(अ).—के ीय सरकार, लोक ितिनिधव अिधिनयम, 1951 (1951 का 43) क$ धारा 60 के
का.आ. 3786(अ).
3786(अ).—

खंड (ग) +ारा द, शि.य/ का योग करते 0ए, िनवा2चन आयोग से परामश2 करने के प6ात्, िनवा2चन/ का संचालन िनयम,
1961 का और संशोधन करने के िलए िन9िलिखत िनयम बनाती है, अथा2त:् -
1. (1) इन िन यम/ का संि>? नाम िनवा2चन/ का संचालन (संशोधन) िनयम, 2019 है ।
(2) ये उनके राजपB मC काशन क$ तारीख को वृ, ह/गे ।
2. िनवा2चन/ का संचालन िनयम, 1961 (िजहC इसमC इसके प6ात् “उ. िनयम” कहा गया है) के िनयम 18 के खंड (क) के

उपखंड (IV) के प6ात् िन9िलिखत उपखंड अंतःJथािपत कया जाएगा, अथा2त:् -

“(V) अिधिनयम क$ धारा 60 के खंड (ग) के अधीन अिधसूिचत Kि., िजनके अंतग2त अनुपिJथत मतदाता भी हN,”;
3. उ. िनयम/ के िनयम 27क मC--
(अ) खंड (क) के प6ात् िन9िलिखत खंड अंतःJथािपत कए जाएंग,े अथा2त:् -
(कक) “ अनुपिJथत मतदाता” से Kि.य/ के कसी ऐसे वग2 का कोई Kि. अिभेत है जो अिधिनयम क$ धारा 60 के
खंड (ग) के अधीन अिधसूिचत कया जाए और जो उ. अिधसूचना मC यथा-वQणत आवSयक सेवाT मC िनयोिजत है, और
इसके अंतग2त वUरV नागUरक या दKांग Kि.य/ के वग2 का िनवा2चक भी है;
(कख) “नोडल अिधकारी” से ऐसे कसी अनुपिJथत मतदाता के दावे के सयापन के िलए ािधकृ त कोई अिधकारी
अिभेत है जो कसी ऐसे वUरV नागUरक या दKांग Kि.य/ के वग2 का िनवा2चक नहW है;

(आ) खंड (ख) मC “अिभेत है जो”, से शXद/ के प6ात् “अनुपिJथत मतदाता से िभY ” शXद अंतःJथािपत कए जाएंगे,
(इ) खंड (ख) के प6ात् िन9िलिखत खंड अंतःJथािपत कए जाएंगे, अथा2त:् -
दKांग Kि.” से ऐसा Kि. अिभेत है जो िनवा2चक नामावली के िलए डाटाबेस मC दKांग Kि. के [प मC
(ग) “

दQशत है;
(घ) “मतदाता अिधकारी”से वUरV नागUरक या दKांग Kि.य/ के वग2 के िनवा2चक को डाक मतपB जारी करने के िलए
िनयु. अिधकारी अिभेत है;
(ड.) इस भाग के योजन के िलए “वUरV नागUरक” से ऐसा िनवा2चक अिभेत है जो अनुपिJथत मतदाताT के वग2 का
अJसी वष2 से अिधक आयु का है;''
4. उ. िनयम/ के िनयम 27ग मC, दूसरे परंतक
ु के Jथान पर िन9िलिखत परतुंक रखे जाएंगे, अथा2त:् -
“परंतु यह और क अनुपिJथत मतदाता के मामले मC, आवेदन ]प 12घ मC कया जाएगा और उसमC ऐसी िविशि_याँ
अंतQव_ ह/गी जो उसमC िविनaद_ क$ जाएं तथा वह वUरV नागUरक या दKांग Kि.य/ से िभY, अनुपिJथत मतदाता के
िलए नोडल अिधकारी +ारा सbयक ]प से सयािपत होगा, जो Uरटcनग आफसर के पास िनवा2चन क$ अिधसूचना क$
तारीख से अनुगामी पांच दन के भीतर प0ंच जाएगा;”
“परंतु यह भी क ]प 12ग या ]प 12घ मC ऐसा आवेदन िजसके साथ ा[प 12 या [प 12घ के भाग 2 के अधीन
यथा अपेि>त ािधकृ त अिधकारी या नोडल अिधकारी का माणपB नहW है, रe कर दया जाएगा;”
5. उ. िनयम/ के िनयम 27ड. के उपिनयम (1) मC, परंतुक के प6ात् िन9िलिखत परंतक
ु अंतःJथािपत कया जाएगा,
अथा2त:् -
“परंतु यह और क अनुपिJथत मतदाता के मामले मC, डाक मतपB ऐसी रीित मC जारी कया जाएगा, जो िनवा2चन आयोग
+ारा िवनaद_ क$ जाए।”
6. उ. िनयम/ के िनयम 27च के उपिनयम (2) के प6ात् िन9िलिखत अंतःJथािपत कया जाएगा, अथा2त्:-
“(3) अनुपिJथत मतदाता के मामले मC, मत को ऐसे के  मC अिभिलिखत कया जाएगा, जो िनवा2चन आयोग +ारा
िविनaद_ कया जाए:
परंतु वUरV नागUरक या दKांग Kि.य/ के वग2 के अनुपिJथत मतदाता के मामलC मC, ]प 13क मC घोषणा का
अनुमाणन मतदान आफसर +ारा कया जाएगा।”
7. उ. िनयम/ के िनयम 27झ के उप-िनयम (1) मC िन9िलिखत परंतक
ु अंतःJथािपत कया जाएगा, अथा2त:् -
“परंतु अनुपिJथत मतदाता के मामले मC, िनवा2चन आयोग +ारा इस िनिम, जारी कसी िनदेश के अधीन रहते 0ए, डाक
मतपB, िनयम 27च के उपिनयम (3) के अधीन मत को अिभिलिखत करने के िलए उपबंिधत के  को लौटा दया
जाएगा।”।

