• SUMMARY OF PD 1096 (NBCP):
This Rules shall be known and cited as the “Revised Implementing Rules and Regulations of
the National Building Code of the Philippines (PD 1096)” and shall be referred as the “IRR”.
It is hereby declared to be the policy of the State to safeguard life, health, property, and public
welfare, consistent with the principles of sound environmental management and control; and
to this end, make it the purpose of the Code to provide for all buildings and structures, a
framework of minimum standards and requirements to regulate and control their location, site,
design quality of materials, construction, use, occupancy, and maintenance.
RULE I - GENERAL PROVISIONS
BLDG. REQUIREMENTS
Safe construction
Adequate environmental safeguards
Maintain building in safe, sanitary and good working conditions
Land shall be sanitary hygienic or safe, at safe distance from streams or bodies of water and/or sources of polluted air, from
volcano or building source of fire or explosion.
RULE I - GENERAL PROVISIONS
• ADDITION – Any new construction which increases the height and/or floor area of existing buildings/structures.
• AGENCY OF THE GOVERNMENT – Refers to any of the various units of the government including a department, bureau,
office, instrumentality, or government owned or controlled corporation.
• ALTERATION – Works in buildings/structures involving changes in the materials used, partitioning, location/size of openings,
structural parts, existing utilities and equipment but does not increase the building height and/or floor area.
• APPLICATION FORMS – A preformatted prescribed application form duly accomplished and notarized by the respective
design professional with validation matrices related to other building rules and regulations.
• APPLICANT/PERMITTEE – Any person, firm, partnership, corporation, head of government or private institution, organization
of any character applying for the issuance of permits and certificates.
RULE I - GENERAL PROVISIONS
• BUILDING OFFICAL – the Executive Officer of the OBO appointed by the Secretary.
• BUILDING PERMIT – A document issued by the Building Official (BO) to an owner/applicant to proceed
with the construction, installation, addition, alteration, renovation, conversion, repair, moving,
demolition or other work activity of a specific project/building/structure or portions thereof after the
accompanying principal plans, specifications and other pertinent documents with the duly notarized
application are found satisfactory and substantially conforming with the National Building Code of the
Philippines (the Code) and its Implementing Rules and Regulations (IRR).
• CODE – PD 1096, otherwise known as the National Building Code of the Philippines.
• CONSTRUCTION – All on-site work done in the site preparation, excavation, foundation, assembly of
all the components and installation of utilities, machineries and equipment of buildings/structures.
RULE I - GENERAL PROVISIONS
• CONVERSION – A change in the use or occupancy of buildings/structures or any portion/s thereof, which has
different requirements.
• MOVING – The transfer of buildings/structures or portion/s thereof from original location or position to another, either
within the same lot or to a different one.
• OFFICE OF THE BUILDING OFFICIAL (OBO) – The Office authorized to enforce the provisions of the Code and its
IRR in the field as well as the enforcement of orders and decisions made pursuant thereto.
RULE I - GENERAL PROVISIONS
• REFERRAL CODES – The applicable provisions of the various agency and technical professional
codes that are supplementary to the Code.
• RENOVATION – Any physical change made on buildings/structures to increase the value, quality,
and/or to improve the aesthetic.
• STAFF – The personnel of the National Building Code Development Office (NBCDO).
RULE II – ADMINISTRATION AND ENFORCEMENT
SECRETARY
Vested to do Administration and enforcement of the provisions of the Code and IRR, including
the imposition of penalties for administrative violations thereof
Functions:
O Formulate policies, plans, standards and guidelines
O Issue and promulgate additional rules and regulations in the form of Memorandum Circulars
O Exercise appellate jurisdiction over the decisions and orders of the Building Official
O Evaluate, review, approve and/or take final action on changes and/or amendments to existing
Referral Codes as well as on the incorporation of other referral codes
O Prescribe and impose the amount of fees and other charges
O Appoint a Building Official
RULE II – ADMINISTRATION AND ENFORCEMENT
• Functions:
O Assist in the administration and enforcement of the provisions of the Code and its IRR.
O Review, evaluate and take final action on various technical and legal problems
O Conduct seminar/workshops on the Code, its IRR, and BP 344 (Accessibility Law).
O Undertake other duties and tasks assigned by the Secretary.
PENAL PROVISIONS – Any person, firm or corporation who shall violate any of the provisions of the Code
Punishment: 20,000 Max. Fine / 2 years Max. Imprisonment / both
DANGEROUS BUILDINGS
are those declared structurally unsafe or not provided with safe egress, or which constitute a fire hazard, or are otherwise
dangerous to human life, or which in relation to existing use, constitute a hazard to safety or health or public welfare because of
inadequate maintenance, dilapidation, obsolescence, or abandonment; or which otherwise contribute to the pollution of the site or
the community to an intolerable degree.
The Building Official shall order the repair or demolition of dangerous or ruinous building or structure.
RULE II – ADMINISTRATION AND ENFORCEMENT
BUILDING PERMITS
No person, firm or corporation, including any agency or instrumentality of the government shall construct, alter, repair, convert,
use, occupy, move, demolish and add any building/structure or any portion thereof or cause the same to be done, without first
obtaining a building permit therefor from the Building Official.
SUPPLEMENTARY PERMITS
Ancillary Permits - duly signed and sealed plans and specifications by professionals and shall be submitted together with duly
notarized application for Building Permit. The Building Permit is null and void if not accompanied by the Ancillary Permits.

