AFFIDAVIT
I, Vidhya G, D/o S.Gopalan, Age:33, Occupation: Law student, R/o Flamingo Residency,
Falcon Valley Colony, Shaikpet, Hyderabad-500008, do hereby solemnly affirm and state
on oath as follows:
1. I submit that I am the petitioner in the main petition as well as the present interim
petition and as such I am well acquainted with the facts of the case.
2. I submit that I have filed for the maintenance case praying for this Hon’ble Court to
direct the respondent to pay me Rs. 1,00,000/- month as maintenance.
3. submit that I am a student and have no source of income. I am living at the mercy of
my parents and friends. I was thrown out of the matrimonial home in the middle of the
pandemic during 2020 while there was a complete lockdown. I had to obtain e-pass
and take shelter in Bangalore temporarily due to incapacity to travel ti my parents in
Hyderabad during middle of a complete lockdown. I had to leave Bangalore and come
to Hyderabad once the pandemic was over due to the severe sexual assault and loss
of baby caused by the respondent in Bangalore.
4. I submit that I am studying LLB in Hyderabad and I have a monthly expense of Rs.
40,000 including Food, Shelter, and clothing but the legal and medical expenses are
mounting and incrementing due to the atrocities of the respondent, and I require Rs.
1,00,000/- per month for my bare minimum livelihood as well as travel, legal and
medical expenses. This respondent has filed his divorce petition in Madurai deliberately
without jurisdiction to harass and destabilize me financially, his mother also has filed
domestic violence case against me in Madurai to further harass and loot me. I am
forced to travel to Madurai costing Rs. 10000/- to and fro.
5. I further submit that the respondent is represented by top legal counsels in all his
cases, and I am unable to get any relief from the courts as I am appearing in person in
my cases, unable to employ legal assistance on par with the respondent. I am entitled
to live the same standard of living and employ same level of advocates as that of the
respondent and this disparity in economic statis between mine and the respondent
must be rightly addressed by using this social beneficial legislation of CrPC 125.
6. I submit that I was granted ex-parte maintenance on 07.06.2023 by this Hon’ble Court
which proves that there are more than prima facie merits in my case to award ad-hoc
interim relief with immediate effect else I would be left with no means to even prosecute
this case.
7. I submit that it is well settled law that the wife is entitled to live the same standard of
living, commensurate as that of the husband and his family.
8. I submit that the respondent is a post graduate with B.E and M.B.A degrees working as
HR Manager earning monthly income of R.s 3,00,000/- per month in Photon Infotech
Ltd at ITPL Bangalore and it is sufficiently proved from his own verified LinkedIn Job
networking account and with new evidence that has come in my hands that the
respondent is also deriving his income from the Family Business as a passive partner
(Trade Name: HOCHERMAN CONSULTING and GSTIN No. 33EIBPP6116F1ZI) with
legal name of business of his brother and address that of the native parental address of
the respondent.
Hence, I humbly pray to this Hon’ble Court that may be pleased to order the respondent to
pay a sum of Rs. 100000/- per month as interim maintenance till the disposal of the main
case.

For the grounds stated in the accompanying affidavit, it is prayed that this Hon’ble
Court may be pleased to pass order directing the respondent to pay monthly
maintainance of Rs. 1,00,000/- on adhoc ad-interim basis till the disposal of the main
case, otherwise the petitioner would be left in greater hardship to even prosecute her
cases and to bare the legal expenses to defend the cases filed by the respondent and
his circle apart from her bare minimum livelihood.
