(अ).—िन निलिखत ाप दलहन ेणीकरण और िचनांकन िनयम, 2018, क धारा 3, कृ िष उपज (ेणीकरण
और िचनांकन) अिधिनयम, 1937 (1937 का 1) को दनांक 27जून , 2018 क अिधसूचना, सं,या सा०का०िन० 597(अ), के तहत
भारत के राजप., असाधारण, भाग- II, धारा 3, उप धारा(i) म/ कािशत कए गए थे, िजनम/ ऐसे सभी 5यि6य7 से िजनके इससे भािवत
होने क संभावना थी, उस तारीख से िजस तारीख को भारत के राजप. म/ कािशत उ:त अिधसूचना क ितयां जनता को उपल;ध करा
दी गई थी, प<तालीस दन क अविध के भीतर आ>ेप और सुझाव आमंि.त कए गए थे;
उ:त सूचना क ितयां जनता को दनांक जून 29, 2018 को उपल;ध करा दी गई थी;
उ:त िनयम7, के संबंध म/ जनता से कोई आ>ेप अथवा सुझाव ाBत नहC Dए ह<;
अत: अब कृ िष उपज(ेणीकरण और िचनांकन) अिधिनयम, 1937 (1937 का 1) क धारा 3 Fारा दGत शि6य7 का योग करते
Dए तथा उ:त धारा क अपे>ानुसार तथा दलहन ेणीकरण और िचनांकन िनयम, 2003 को उन बात7 के िसवाय अिधJांत करते
Dए, िजKह/ ऐसे अिधJमण से पहले कया गया है, के KMीय सरकार िन निलिखत िनयम बनाती है, नामश:-
1 संि>Bत नाम, लागू होना और ारं भ- (1) इन िनयम7 का संि>Bत नाम कृिष उपज (दलहन ेणीकरण और िचनांकन) िनयम
2019 है ।
2 ये मानव खपत के िलए उपयोग म/ आने वाली साबुत, िछलके सिहत और िछलके रिहत क दाल7 पर लागू ह7गे जैसे- उड़द या ;लैक
Pाम (िवQा मुंगो एल.हेBपर), मूंग या Pीन Pाम (िवQा रे िडएटा एल.िवकजेक), मसूर या ल<Uटल (ल/स :यूिलनाUरस मेिडक), अरहर/तुअर
या रे ड Pाम (के जानस काजन एल.िमिलVप), काबुली चना (साइसर एरीUटनम एल.), चना या बंगाल Pाम (साइसर एरीUटनस एल), मटक
या मोठ (िवQा एकोिनटीफोिलया जैक मेयरछल), मटर (पाइसम सतीवम एल.), राजमा (फे िजयोलस वलगेUरस एल.), लोिबया या काउपी
(िवQा अनXयूकुलाय एल. वाप) ।

