paid by him when he submitted his tender as security for the due fulfillment of the contract to
the satisfaction of the Executive Engineer, Cauvery Basin Division, Thanjavur (hereinafter referred to
as the EXECUTIVE ENGINEER

A deduction of 2% will be made towards income tax from every payment made to the
Contractor. A deduction of 2% will be made towards sale tax from every payment made to the
Contractor for civil work exceeding Rs. 1,00,000 ( Rupees one lakh only)

And whereas Contractor has also signed the copy of the Tamilnadu Detailed standard
specifications and addenda volume there to maintained in the Executive Engineer, Cauvery Basin
Division Office in acknowledgement of being bound by all the conditions of the clauses of the standard
preliminary specification and all the specification for items for works described by a standard
specification Number in Schedule A.

Whereas the Contractor has agreed to execute upon and subject to the conditions set forth in the
preliminary specifications of the Tamilnadu Detailed Standard Specifications and such other conditions
as are contained in all the specifications forming part of the contract (here in after to as "the said
conditions") the works shown upon the drawings and described in the said specifications and set forth
in schedule A as the "probable quantities" and comply with rate of progress noted at end if this Articles
of Agreement for sum of Rs.876493 /- ( Rupees Eight Lakhs Seventy Six Thousand Four Hundred
and Ninety Three only) such other such other sum as may be arrived at under the clause of standard
Preliminary Specification relating to "Payment on lump sum basis or by final measurement at unit
price".
Now it is hereby agreed as follows :-
1) In Consideration of the payment of said sum Rs.876493 /- ( Rupees Eight Lakhs Seventy Six
Thousand Four Hundred and Ninety Three only) as may be arrived at under the clause of the
standard specification relating to "payment of lump sum basis or by final measurement at unit prices the
contract will upon and subject to the said conditions execute and complete the works shown upon the
said drawings and described in the said specifications and to the extent of the probable quantities
shown in schedule A with such variations by way of alterations of additions to or deduction from the
said work and method of payment therefore as are provided for in the said conditions.

2) The term Executive Engineer in the said conditions shall mean the Public works officer in
charge of the Cauvery Basin Division, Thanjavur who shall be competent to exercise all the powers and
privileges reserved herein, in favour of the Government with the previous sanction of or subject to the
rectification by the # Executive Engineer, Cauvery Basin Division, Thanjavur in cases where such
sanction or ratification may be necessary.
Note :- Of the six recite clauses relating to the additions security marked the one suitable to the kind of
security actually deposited should be retained and the rest scored out with due attestation at the time
of execution of the agreement.

1) The arbitrator fulfilling the duties set forth arbitration clause of the Standard Preliminary
specifications shall be Superintending Engineer of Vellar Basin Circle, Cuddalore upto Rs.50000/- and
beyond that as specified in special condition in para 32.

2) Times shall be considered as the essence of the agreement and the Contractor here by agrees
to commence the work as soon as this agreement is accepted by competent authority as defined by the
Tamilnadu Public works Department code and the site (or premises) is handed over to him as provided
for in the said conditions agrees to complete the work within 2 (Two) month from the date of such
handing over to the site (or premises) and to show progress as defined in the tabular statement "Rate
of progress below subject never the less to the provisions for extension of contained clause 59 of the
Standard Preliminary Specification.

3) The said conditions shall be read and constructed as forming part of this agreement and the
parties hereto will respectively abide by and submit themselves to the conditions and stipulations and
perform the agreements on their parts respectively.

4) Upon the terms and conditions of this agreement being fulfilled and performed to the
satisfaction of the Executive Engineer the security deposited by the Contractor as here in before recited
or such portion there of as he may be entitled to under the said conditions shall be returned to the
Contractor.
