UPON hearing the counsel the Court made the following


O R D E R

1 By the impugned order of the Single Judge of the High Court of Judicature at
Allahabad, the application for bail filed by the petitioner under Section 439 of
the Code of Criminal Procedure 1973 has been rejected. The petitioner is
involved in Case Crime No 17 of 2022 for alleged offences under Sections
366 and 376 of the Indian Penal Code.

2 The petitioner is in custody since 3 March 2022. The charge-sheet has been
filed.

3 The submission which has been urged on behalf of the petitioner is that the
relationship between the parties was consensual and they had, in fact,
travelled together. We are desisting from indicating any prima facie opinion
on the merits of the submission since the trial is pending.

4 In the facts and circumstances, we direct that the petitioner be enlarged on


bail subject to such terms and conditions as may be imposed by the sessions
court in connection with Case Crime No 17 of 2022.

5 The Special Leave Petition is accordingly disposed of.

6 Pending applications, if any, stand disposed of.