2 परभाषाएं-(1) इन िनयम7 म/, जब तक क अKयथा अपेि>त न हो,

(क) अिधिनयम से कृ िष उपज(ेणीकरण और िचनांकन) अिधिनयम, 1937(1937का1) अिभ ेत है।
(ख) ‘’ कृिष िवपणन सलाहकार’’ से भारत सरकार का कृिष िवपणन सलाहकार अिभ ेत है ;
(ग) ‘’ ािधकृ त पैकर’’ से ऐसा 5यि6 या 5यि6य7 का िनकाय अिभ ेत है िजसे इन िनयम7 के अधीन ेणी मानक7 और िविन\द]ट Jया के
अनुसार दलहन का ेणीकरण और उसे िचनांकत करने के िलए ािधकार माण-प. अनुदGत कया गया था,
(घ) ‘’अनुसूची’’ से इन िनयम7 के साथ संलQ अनुसूची अिभ ेत है ;
(2) श;द और अिभ5यि6यां जो यु:त कए गए ह< और पUरभािषत नहC है परंतु कृ िष उपज (ेणीकरण और िचनांकण) अिधिनयम,
1937(1937 का 1) और साधारण ेणीकरण और िचनांकन िनयम, 1988 म/ पUरभािषत है, के वही अथ_ ह7गे जो उ:त अिधिनयम म/ ह<;
3. ेणी अिभधान िचन :- ेणी अिभधान िचन म/ ऐसा ‘’एगमाक_ अिधकार िचन’’ होगा िजसम/ ािधकार माण-प. क सं,या
‘एगमाक_ ’ श;द, वVतु का नाम और अनुसूची-I व`णत के सदृश ेणी अिभधान से िमलकर बने ह7गे ।
4. ेणी अिभधान :- दलहन क :वािलटी दशा_ने के िलए ेणी अिभधान वह होगा जो ेणी अिभधान के मानदंड के कॉलम से संबंिधत
अनुसूची 19 क अनुसूची-2 के पैरा 3 म/ िविन\द]ट हो ।
5. पै कग करने क" प#ित (1): दलहन को नए, Vवbछ और शु]क जूट म/ , पॉिल थैल7 िजनका आंतUरक अVतर खाc Pेड सामPी का हो
अथवा पॉली पाउच7 म/ ; खाc Pेड सामPी के उbच सघनता पॉली एथीलीन थैल7 अथवा ऐसी कसी दूसरी पैeकग सामPी म/ जो कृ िष
िवपणन सलाहकार Fारा अनुमोदत ह7 पैक कया जाएगा ।
(2) पैकेिजग सामPी Vवbछ, ठोस कट7 और फफूं द के संदष ू ण से मु:त ह7गे िजससे दलहन क VवाVgय द, पोषक तथा आगhनोलेिBटक
:वािलटी सुरि>त रह/गी ।
(3) पैकेiजग सामPी सिहत आधान7 का िनमा_ण इस तरह के पदाथj से कया जाएगा जो उनके अिभ]ट उपयोग के िलए सुरि>त और उपयु:त
हो उनसे दलहन म/ कोई िवषैले पदाथ_ अथवा अवांछनीय गंध या उGपाद क सुवास नहC आएगी ।
(4) दलहन को पैक आकार7 म/ िविधक माप िवkान (पैकेज क गई वVतुएं) िनयम 2011 िविधक माप िवkान अिधिनयम 2009 (1 का
2010) अथवा कृिष िवपणन सलाहकार Fारा जारी समय-समय पर अनुदेश7 के अनुसार पैक कया जाएगा ।
(5) Gयेक पैकेज म/ समान कार और समान ेणी अिभधान के दलहन अंत`व]ट ह7गे ।
(6) Gयेक पैकेज उिचत और सुरि>त प से बंद और मुहरबंद कया जाएगा ।
6. िचनांकन क" प#ित : (1) ेणी अिभधान िचन Gयेक पैकेज पर कृ िष िवपणन सलाहकार या साधारण ेणीकरण और िचनांकन,
1988 (िनयम 11)अिधिनयम के अKतग_त, के अनुसार इस िनिमत उसके Fारा ािधकृ त कसी अिधकारी Fारा अनुमोदत रीित से सुरि>त
प से िचपकाया जाएगा या मुMत कया जाएगा ।
(2) Gयेक लेबल या पैकेज पर ेणी अिभधान िचन के अितUर:त िन निलखत िविशिlयां Vप]टत: पहचाने जाने योXय प म/
िचनांकत क जाएंगी, अथा_तः-
(क) वVतु का नाम;
(ख) पैक करने का Vथान;
(ग) लॉट या बैच नंबर;
(घ) पैक करने क तारीख;

(ड) ेणी;
(च) शुn भार;
(छ) अिधकतम खुदरा मूय (सभी कर7 सिहत);
(ज) मास.............वष_...............से पूव_ उपयोग के िलए सवoGतम;
(झ) ािधकृ त पैकर का नाम और पता ।
(ञ) िविधक माप िवkान (पैकेज क गई वVतुएं) िनयम, 2011, खाc सुर>ा और मानक अिधिनयम, 2006 (34 का 2006) के
अंतग_त सूचना जो िविन\द]ट क जा सके , अथवा कृ िष िवपणन सलाहकार Fारा या इस िनिमGत् उसके Fारा ािधकृ त कसी
अिधकारी Fारा जारी अनुदश े के अनुसार कोई अKय जानकारी।
(ट) फसल का वष_ अथवा सीजन (वैकिपक), और
(ठ) उqव का देश अथवा उपज का उqव Vथान अथवा भौगोिलक >े. (वैकिपक)।