RULE III – PERMIT & INSPECTION
Accessory Permits - issued by BO for accessory parts of the project with very special functions/use which are indicated in the plans
and specifications that accompany the building permit application.
Examples: Bank and records vaults; swimming pools; firewalls separate from the building/structure; towers; silos; smokestacks;
chimneys; commercial/industrial fixed ovens; industrial kilns/furnaces; water/waste treatment tanks, septic vaults; concrete and
steel tanks; booths, kiosks and stages; and tombs, mausoleums and niches
Minor Constructions
Sheds, outhouses, greenhouses, children’s playhouses, aviaries, poultry houses and the like - 6 m2 max. & completely
detached from other building and are intended for owner private use only.
Addition of open terraces/patios resting directly on ground - 20 m2 max. exclusively for owner private use only
Installation of window grilles.
Garden pools for habitation of water plants/aquarium fish - 500 mm Max. in depth and exclusively for private use.
Garden masonry walls other than party walls - 1.20 m. Max. height, footpaths, garden walks and/or driveways.
RULE III – PERMIT & INSPECTION
Repair Works
Repair works not involving any structural member - replacement of deteriorated roofing sheets or tiles, gutters, downspouts,
fascias, ceilings and/or sidings.
Repair and/or replacement of: non-load-bearing partition walls, any interior portion or a house not involving addition or
alteration, doors and windows, perimeter fence and walls, flooring, plumbing fixtures, fittings or pipings.

If not registered owner of lot - Notarized copy of the Contract of Lease, or Deed of Absolute Sale

Clearances from Other Agencies
Locational Clearance - obtained by the owner/permittee from the City/Municipal Zoning Administration
7 days from receipt of application - Application failure to receive reply shall be sufficient not to cause further delay in
processing the building permit application by the BO.

No change shall be made in the type of construction of any building which would place it in a different

their use or occupancy, type of construction, and resistance to fire

Section 704. Location on Property
The rule on allowable floor area is given on Table VII.1 Allowable Maximum Total Gross Floor Area (TGFA) Based on the Allowed
Percentage of Site Occupancy (PSO) of the Total Lot Area (TLA).
The floor areas may increase under appropriate conditions based on existing public space, street or yards, subject to approval of the
Building Official.

