Exception to the standard method of measurements

Attendance; Clause B19 (a) of the Standard Method


of Measurement is deleted and the following clause
is substituted:- Attendance on nominated
SubContractors shall be given as an item in each
case shall be deemed to include: allowing use of
standing scaffolding, mess rooms, sanitary
accommodation and welfare facilities; provision of
special scaffolding where necessary; providing
space for office accommodation and for storage of
plant and materials; providing light and water for
their work: clearing away rubbish; unloading
checking and hoisting: providing electric power and
removing and replacing duct covers, pipe casings
and the like necessary for the execution and testing
of SubContractors' work and being responsible for
accuracy of the same

Form of contract

The Form of Contract shall be as stipulated in the


Republic of Kenya's Standard Tender Document for
PROCUREMENT OF WORKS (BUILDING AND
ASSOCIATED CIVIL ENGINEERING WORKS
(Revised October 2006) included herein

Bond

The Contractor shall find and submit on the Form


of Tender and approved bank and who will be
willing to be bound the Government in an amount
equal to five per cent (5) of the Contract amount for
the due performances of the Contract up to the date
of completion as certified by the PROJECT
MANAGER and who will when and if called upon,
sign a Bond to that effect on the relevant standard
form included herein. (without the addition of any
limitations) on the same day as the Contract
Agreement is signed, by the Government, the
Contractor shall furnish within seven days another
surety to the government approval

Plant ,tools and vehicle

Allow for providing all scaffolding, plant, tools and


vehicles required for the works except in so far as
may be stated otherwise herein and except for such
items specifically and only required for the use of
nominated Sub-Contractors as described herein. No
timber used for scaffolding, formwork or temporary
works of any kind shall be used afterwards in the
permanent work.

Materials and workmanship

All materials and workmanship used in the


execution of the work shall be of the best quality
and description unless otherwise stated. The
Contractor shall order all materials to be obtained
from overseas immediately after the Contract is
signed and shall also ensure they are onsite when
required for use in the works. The Bills of
Quantities shall not be used for the purpose of
ordering materials.

Existing property

The Contractor shall take every precaution to avoid


damage to all existing property including roads,
cables, drains and other services and he will be held
responsible for and shall make good all such
damage arising from the execution of this contract
at his own expense to the satisfaction of the
PROJECT MANAGER

Adjustment of Prime cost sum

In the final account all P.C. Sums shall be deducted


and the amount properly expended upon the
PROJECT MANAGER'S order in respect of each
of them added to the Contract sum. The Contractor
shall produce to the PROJECT MANAGER such
quotations, invoices or bills, properly receipted, as
may be necessary to show the actual details of the
sums paid by the Contractor. Items of profit upon
P.C. Sums shall be adjusted in the final account
pro-rata to the amount paid. Items of "attendance"
Should the Contractor be permitted to tender and
his tender be accepted of any work for which a P.C.
Sum is included in these Bill of Quantities profit
and attendance will be allowed at the same rate as it
would be if the work were executed by a
Nominated subcontractor

Adjustment of provisional sums

In the final account all Provisional Sums shall be


deducted and the value of the work properly
executed in respect of them upon the PROJECT
MANAGER's order added to the Contract Sum.
Such work shall be valued as described for
Variations in Conditions No. 22 of the Conditions
of Contract, but should any part of the work be
executed by a Nominated Sub-Contractor, the value
of such work or articles for the work to be supplied
by a Nominated Supplier, the value of such work or
articles shall be treated as a P.C. Sum and profit and
attendance comparable to that contained in the
priced Bills of Quantities for similar items added

Nominated Subcontractor

When any work is ordered by the PROJECT


MANAGER to be executed by nominated
subcontractors, the Contractor shall enter into
subcontracts as described in Condition No. 7 of the
Conditions of Contract and shall thereafter be
responsible for such sub-contractors in every
respect. Unless otherwise described the Contractor
is to provide for such Sub-Contractors any or all of
the facilities described in these Preliminaries. The
Contractor should price for these with the
nominated Sub-contract Contractor's work
concerned in the P.C. Sums under the description
"add for Attendance".

Agoi Road .The site of the works shall be used
solely for the purpose of executing and completing
the Contract to the satisfaction of the Architect.The
Contractor shall obtain the Architect's approval for
the siting of all temporary storage areas for
materials. Site storage shall be the responsibility of
the main contractor and his pricing shall cater for
the same.

