Heard Mr. B.D. Konwar, learned Senior Counsel assisted by Mr. H. Agarwal, learned
counsel for the petitioner as well as Mr. K. K. Parasar, learned Addl. P.P. appearing for the
State.

The petitioner, namely, Ronak Agarwal has filed this petition under Section 438 Cr.P.C

with prayer for pre-arrest bail as he is apprehending arrest in connection with Dispur P.S.
Case No. 2427/2022, under Section 381/406/420 IPC.

It is submitted that the Section 381/406/420 IPC is not attracted in this case. The FIR is
opaque and does not specifically allege what articles were removed. The quantity of articles
were not mentioned as well as the articles were not described properly. It is also submitted
that the petitioner is a student who is 18 years old.

In the event of his arrest, the petitioner is to be enlarged on bail of Rs. 25,000/- with a
suitable surety of like amount to the satisfaction of arresting authority in connection with
Dispur P.S. Case No. 2427/2022 .

The petitioner is directed to co-operate with the investigation and not to exercise
threats during investigation or to the witnesses. The petitioner is not to leave the
jurisdictional Court’s area without prior permission from the jurisdictional Court till completion
of investigation.