(3) पैकेज7 पर िचनांकन के िलए यु:त Vयाही उGपाद को संदिू षत नहC कर/ गी।
(4) ािधकृ त पैकर कृ िष िवपणन सलाहकार इस िनिमGत उसके Fारा ािधकृ त कसी अिधकारी का पूव_ अनुमोदन अिभ ाBत करने के
पsचात ेणीकृ त पैकेज7 पर अपना ाइवेट 5यापार िचन या 5यापार tांड िचनांकत करेगा परं तु वह इन िनयम7 के अनुसार ेणीकृ त
पैकेज7 पर लगाए ेणी अिभधान िचन Fारा उ द`शत :वािलटी से िभKन :वािलटी उपद`शत न करता हो ।
7. %ािधकार
%ािधकार %माण प' क" िवशेष शत*:- साधारण ेणीकरण और िचनांकन िनयम, 1988 के िनयम के उपिनयम 3(8) म/
िविन\द]ट शतj के अितUर:त िन निलिखत शतu इन िनयम7 के योजन के िलए जारी Gयेक ािधकार माण-प. क िवशेष शतu
ह7गी अथा_त :-
(क) ािधकृ त पैकर दलहन क :वािलटी का परी>ण करने के िलए साधारण ेणीकरण और िचनांकन िनयम 1988 के
िनयम 9 के अनुसार कृ िष िवपणन सलाहकार या इस िनिमGत उसके Fारा ािधकृ त कसी अिधकारी Fारा अनुमोदत
योXय रसायनk Fारा बंध क जा रही अपनी Vवंय क योगशाला Vथािपत करेगा या कसी अनुमोदत राvय ेणीकरण
योगशाला या सहकारी या सहयोजन योगशाला या ाइवेट वािणिvयक योगशाला के साथ स पक_ करेगा,
(ख) पUरसर7 को VवाVgय द और Vवbछता क दशाw के साथ उिचत संवातन और अbछे काश 5यवVथा म/ रखा जाएगा । इन
संJयाw म/ लगे का`मक7 का अbछा VवाVgय होगा और वे कसी संचारी, संसगx या संJामक रोग से मु:त ह7गे,
(ग) पUरसर7 म/ प:के फश_ वाली पया_Bत भंडारण सुिवधाएं ह7गी और वे कृं तक और कट7 के उGपीड़न से मु:त ह7गे ।
(घ) ािधकृ त पैकर और अनुमोदत रसायनk, परी>ण, ेणीकरण, पैeकग, िचनांकन, सीलबंद और अिभलेख7 के अनुर>ण
संबंधी कृ िष िवपणन सलाहकार या उसके Fारा ािधकृ त अKय कोई अिधकारी के Fारा साधारण ेणीकरण और
िचनांकन िनयम के अनुसार इस िनिमGत समयमय पर जारी सभी अनुदेश7 का अनुपालन कर/ गे।स- सभी अनुदश े 7 का
अनुपालन कर/ गे।

(ग) कृं तक बाल7 और िव]ठा, फफूंदी, जीिवत और मृत कट7, कट7 के टुकड़7, हािनकारक
बै:टेUरया, फफूंदी संदषू क, कवक वृिn, मकडी के जाल7, परजीिवय7, लारवा और बथी से
मु:त;
(घ) दुगzध, बदरं गता और अKय सभी अपिमण7 से मु: त, िसवाय उस सीमा तक िजतना इस
अनुसूची म/ िविन\द]ट कया गया हो;

(ड़) िमलाई गई रं ग सामPी, िवषैले पदाथj और हािनकारक पदाथj के अिधिमण से मु:त;
(च) िवषैले और हािनकर बीज7 जैसे-JोटालाUरया (JोटालाUरया जाित), कॉन_ कोकल
(एPोVटे मा िगथेगो ल ), के Vटर बीन (Uरिसनस क यूिनस ल ), िजमसन खरपतवार (धतूरा
V{ेमोिनयम) और अKय बीज7, जो सामाKयत: VवाVgय के िलए हािनकारक माने जाते ह<, और
से मु:त; और
(छ) असामाKय Vवाद, |लेवर और गंध से मु:त।
इसम/ धािGवक संदषू क7, फसल संदषू क7, ाकृ ितक प से उGपKन होने वाले िवषा:त पदाथj, कटनाशक7, नाशी जीव दवाw के

अवशेष7, सू}म जैिवक अपे>ाw के िलए िनधा_Uरत सीमाw से संबंिधत ितबंध7 तथा खाc सुर>ा और मानक (संद षू क, िवषा:त पदाथ_
और अवशेष) िविनयम, 2011 के अंतग_त यथा िविन\द]ट अKय खाc सुर>ा अपे>ाw और घरे लू 5यापार के िलए खाc सुर>ा और मानक
(खाc उGपाद मानक और खाc योvयक) िविनयम, 2011 खाc सुर>ा एवं मानक अिधिनयम, 2006(34 का 2006) का अनुपालन कया
जाएगा ।