Section 707 Maximum Heights of Buildings
The rule on building height limit (BHL) is based on proposed use or occupancy, after the application of other development
controls (DC) and parameters and is provided for in Table VII.2 Building Height Limit (BHL) by Type of Use or Occupancy.
The rules on parking area are given shown on Table VII.4. Minimum Required Off-Street (Off-RROW) cum On-Site Parking Slot, Parking
Area and Loading/Unloading Space Requirements by Allowed Use or Occupancy.

The Secretary shall promulgate rules and regulations for each of other Group Occupancies.
Included in this section is the Guidelines on Building Bulk, Development Controls, Buildings and Other Accessory Structures within
Cemeteries and Memorial Parks.
RULE VIII – LIGHT AND VENTILATION
Section 801. General Requirements of Light and Ventilation
Every building shall be designed, constructed and equipped to provide adequate light and ventilation, must face a street or public alley
or a private street.
Measurement taken from ground level exclusive of courts, yards and light wells which shall be measured clear of all projections.
Maximum site occupancy governed by use, type of construction and height of building. Rule shown on Table VIII.1 Reference Table of
Maximum Allowable PSO, Maximum Allowable ISA, the MACA, the Minimum USA and the TOSL by Type of Land Use Zoning per Lot.
Rules are shown on Table VIII.2 Minimum Setbacks for Residential Buildings/Structures; Table VIII.3. Setbacks for Commercial,
Industrial, Institutional and Recreational Buildings.

o Rooms for Human Habitations – 6m2 with at least dimension of 2m (2x3m)

All buildings for human habitation shall be provided with adequate and potable water supply and other measures for protection and
promotion of health of persons
Shall be supplied from existing waterworks system, conforming to National Standards for Drinking Water Standard. Deepwells subject
to Water Code of the Philippines (PD 1067) and piping installation to Revised National Plumbing Code of the Philippines.
Wastewater to be discharged directly to nearest street sanitary sewer main in accordance with Code on Sanitation of the Philippines
and Revised National Plumbing Code of the Philippines.
Rainwater drainage not to discharge to sanitary sewer system. Disposal to conform to Revised National Plumbing Code of the
Philippines.
RULE IX – SANITATION
Wood construction buildings to be provided with rat-proofing; garbage bins and receptacle be protected against entry of pests and
vermins.
Positive noise abatement devices shall be provided to industrial establishments, conforming to standards of DENR.
Projection over public property shall be measured horizontally from property line.
o Footings – at least 2.40m below grade along national roads, may project not greater than 300mm beyond property line.
o Foundations- not lesser than 600mm below the grade, may encroach 500mm into public sidewalk areas.

RULE X – BUILDING PROJECTION OVER
PUBLIC STREET
Section 1007. Doors and Windows, and the Like
Doors and Windows – not less than 2.40m above pavement or ground line shall not, when fully opened, project beyond properly line
except fire exit doors.
o Public Street or Alley less than 3.60m in width shall be truncated at the corner “Chaflan”
o If arcaded building, no chaflan required notwithstanding the width of public street, less than 12.00m.
RULE XI – PROTECTION OF PEDESTRIANS
DURING CONSTRUCTION OR DEMOLITION
Section 1101. General Requirements
No one shall occupy a street, alley or public sidewalk, nor perform any work unless pedestrian are protected.
Materials and equipment placed or stored on public property shall not obstruct any fire hydrant and the like, nor interfere with drainage
and smooth flow of traffic.
Public or private utilities and services above and below ground shall be protected from damage by any work being done.
RULE XI – PROTECTION OF PEDESTRIANS
DURING CONSTRUCTION OR DEMOLITION
Section 1105. Walkway
o Removal – protective fence or canopy shall be removed 30 days after protection no longer required.
Demolition shall be done by an experienced contractor and must exercise precaution and enough safeguards.

