination with the DENR, NEDA and affected LGUs shall
craft a National and/or Regional RDPs which take into consideration
environmental, social and economic impacts of proposed reclamation projects.
All RDPs shall undergo public consultation and shall be consistent with the
greater public interest.
All proposals for reclamation projects covered by E.O No. 74 must be
compliant with these RDPs and relevant master plan of the concerned national
government agency.
On the other hand, the IRR provides for the following requirements:
1. ADVISORY OPINION
(Section 3.1, IRR)
Similar to the requirement under E.O No. 74, the IRR requires Advisory
Opinion coming from the NEDA, DENR and DOF.
The advisory opinions must be conveyed to the PRA within thirty (30) calendar
days from their receipt from the PRA of all documents reasonably necessary for
their respective evaluation and shall be without prejudice to the running of the
prescribed periods for PRA’s evaluation and approval of the reclamation project
under Sections 5.3 and 5.4.
2. AREA CLEARANCE
(Section 3.2, IRR)
This refers to the output of the entire process of PRA review and
evaluation including the required advisory opinions under Section 3 of E.O No.
74, if any, as basis for the recommendation of reclamation proposals for approval
of the PRA Governing Board.
5. EQUIVALENT STUDIES
(Section 3.5, IRR)
Studies being required by the DENR to secure an ECC such as but not
limited to Environmental Impact Assessment (EIS), Initial Environmental
Examination (IEE) Checklist, Environmental Performance Report and
Management Plan (EPRMP), as may be applicable.
7. PRE-CONSTRUCTION DOCUMENTS
(Section 3.10; Section 8, IRR)
Similar to the requirement under E.O no. 74, the IRR also requires the
creation of an RDP in coordination with the DENR, NEDA and affected LGUs.
I. PRE-QUALIFICATION REQUIREMENTS
a. Legal Requirements
i. Letter of Intent (LOI) from the Applicant
ii. Provincial/City Council Resolutions expressing no
objection to the proposed reclamation project
b. Financial Requirements
Aside from above requirements, the PRA reserves the right to impose
from the applicant additional requirements from concerned government agencies
that may be affected by the proposed reclamation projects.