NOTIFICATION
New Delhi, the 17th January, 2019

G.S.R. 36(E).—Whereas, the draft of the Pulses Grading and Marking Rules, 2018 was published as required by
section 3 of the Agricultural Produce Grading and Marking Act 1937 (1 of 1937) in the Gazette of India, Extraordinary,
Part II, Section 3, Sub section (i) vide notification number G.S.R. 597(E), dated the 27th June, 2018 for inviting
objections and suggestions from all person likely to be affected thereby within forty five days from the date on which
copies of the said notification were made available to the public;
And, whereas, copies of the said notification were made available to the public on 29th June, 2018;
And, whereas, no objections or suggestions have been received from the public in respects of the said rules;
Now, therefore, in the exercise of the powers conferred by the section 3 of the Agricultural Produce (Grading and
Marking) Act, 1937 (1 of 1937) and in supersession of the Pulses Grading and Marking Rules, 2003, except as
respects things done or omitted to be done before such supersession, the Central Government hereby makes the following
rules, namely:—
1. Short title, application and commencement.— (1) These rules may be called the Agricultural Produce (Pulses
Grading and Marking) Rules, 2019.
(2) They shall apply to whole, with husk and without husk form of pulses- Urd or Black gram(Vigna mungo Linn.
Hepper), Moong or Green gram (Vigna radiata Linn. Wilczek) , Masoor or Lentil ( Lens culinaris Medik), Arhar or Tur
/Red gram (Cajanus cajan Linn. Millsp), Kabuli chana (Cicer arietinum Linn.), Chana /Bengal gram (Cicer arietinum
Linn.), Matki / Moth(Vigna aconitifolia Jacq Marechal), Peas (Pisum sativum Linn.), Rajma (Phaseolus vulgaris Linn.),
Lobia or Cowpea (Vigna unguiculata Linn.Walp ) intended for human consumption.
(3) They shall come into force on the date of their publication in the official Gazette.
2. Definitions.-(1) In these rules, unless the context otherwise requires,—
(a) ” Act” means the Agricultural Produce ( Grading and Marking ) Act, 1937 (1of 1937) ;
(b) " Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of
India;
(c) "Authorised packer" means a person or a body of persons who had been granted a certificate of
authorisation to grade and mark the Pulses in accordance with the grade standards and procedure
specified under these rules;
(d) "Schedule" means a Schedule appended to these rules.
(2) The words and expressions used in these rules and not defined but defined in the Agricultural Produce
(Grading and Marking) Act, 1937 and General Grading and Marking Rules, 1988 shall have the same meanings
respectively assigned to them in the said Act and the rules.
3. Grade designation mark.— The grade designation mark shall consist of “AGMARK insignia” consisting of a
design incorporating the certificate of authorisation number, the word "AGMARK", name of commodity and grade
designation resembling the design as specified in Schedule-I.
4. Grade designations.— The grade designations to indicate the quality of Pulses shall be as specified in
Schedule-II to Schedule-XIX relating to column of criteria for grade designation.
5. 5. Method of packing.— (1) Pulses shall be packed in new, clean and dry containers made of jute or cloth , poly
woven bags with inner lining of food grade material or poly pouches, high density poly ethylene bags of food grade
material or any other packing material as approved by the Agricultural Marketing Adviser.
(2) The packing material shall be clean, sound, free from insect, fungal infestation which shall safeguard the
hygienic, nutritional and organoleptic qualities of the Pulses.
(3) The containers, including packaging material, shall be made of such substances which are safe and suitable
for their intended use and they shall not impart any toxic substance or undesirable odour or flavour to pulses.
(4) Pulses shall be packed in pack sizes in accordance with the provisions of the Legal Metrology
( Packaged Commodities ) Rules, 2011 made under the Legal Metrology Act, 2009 ( 1 of 2010 ) and in
accordance with the instructions issued by the Agricultural Marketing Adviser from time to time.
(5) Each package shall contain pulses of the same type and of the same grade designation.
(6) Each package shall be properly and securely closed and sealed.
6. Method of marking.— (1) The grade designation mark shall be securely affixed to or printed on each package
in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in
accordance with the provision of rule 11 of the General Grading and Marking Rules, 1988 made under the Act.
(2) In addition to the grade designation mark, the following particulars shall be clearly and indelibly marked
on each label or package, namely :-
(a) Name of the commodity;

