ORDER DENYING DEFENDANTS’ MOTION TO STRIKE COMPLAINT AS A SHAM

THIS CAUSE came before the Court on September 13, 2022 on Defendants’, JASON

MERCIER’s and NATASHA MERCIER’s, Motion to Strike Complaint as a Sham, and the

Court having considered the Motion, hearing argument, and being otherwise fully advised in the

premises, it is hereby:

ORDERED AND ADJUDGED that the Motion is denied as to all counts and the

Complaint is dismissed without prejudice. Plaintiff FERNANDO ROSAS shall have twenty (20)

days from the date of the hearing, no later than December 6, 2021, to file an Amended

Complaint. Thereafter, Defendants shall have twenty (20) days to file a response.