Buildings for construction shall comply with all regulations and specifications and safety standards embodied in Administrative Order
of DOLE.
Definition – nonstructural facing brick, concrete, tile, metal, etc. attached at the backing or structural components for the purpose of

c. Winding Stairways – narrower side of the thread 150mm – 300mm
d. Circular Stairways – used as exit w/ min width of run not < 250mm

g. Handrails – not < 800mm nor more than 900mm.

Section 1209. Bays, Porches and Balconies
Railings for balconies, landings or porches more than 750mm above grade
a. Height – Type V construction shall exceed 8.40m above roof, shall not extend more than 3.60m in height w/ the roof.
b. Towers and Spires – framework of iron, steel or reinforced concrete when not enclosed, towers not enclosed w/c extend more than
20m above grade, shall not occupy more than ¼ of street frontage of bldg.
Shall be designed, anchored, supported, reinforced, constructed and installed in accordance with generally accepted principles of
engineering.
a. Fire-Extinguishing Systems
1. Every storey, basement or cellar w/ 200sq.m or more w/c is used for habitation, etc. w/c has an occupant load of more than 20.
2. Dressing, rehearsal rms., workshops or factories w/ occupant load of more than 10 or assembly halls w/ occupant load of more
than 500, if the next doors of rooms are more than 30.00m from safe dispersal area.

4. Pressure and Gravity Tanks – 1500 liters/water per minute for not < 10 minutes
5. Fire pumps – capacity not < 1000 liters per minute w/ pressure not < 2 kg per sq.cm connected to street main w/ not < 100mm
diameter

CONSTRUCTION REQUIREMENTS
Section 1213. Stages and Platform
Design must be in accordance with the Code, with separating walls not less than 1-hr Fire-Resistive Occupancy Separation.
a. Construction – 1 hr fire resistive, ceiling shall not be < 2.40m from finished floor. Room shall have a floor area of not < 7.00sq.m and
3.50sq.m for every additional machine.
b. Exit – Projection room – at least 2 exits separated by not < 1/3 the perimeter of room, each at least 750mm wide and 2.00m high
c. Ports and Openings (3 kinds) – projection, observation, combination ports
1. Ports required – limited in area to 750 sq.cm, not more than 1 observation ports w/c be limited to 1300 sq.cm. There shall be not
more than 3 combination ports w/c not exceed 750mm by 600mm. Projection ports not to exceed 4,500 sq.cm in area.
d. Ventilation
1. Inlet – fresh air inlet from the exterior bldg. not < 900sq.cm. & protect w/ wire netting installed w/in 50mm of the floor in every
projection room
2. Outlets – provide 1 or more mechanical exhaust systems.
Installation shall conform to fire-resistive rating requirements and type of construction of building.
RULE XIII – ELECTRICAL AND MECHANICAL
REGULATIONS
Section 1301. Electrical Regulations
All electrical systems, equipment and installation shall conform to provisions of Philippine Electrical Code Part 1 (PEC-1) and Part 2
(PEC-2) as adopted by the Board of Electrical Engineering pursuant to RA 7920-Philippine Electrical Engineering Law.
Refer to Table XIII.1. Clearance of Wires, Conductors, Cables and Unguarded Rigid Energized Parts Adjacent but not Attached to
Buildings and Other Installation Except Bridges
All mechanical systems, equipment and installation shall conform to provisions of Philippine Mechanical Code as adopted by the Board of
Mechanical Engineering pursuant to RA 8495-Philippine Mechanical Engineering Law.
RULE XX – SIGNS
No sign or signboard shall be erected to confuse or obstruct view or interpretation of any official traffic sign, signal or device.
Any provision declared unconstitutional or invalid, other sections and provisions not affected shall continue to be in full force and
effect.
All Administrative Orders, rules and regulations, memoranda, circulars, etc. inconsistent or contrary to the provisions are hereby
repealed or modified accordingly.
IRR takes effect 15 days after publication once a week for 3 consecutive weeks in newspaper of general circulation