(b) Place of packing;
(c) Lot or batch number;
(d) Date of packing;
(e) Grade;
(f) Net weight;
(g) Maximum Retail Price (inclusive of all taxes);
(h) Best before…….date………month……..year;
(i) Name and address of the authorised packer;
(j) any other information specified under the Legal Metrology (Packaged Commodities) Rules, 2011,made under
the Legal Metrology Act, 2009 ( 1 of 2010 ) the Food Safety and Standards Act, 2006 ( 34 of 2006 ) or
instructions issued by the Agricultural Marketing Adviser or any officer authorised by him;
(k) Crop year or season (optional); and
(l) Country of origin or Origin of produce or Geographical region (optional).
(3) The ink used for marking on packages shall not contaminate the product.
(4) The authorised packer may, after obtaining prior approval of the Agricultural Marketing Adviser or an officer
authorised by him in this behalf, mark his private trade mark or trade brand on the graded packages provided that the
same does not indicate quality other than that indicated by the grade designation mark affixed to the graded packages in
accordance with the provisions of these rules.
7. Special conditions of certificate of authorisation.— In addition to the conditions specified under the sub-rule
(8) of rule 3 of the General Grading and Marking Rules,1988, the following shall be the special conditions for every
certificate of authorization issued for the purpose of these rules, namely:-
(a) the authorised packer shall either set up his own laboratory as per the specified norms or have access to an
approved State Grading Laboratory or cooperative or association laboratory or a private commercial laboratory
manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorised by him
in this regard in accordance with rule 9 of the General Grading and Marking Rules, 1988 for testing the quality
of pulses;
(b) the premises shall be maintained in perfect hygienic and sanitary conditions with proper ventilations and well
lighted arrangement and the personnel engaged in these operations shall be in good health and free from any
infectious, contagious or communicable diseases;
(c) the premises shall have adequate storage facilities with clean and proper pucca flooring and free from rodent
and insect infestation; and
(d) the authorised packer and the approved chemist shall observe all instructions regarding testing, grading,
packing, marking, sealing and maintenance of records which may be issued by the Agricultural Marketing
Adviser or any other officer authorised by him in this regard from time to time.

1. Urd whole (Black gram) shall be dried and mature seeds of pulse Vigna mungo Linn. Hepper.
2. Minimum requirements :
(i) Urd whole shall be,-
(a) sweet, sound, clean, wholesome and free from admixture of unwholesome substances;
(a) uniform in size, shape and colour;
(b) free from rodent hair and excreta, moulds, living and dead insects, insect fragments, harmful
bacteria, fungal infestation, mould growth, webs, parasites, larvae and mites;
(c) free from obnoxious smell, discolouration and all other impurities except to the extent as
specified in this schedule;
(d) free from added colouring matter, admixture of deleterious substances;
(e) free from toxic or noxious seeds such as Crotalaria (Crotalaria spps.), Corn cockle
(Argrostemma githago Linn.), Castor bean (Ricinus communis Linn.), Jimson weed (Datura
stramonium), and other seeds that are commonly recognized as harmful to health; and
(f) free from abnormal taste, flavour and odour.
(ii) It shall comply with the restrictions in regard to the limits for metallic contaminants, crop contaminants,
naturally occurring toxic substances, insecticides and pesticides residue, microbial requirements and other
food safety requirements specified under the Food Safety and Standards (Contaminants, Toxins and Residue)
Regulation, 2011 and the Food Safety and Standards (Food Products Standards and Food Additives)
Regulation, 2011 made under the Food Safety and Standards Act,2006 (34 of 2006 ) for domestic trade.
(iii) It shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as
laid down by the Codex Alimentarius Commission, or importing countries requirement for exports.
3. Criteria for grade designation.- The criteria for grade designation for the Urd whole ( Black gram ) shall be as

Explanations:
(1) “Foreign matter” includes inorganic and organic matter. The inorganic matter shall include sand, gravel, dirt,
pebbles, stones, glass and metallic pieces, lumps of earth, clay and mud. Organic matter shall include husk,
chaff, straw, weed seeds, fragments, bran and other inedible grains. Paddy shall be considered as foreign matter
in commodities other than paddy.
(2) “Other Edible Grains” means any edible grains (including oil seeds) other than the one which is under
consideration;
(3) “Damaged Grains Kernels” are pieces of kernels that are sprouted or internally damaged as a result of heat,
moisture, weather or microbes.
(4) “Broken and Fragments” are pieces of sound kernels that are less than three-fourth of the size of the full
kernels. In case of dals, pieces that are less than the size of three-fourths of the split pulses shall be considered as
brokens.
(5) “Weevilled Grains” are grain kernels that are partially or wholly bored by insects injurious to grain but do not
include germ-eaten grains and egg-spotted grains.
