PREAMBLE
1

We, the Teachers-Employees Association of Mendez, beseeching the help of the


All-powerful God, in organizing a just and equitable association that shall
embody our principles and aspirations, adhere to the DepEd’s Philosophy,
Vision, and Mission, foster esprit de corps in our profession, promote the
general welfare of its members, strengthen unity and harmonious accord, and
proliferate in us the tenets of love, honesty, and integrity, do ordain and
promulgate this Constitution.

ARTICLE I – NAME AND DOMICILE

Section 1. The Organization shall be known as Teachers- Employees


Association of Mendez, and referred to as “TEAM”.

Section 2. The Office is located at Mendez Central School.

BUILDING – serves as the foundation and the growing up TEAM

ARTICLE II – STATEMENT OF PURPOSES

This TEAM has been created for the following purposes:


1. To promote unity and harmonious accord among members in
consonance with the foregoing Deped’s vision and mission for effective
and efficient work performance.

2. To uphold the rights and caters to the mutual benefits of the all the
members as well as respect to human dignity which conforms to Deped’s
policies and regulations.

3. To maintain and preserve the function of TEAM that protects and


upholds the interest of all its members.

4. To be an open channel of communication for airing sentiments among its


members.

5. To support all aspects of growth and development of its members.

ARTICLE III – MEMBERSHIP, FEES AND FUNDS

Section 1. All active regular – permanent teachers and employees shall


automatically considered members of the TEAM.
Section 2. All teachers and employees shall automatically be separated from
membership in case of resignation from the service, retirement,
termination.
Section 3. Membership for teachers and employees promoted and transferred
to other station is optional.
Section 4. The TEAM is a stock and profit organization. All the funds of the
association are derived from the fees and fund-raising efforts of
the members.

Section 5. The members shall pay the annual due amounting to P 300 and
shall be settled on the fourth week of the month prior to the first
day of service in every school year to be used as a
revolving/contingency fund of the TEAM. Increment on annual due
shall be determined by the executive board as deemed necessary.

Section 6. The fund shall be deposited to a refutable bank under the name of
the TEAM as represented by the current president and the
treasurer as signatories. The passbook shall be turned over to the
district accounting officer during summer for safe keeping and shall
only be accessed by two signatories in consensus as need arise.

ARTICLE IV – MONETARY ASSISTANCE, BENEFITS AND RIGHTS

Section1. A member of the TEAM shall have the following benefits:

a. The TEAM shall extend assistance on the needs of members that are
related to the working condition.

b. Members shall have the following monetary benefits:

1) Hospitalization assistance amounting to P 10, 000 shall be


given to a member who underwent major operation and
whose expenses reached to P40, 000 and up in a year
supporting with medical abstract and official receipt.
2) Mortuary assistance amounting to P 50 shall be given to the
member whose immediate family members (legal
husband/wife, children, parents and siblings of single
members) passed away.

3) Mortuary assistance amounting P 200 shall be given to the


legal beneficiaries of any member who passes away.
4) Upon the death of the member, the member shall receive 50%
of his/her total contribution.
5) Upon retirement, the retiring member shall receive 40,000 as
separation pay.
6) Upon resignation, the resigning member shall receive

c. Monetary benefits that require immediate response shall be


decided upon as soon as possible and should be granted within three
working days and/or depending on the availability of funds.

Section 2. All honorary members shall enjoy all the rights and privileges of
regular members except in the deliberation or discussion, to vote,
and to be voted into the office of the Association.

Section 3. All monetary assistance beyond the TEAM constitution and by-laws
shall be upon the approval of the District Supervisor and
consequently, shall be decided by the officers. After the requisite/s
has/have been met the TEAM shall extend monetary assistance
amounting to P ______ taken from the existing funds and shall be
accommodated by elected treasurer of the current term.

ARTICLE V – DUTIES AND RESPONSIBLITIES OF A MEMBER

Section1. Every member shall carry out the following duties and
responsibilities:
a. To uphold and abide in all the provision stated by this Constitution.

b. To abide by all implementing policies and rules of the Department of


Education.

c. To acknowledge implementing policies and rules of Teachers’ Federation.

d. To follow all reasonable policies and rules that the TEAM shall need to
implement.

e. To be updated or informed and actively participate in all activities,


programs and project of the TEAM.

f. To pay all the prescribed fees, contribution, and other dues agreed by the
members of the TEAM.

g. It is the duty of the member to provide necessary documents (e.g.


marriage or death certificate) after the claim monetary benefits for the
period of fourteen (14) days or two (2) weeks after the release of the
assistance. The said documents shall be given to the elected treasurer in

the current term for filing and auditing purposes. In case the said
requisite has not been provided the officers of the current term shall
take due consultation and deliberation wherein, they (officers) shall
issue a resolution.(e.g. monetary benefits shall be returned or shall
consider the reason of the claimant)

h. To observe proper decorum during meetings.

i. To uphold propriety and decency at all times.

j. To inform the TEAM in writing pertinent to the concerns, needs, and


problems that needs assistance of the TEAM.

ARTICLE VI – EXECUTIVE OFFICERS AND THE TERM OFFICE

Section 1. The Teachers Employees Association of Mendez shall be governed by


the sixteen (16) members of Executive Board who shall be elected by
the TEAM members.

Section 2. The TEAM-Executive Board is composed of the following:

(1) President; (2) Vice President; (3) Secretary; (4) Treasurer; (5)
Auditor; (6) Sgt. at Arms; (7) Peace Officer; (8) Public Relations
Officer; (9) Business Manager; (10) Muse and Escort; and (11)
Board Members or Board of Trustees.

