Elements:

a. The offender is a Filipino citizen or a resident alien.

b. There is war in which the Philippines is involved.
c. The offender levies war against the government or adheres to its enemies, giving them aid or
comfort.

a. The offender owes allegiance to the Government and not a foreigner.

b. He has knowledge of any conspiracy (to commit treason) against the Government.