8. उ. िनयम/ मC “]प 12 ग” के प6ात् िन9िलिखत ]प अंतःJथािपत कया जाएगा, अथा2त्:-

गया था।

NOTIFICATION
New Delhi, the 22nd October, 2019
S.O. 3786(E).—In exercise of the powers conferred by clause (c) of section 60 of the
Representation of the People Act, 1951 (43 of 1951), the Central Government, after consulting the Election
Commission, hereby makes the following rules further to amend the Conduct of Election Rules, 1961,
namely:––
1. (1) These rules may be called the Conduct of Elections (Amendment) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Conduct of Elections Rules, 1961(hereinafter referred to as “the said rules”),
in rule 18, in clause (a), after the sub-clause(iv), the following sub-clause shall be inserted,
namely:-
“(v)persons notified under clause (c) of section 60 of the Act, including absentee voters;”;
3. In the said rules, in rule 27A––
(A) after clause (a), the following clauses shall be inserted, namely:-
“(aa) ‘absentee voter’ means a person belonging to such class of persons as may be notified,
under clause (c) of section 60 of the Act, and who is employed in essential services as
mentioned in the said notification, and includes an elector belonging to the class of senior
citizen or persons with disability;
(ab) ‘nodal officer’ means an officer authorised to verify the claim of an absentee voter not
being an elector belonging to the class of senior citizen or persons with disability;
(B) in clause (b), for the words, “the Act.”, the words “the Act, other than an absentee voter” shall
be inserted;
(C) after clause (b), the following clauses shall be inserted, namely:-
(c) ‘person with disability’ means a person flagged as person with disability in the data base for
the electoral roll;
(d) ‘poll officer’ means the officer deputed to issue postal ballot to elector belonging to the class
of senior citizen or persons with disability;
(e) ‘senior citizen’ for the purpose of this Part means an elector belonging to the class of
absentee voters and is above 80 years of age.”

4. In the said rules, in rule 27C, for the second proviso, the following provisos shall be substituted,
namely:-
“Provided further that in case of an absentee voter, the application shall be made in Form 12D, and
shall contain such particulars as specified therein, and shall be duly verified by the Nodal Officer for
the absentee voter, other than senior citizen or persons with disability, which shall reach the
Returning Officer within five days following the date of notification of election;
Provided also that an application in form 12C or 12D without a certificate from the authorised officer
or nodal officer as required under Part II of Form 12 or 12D shall be rejected;”
5. In the said rules, in rule 27E, in sub-rule (1), after the proviso, the following proviso shall be inserted,
namely:-
“Provided further that in the case of absentee voter, the postal ballot paper shall be issued in such
manner as may be specified by the Election Commission.”
6. In the said rules, in rule 27F, after sub-rule(2), the following shall be inserted, namely:-
“(3) In the case of an absentee voter, the recording of vote shall be made in such centre as may be
specified by the Election Commission:
Provided that in the case of absentee voter in the class of senior citizen or persons with disability, the
attestation of declaration in Form 13A shall be done by the poll officer.”;
7. In the said rules, in rule 27-I, in sub-rule (1), the following proviso shall be inserted, namely:-
“Provided that in the case of absentee voter, postal ballot paper shall be returned to the centre provided
for recording of vote under sub-rule(3) of rule 27F, subject to any direction that may be issued by the
Election Commission in this behalf.”.
8. In the said rules, after “FORM 12C”, the following Form shall be inserted, namely:-
