IN FAVOUR OF

ICICI BANK LTD., a banking company within the


meaning of the Companies Act 2013 having its registered
Office at Aluva, Kerela State and having its branch/es,
inter alia, at 510/11, Aparna Bus Stop, Palakkad Main
Road, Kuniyamuthur Post, Coimbatore-641008.
(hereinafter referred to as the Mortgagee or Bank which
expression shall unless repugnant to the meaning or
context thereof shall include their/ its heirs, legal
representatives, executors, administrators, successors
and assigns).
By this memorandum the mortgagor confirm having
visited the mortgagee at its branch 510/11, Aparna Bus
Stop, Palakkad Main Road, Kuniyamuthur Post,
Coimbatore-641008, which is a notified town, on
and deposited with the mortgagee, the documents of title
listed in Schedule A hereunder relating to the properties of
the mortgagors described in Schedule B hereunder, with
an intent to create an equitable mortgage over the
properties described in Schedule B hereunder by way of
deposit of title deeds as contemplated under Sec.58(f) of
Transfer of Property Act as a continuing security for
repayment to the mortgagee of all the amount owing/
payable to or that may become due and payable hereafter
to the mortgagee by the mortgagors Mr. HARSHAA
SAMPATHKUMAR S/o Sampathkumar and Mrs. KAVIYABHARATHI
NARAYANAN W/o mr. Harshaa Sampathkumar (hereinafter
referred to as “Borrowers”) under the credit facilities in
the nature of funded and/or non – funded limits / loans
sanctioned/ to be sanctioned up to aggregate amount of
Rs.30,00,000/- (Rupees Thirty lakhs only) availed and / or to
be availed of by the Mortgagors and / or the Borrowers,
from time to time together with interest thereon at the
rates stipulated by the mortgagee from time to time, cost,
charges and other incidental expenses etc., incurred / to
be incurred in connection with the realization of the
amount due.
The Mortgagors declare and place on record that the
documents of title described in Schedule A hereunder are
the original documents of title relating to the Security
properties and that the security properties duly mortgaged
to mortgagee are under the absolute possession and
enjoyment of mortgagors and are not charged/ encumbered
to any other persons and thus the mortgagee created in
favour of the mortgagee by deposit of title deed as
explained above is absolute, first and paramount.

The mortgagors further confirm and place on record that


the properties described in Schedule B hereunder or any
part thereof are not encumbered/transferred/leased to any
persons and further agrees not to transfer any interest
therein by way of lease, sale or otherwise in favour of any
other persons without the prior written consent/
permission of the mortgagee bank so long as the
mortgagee debt is not discharged fully.