Section 3. The term of office of the Executive Board shall be for 2 years
and maybe re-elected for another term. The maximum term for
any elective position is 4 years
Section 4. Minor offices and ad hoc committees may be created and appointed
by Executive Board as deemed necessary for the efficient
administration and execution of the affairs of the TEAM.

ARTICLE VII – BOARD OF REPRESENTATIVES AND THE TERM OFFICE

Section 1. The Teachers Employees Association of Mendez shall have Board


Members that shall be headed by the president of each school
within the district of Mendez.

Section 2. The member of the Board of Representatives (BM) shall cater and air
the needs and concerns of their respective locale for efficient and
effective resolution.

Section 3. The BOR shall assists the Executive Board in all programs and
activities of the association

ARTICLE VIII – DUTIES OF OFFICERS

Section 1. The administrative planning and execution of the activities of the


Association shall be vested on the Executive Board and it shall
perform those functions appurtenant to said offices. Matters of
general policy may be planned and executed by the officers.
However, the organization, acting as a body on any regular or
special meeting, may provide general matters or specific actions for
the Executive Board to represent the organization.

Section 2 Duties of Officers:


President
1. Shall preside in all meetings of the Association.
2. Shall represent the Association on all transactions.
3. Shall present term reports in the general assembly.
Vice-Presidents
1. Shall assist the President in his/her duties and responsibilities.
2. Shall act in behalf of the President in his/her absence.
3. Shall perform other duties as may be assigned by the President.

Secretary

1. Shall keep the records of the Association.


2. Shall take down the minutes of every meeting.
3. Shall prepare communications and reports of the president.
4. Shall call officers to the meeting as instructed by the President.
5. Shall perform other duties as assigned by the President.

6. Shall keep a roster of the members of the Association.


Treasurer
1. Shall keep the book of accounts of the Association.
2. Shall be responsible for the disbursement of funds of the Association.
3. Shall keep a record of receipts of all expenses.
4. Shall report the financial status of the Association during meetings and
upon inquiry by any officer.
Auditor
1. Shall work closely with the treasurer regarding the financial status of the
Association.
2. Shall audit financial reports prepared by the treasurer.
3. Shall sign financial reports.
4. Shall perform other tasks as assigned by the President.
Sergeant at Arms
1. Shall keep the meeting in order

2. Shall handle administrative task like collecting ballots, tallying votes and
recording od attendance.

3. Shall warn or eject the members if they are disrupting the meeting.

4. Shall maintains order and decorum at meetings.


Peace Officer
1. Shall uphold the peace.

Public Relations Officer

1. Shall act as liaison personnel of the Association.


2. Shall be responsible for the establishment and maintenance of good
public relations of the Association.
3. Shall take charge of information dissemination as necessary.

4. Shall perform other tasks as assigned by the President.


Business Manager
1. Shall transact business as approved during meetings.
2. Shall perform tasks pertaining to the ways and means of the Association.
3. Shall perform other tasks as assigned by the President.
Muse and Escort
1. Shall avoid negative poles by providing a natural division of duties.

2. Shall be responsible for providing the ideas and energy of the TEAM
Board Members
1. Shall ensure the availability of adequate financial resource.

2. Shall account to the stakeholders for the organization’s performance.

3. Shall govern the TEAM by establishing broad policies and setting out
strategic objectives.

ARTICLE IX – ELECTION

Section 1. Election for TEAM shall be officiated by the Commission on Election


Officers raffled from the list of elected secretaries in each school
during the election year.

Section 2. The Comelec is composed of the following: (1) Chairman; (2) Poll
Clerk; (3) First Member; and (4) Second Member.
Section 3. Elections shall be held every 2 years, particularly, on the last Friday
of the six month (June).
Section 4. Elections shall be either by viva-voce or secret balloting.

Section 5. Only members of the TEAM present during the election shall have
the right to vote and be voted for.

ARTICLE X – DUTIES OF ELECTION OFFICERS

Section 1. The Election Officers shall be the over-all in charge on the election
process of TEAM officers.

Section 2. Duties of Election Officers:


Chairman
1. shall preside on the election process

2. shall pronounced the winner of the election

Poll Clerk
1. shall assists the chairman

2. shall canvass, count and tally the votes First and Second Member

3. shall be responsible for the campaign paraphernalia

4. shall assists the poll clerk in counting of votes

ARTICLE XI – MEETINGS

Section 1. The General Assembly meets every year and shall be held 5 days
before the school year ends or as may be deemed necessary which
shall be called upon by the president or two thirds (2/3) of the
Executive Board.

Section 2. The meeting of the TEAM Executive Board shall be held every last
Friday of the month or as may be deemed necessary and shall be
called upon by the president or two thirds (2/3) Executive Board.

Section 3. Any special meeting may be called upon by the request of the two
thirds (2/3) of the TEAM members.

Section 4. Attendance of a simple majority shall constitute the quorum. In the


absence of the incumbent officer, anybody maybe delegated to act
for and in behalf of the said officer with a necessary authorization.

ARTICLE XII – AMENDMENTS

Section 1. Any member of the organization can propose amendment to the


Constitution.
Section 2. Any amendment in this Constitution shall be approved by at least
two-thirds of the members present in the general assembly.

ARTICLE XIII – SEPARABILITY CLAUSE

Section1. In case any provision in this Indenture or in the Securities shall be


invalid, illegal or unenforceable, the validity, legality and enforceability of the
remaining provisions shall not in any way be.

EFFECTIVITY

This Constitution and By- Laws shall take effect immediately upon ratification
by a majority vote (50% + 1) of all its members in a plebiscite called for the
purpose.
