PETITION FOR CANCELLATION OF ENCUMBRANCE UNDER SECTION 1,

RULE 74, RULES OF COURT, TCT. NO.

PETITION

PETITIONER, to the REGISTER OF DEEDS OF MARINDUQUE, most


respectfully submits this Petition for Cancellation of Encumbrance and states:

1. Petitioner is a Filipino citizen, of legal age and married to;

2. Petitioner, is the buyer and daughter of the registered owner of the real
property covered by TCT Noof the Register of Deeds of the Province

3. Annotated on said title is the extrajudicial settlement by agreement


between heirs, as provided in “Section 1, Rule 74 of the Rules of Court”;

4. Let it be known that my mother and the registered owner of subject real
property, xxx, is still alive, and sold the subject property to me and my
husband, by way of a Deed of Absolute Sale, which was duly notarized
last December 8, 2020, and recorded in the notarial books under

5. Thus, there is a need to CANCEL the said annotation.

PRAYER

WHEREFORE PREMISES CONSIDERED, and by virtue of the provisions


of LRC Circular No. 119, petitioner PRAYS for the cancellation of the annotation in
TCT. No. xxx pertaining to Section 1, Rule 74 of the 1997 Rules of Court, without
any judicial pronouncements.

Other reliefs, just and equitable under the premises, are likewise prayed for.
