His Majesty King Bhumibol Adulyadej is graciously pleased to proclaim
that:

Be it, therefore, enacted by the King, by and with the advice and
consent of the National Legislative Assembly acting as the National Assembly, as
follows:

Section 1. This Act is called the “Tobacco Products Control Act,

B.E.

Section 2. This Act shall enter into force after the expiration of one
hundred and twenty days as from the date of its publication in the Government
Office of the Council of State Office of the Council of State
Gazette.๑

Section 3. In this Act,

“tobacco product” means the tobacco under the law on tobacco and
any other products composed of tobacco leaves or Nicotiana tabacum, to be used
by smoking, sucking, sniffing, pulling, chewing, eating, blowing or spraying into the

mouth or nose, or by other means which caused the same effect;
“package” means a pack, carton, or other containers using for wrap or
contain tobacco products;

“competent official” means a person appointed by the Minister for

the execution

“Minister” means the Minister having charge and control of the execution
of this Act.

Section 4. No person shall distribute, sell, exchange, or give tobacco
products to a person whom he knows that a purchaser or receiver is under
eighteen

Section 5. No person shall sell tobacco products by vending machines.

Section 6. No person shall perform the following acts:
(1) sell goods or render services with the distribution, addition, gift of
tobaccoof products

(2) sell tobacco products with the distribution, addition, gift of or
exchanging with other goods or services;
(3) give or offer privileges to attend any competition

or show, receive

any service, or get any benefit to the purchaser of tobacco products in favour of
purchasing or to a person who exchanges or redeems the package of tobacco
products with such privileges.

Section 7. No person shall distribute tobacco products in a manner
of their samples, or in order to spread out tobacco products or to persuade the

public to consume such tobacco products except for a customary gift.

Section 8. No person shall advertise tobacco products or expose the

radio, broadcast television, or by any other advertising method, or to use the name
or emblem of tobacco products in the shows, games, services or any other activity to

The provision of paragraph one shall not apply to the live broadcast

distribute in the Kingdom.

Section 9. No person shall advertise goods using the name or
emblem

Section 10. No person shall manufacture or import for sale,

distribute,

Section 11. The composition of tobacco products for sale shall be
in accordance with the standards prescribed in the Ministerial Regulation.

the sale or import of such tobacco products.

Section 12. Before tobacco products being released from
manufacturing site or imported into the Kingdom, as the case may be, the
manufacture or importer of the tobacco products shall display

the label on the

package of tobacco products.
The rules, procedures and conditions of label display and the
statement specified in the label shall be prescribed by the Minister and published in

Section 13. No person shall sell tobacco products without labels

Section 14. In performing duties under this Act, the competent

Section 15. In performing duties under this Act, the competent

Section 16. In performing duties under this Act, the competent
official shall be the official under the Penal Code.

Section 17. Any person who violates section 4 or section 5 shall be
liable to imprisonment for a term not exceeding one month or to a fine not
exceeding two thousand Baht,

Section 18. Any person who violates section 6, section 7, section 9

or section

Section 19. Any person who violates section 8 paragraph one, shall

Section 20. Any manufacturer or importer who fails to inform the list,
reports incomplete or false list, or sells or imports tobacco products in violation of

section 11, shall be liable to imprisonment for a term not exceeding six months or to
a fine not exceeding one hundred thousand Baht, or to both.

Section 21. Any manufacturer or importer who violates section 12
shall be liable to a fine not exceeding one hundred thousand Baht.

Section 25. If an offender under this Act is a juristic person, a managing

shall be liable for the punishment prescribed for such offense, except where he can
prove that he does not acknowledge in so doing or does not give consent to do so.

Section 26. The Minister of Public Health shall have charge and control
of the execution of this Act and shall have the power to appoint competent officials
as wellofasState

publication in the Government Gazette.
