BASIC INFORMANTION ON TODAY’S ORDER PAPER

PROCEDURAL MOTION – REDUCTION OF PUBLICATION
PERIOD OF A SPECIFIED BILL
(The Chairperson, Budget and Appropriations Committee)
This motion seeks the reduction of the publication period of the Supplementary
Appropriation (No. 3) Bill National Assembly Bill No. 71 of 2023) from seven (7)
days to four (4) days.
Support
i. This is a move to enhance faster facilitation and salvage of the bodies and
state agencies that are in dire need of the funding.
ii. Time reduction will also ensure timely completion of crucial house
business before commencement of the long recess.
Reject
i. The hastening of the publication period of the said bill will not give
enough time to the relevant stakeholders to fully scrutinize and analyze
the Bill before publication.
ii. This being the budget of the nation, there is need to take keen interest on
how the taxpayers’ money is being spent to prevent cases of
misappropriation and misuse of public funds.

MOTION – SESSIONAL PAPER NO. 2 OF 2023 ON THE NATIONAL TAX


POLICY
(The Chairperson, Departmental Committee on Finance and National Planning)

Support
i. This bill will regulate the unpredictable frequent changes to the tax law,
which has resulted in uncertainties both to the employers and end employees
due to ever increasing tax.
ii. This bill will streamline the country’s tax system to develop a predictable
tax regime making it easy for businesses to plan ahead.
iii. It aims at raising the gross Domestic Product to the desired East African
Community (EAC) target of 25%, thereby raising sufficient resources to support the
government’s development agenda.
Reject
i. Concerns have been raised on the failure of the bill to address the cross-
cutting issues such as double taxation.
ii. The bill failed to comprehensively stipulate the mechanisms of
determining the excise duty rates as well as tax exemption, making the
provision prone to exploitation

MOTION – REPORTS OF THE AUDITOR-GENERAL ON TWENTY-


THREE (23) NON-COMPLIANT STATE CORPORATIONS
(The Chairperson, Public Investments Committee on Social Services,
Administration and Agriculture)
This report highlights the plight of several sate corporations established with
SemiAutonomous Government Agencies (SAGAs) yet they still operate under the
parent ministries.
There are also concerns that 23 state corporations did not comply by submitting
their financial reports to the auditor general according to the Public Finance
Management Act, 2012.
Observations
- Some state corporations did not have substantive Board of directors, and
- accounting offices (CEOs).
- Some state corporations were established through executive orders but lack
- clear mandate, including the Agricultural Infromation Resource Centre.
- Some of the Cabinet Secretaries were accused of failure to operationalize
- and grant autonomy to the State operations

MOTION – PROCEEDINGS OF THE SECOND ORDINARY SESSION OF


THE SIXTH PAN-AFRICAN PARLIAMENT (PAP)
(Member of the Pan-African Parliament)

The Pan-African Parliament attracted the attendance of several Pan-Africanists and

Corporations geared towards the African Agenda on the African Continental Free

Trade Area Agreement (AfCFTA), climate change, peace and security issues in

Africa, migration issues, fight against corruption and Africa’s socio-economic

transformation.

Some of the recommendations made include: -

i. Recommendation by Women caucus “for an inclusive digital world:

ii. Innovation and technologies for gender equality”

iii. Recommendation from the youth dialogue held in the Kingdom of

iv. Morocco (Rabat) 4-6 December 2022.

v. Recommendation on Climate Policy and Equity in Africa;

vi. Recommendation for the resolution on the ongoing conflict in Sudan and

vii. promotion of peace and stability in the region; and


viii. a Motion proposed by the Permanent Committee on gender equality, the

ix. family, youth and persons with disabilities on the budget of the PAP

MOTION – PROCEEDINGS OF THE 2023 UNITED NATIONS HIGH


LEVEL POLITICAL FORUM ON SUSTAINABLE DEVELOPMENT
(Vice Chairperson, Parliamentary Caucus on Sustainable Development (SDGs)
Goals and Business)
The high level Forum was centered on the theme; " Accelerating the recovery

from the coronavirus disease (COVID-19) and the full implementation of the

2030 Agenda for Sustainable Development at all levels ”.

Futher, the discussion was heavily focused on the effective and inclusive recovery

measures to address the impacts of the COVID-19 pandemic on the Sustainable

Development Goals (SDGs) and explore actionable policy guidance for the full

implementation of the 2030 Agenda and the SDGs

MOTION – ENHANCING REPORTING OF PARLIAMENTARY

BUSINESS ON ONLINE PLATFORMS

This motion seeks to streamline the Parliament’s social media and Communication

platforms to fully realize its mandate of Informing Educating, Outreaching and

Engaging members of the public, on the business conducted by parliament.


Support

i. With the current trend in information dissemination and reporting, social

media has come in handy as the most preferred platform especially

amongst the larger population of Kenyans. In tis regard there is need for

the Parliament to streamline their communication and media structure to

suit the market demand and reach more audience.

ii. This will promote transparency of the parliament’s work, ensuring that

their impact is felt in the grassroots, as provided for by Article 118of the

constitution of Kenya 2010.

iii. The objective collaboration of the Media Relations Department with the

various County/Constituency offices will help bring to light the various

progress and valuable activities conducted by honourable members in

their respective areas of administration.

iv. This will also enhance the parliament’s social media mandate of

Information, Education, Outreach and Engagement with members of the

public.
THE NATIONAL DISASTER RISK MANAGEMENT BILL
(NATIONAL ASSEMBLY BILL NO. 24 OF 2023)
(The Leader of the Majority Party)

The draft Disaster Management bill seeks to establish a Disaster Risk Management
Authority which shall liaise with the national and county governments to deal with
catastrophes, and also offer advice on disaster risk management measures.

It also seeks to establish a Disaster Risk Management Fund to provide cash for
disaster preparedness, mitigation, response and recovery measures.

Support

i. This will hasten mobilization of resources and mitigate against


deadly outcomes of catastrophes such as drought, floods and
terror attacks.
ii. This Bill seeks a formulation of a proper Pubic Private
Partnership on disaster management to help mitigate the impact
of the calamities when they hit.
iii. This will help reduce loss of life and property occasioned by
disasters like floods.

THE VOCATIONAL TRAINING BILL (SENATE BILL NO. 3 OF 2022)

This bill is an Act of Parliament to provide a framework for the establishment for
the administration of training in vocational education in all counties within the
country. This bill will give a rational on the inception, registration, operation and
management of vocational training institution to enhance proper administration and
management of the institutions.

THE COTTON INDUSTRY DEVELOPMENT BILL (SENATE BILL NO. 5


OF 2023)
(The Hon. Mary Emaase, M.P. – Co-Sponsor)

This bill, as passed in the Senate is an Act of parliament to provide for the

- production, processing, marketing and distribution of cotton in Kenya and its products;

- establish the Cotton Industry Development Board,

- provide a framework for cotton farming;

- ensure value addition to cotton and its related products.