Pricing of the items of preliminaries

Prices shall be inserted against items of


preliminaries in the tenderers priced Bills of
Quantities. The contractor is advised to read and
understand all preliminary items

Work description

The works to be carried out under this contract


involves construction of a guard house. The
structure comprises a strip foundation, natural stone
walling, roof structure, mareba concrete roof cover
and ceramic floor tile, chipboard ceiling and
painted wall finishes

Measurements

In the event of any discrepancies arising between


the Bills of Quantities and the actual works, the site
measurements shall generally take precedence.
However, such discrepancies between any contract
documents shall immediately be referred to the
PROJECT MANAGER in accordance with Clause
22 of the Conditions of Contract. The discrepancies
shall then be treated as a variation and be dealt with
in accordance with Clause 22 of the said Conditions

Clearing away

The Contractor shall remove all temporary works,


rubbish, debris and surplus materials from the site
as they accumulate and upon completion of the
works, remove and clear away all plant, equipment,
rubbish, unused materials and stains and leave in a
clean and tidy state to the reasonable satisfaction of
the Project Manager. The whole of the works shall
be delivered up clean, complete and in perfect
condition in every respect to the satisfaction of the
PROJECT MANAGER

Claims

It shall be a condition of this contract that upon it


becoming reasonably apparent to the Contractor
that he has incurred losses and / or expenses due to
any of the contract conditions

Payments

The tenderers attention is drawn to the fact that the


GOVERNMENT IS ALLOWED TO MAKE
ADVANCE PAYMENTS ONLY on production of
an approved bank guarantee and also pays for work
done and materials delivered to site: all in
accordance with Clause 23 of the Conditions of
Contract Agreement. In order to facilitate this, a list
of the general component elements for the works is
given at the summary page of these specifications
and the tenderer is requested to break down his
tender sum commensurate to the said elements

Prevention of accidents ,damages or losses

The Contractor is notified that these works are to be


carried out on a restricted site where the client is
going on with other normal activities. The
Contractor is thus instructed to take reasonable care
in the execution of the works as to prevent
accidents, damage or loss and disruption of
activities being carried out by the Client. The
Contractor shall allow in his rates any expense hes
deemed necessary by taking such care within the
site.

Labour camps

The Contractor shall not be allowed to house labour


on site. Allow for transporting workers to and from
the site during the tenure of the contract

Pricing rates

The tenderer shall include for all costs in executing


the whole of the works, including transport

Security

The Contractor shall allow for providing adequate


security for the works and the workers in the course
of execution of this contract. No claim will be
entertained from the Contractor for not maintaining
adequate security for both the works and workers.

Value added tax

in the Finance Act part 3 Section 21(b) operative


from 1st September, 1993 which requires payment
of VAT on all contracts. The contractor should
therefore include allowance for V.A.T and other
Government taxes currently in force for all his rates,
provisional items and prime cost sums in this tender
The tenderer is advised that in accordance with
Government public notice No. 35 & 36 Dated 11th
September 2003 operational from 1st October 2003,
VAT will be deducted against the contract sum at
the prevailing rate by the Employer and remitted
directly to the Commissioner of VAT through all
interim certificates. It should however be noted that
this is not additional tax but a new mode of
payment for VAT, any excess payment will be
refundable once the Contractor has submitted
monthly returns

Cell phone expenditures

Provide mobile phone airtime worth Kenya


Shillings Five Hundred (Kshs 500.00) only per
person per week for two (2 No.) site managers for
the duration of the contract period. Allow for
contractors profits and overheads (75%)

Transport for site managers

CONCRETE WORK

Architect/Engineer

For the purpose of the concrete structure, the


Structural Engineer shall be deemed invested with
the duties and to be the representative of the
Architect

Code of practice

All workmanship, materials, tests and performances


in connection with the reinforced concrete work are
to be conformity with the latest edition of the
British Standard Code of Practice (C.P. 114 for the
structural Use of Reinforced Concrete

Levels and foundations

The foundation of the works shall be carried down


to depths as may be directed by the Engineer and
must be cut as nearly to the size of the concrete as
possible and vacant spaces between the concrete
filled in as directed by the Engineer. All temporary
timber be removed but should any timber be left in
or should any other work done be beyond that
specified, it will be at the Contractors own cost.

Supervision

A competent person approved by the Engineer shall


be employed by the Contractor whose duty will be
to supervise all stages in the preparation and placing
of the concrete. All cubes shall be made and site
tests carried out under his direct supervision, in
consultation with the Engineer

Contractor's plant ,equipment and construction procedure

Not less than 30 days prior to the installation of the


Contractors plant and equipment for processing,
handling, storing and proportioning ingredients and
for mixing, transporting and placing concrete, the
Contractor shall submit drawing for approval by the
Engineer, showing proposed general plant
arrangement, together with a general description of
the equipment he proposes to use. After completion
of installation, the operation of the plant and
equipment shall be subject to the approval of the
Engineer. Where these preambles, the Bills of
Quantities or the Drawing requires specific
procedures to be followed, such requirements are
not to be construed as prohibiting use by the
contractor of alternative procedures if it can be
demonstrated to the satisfaction of the Engineer,
that equal results will be obtained by the use of such
alternatives. Approval of plant and equipment or
their operation or any construction procedure shall
not waive or modify any procedure or requirements
contained in the preambles governing the quality of
the materials of the finished work

Cement

Cement unless otherwise specified shall be Portland


cement of a brand approved by the Engineer and
shall comply with the requirements of B.S 12 with
the exceptions that it may contain reactive volcanic
ash of not permitted in B.S 12 may be exceeded on
this account only. A manufacturers certificate of
test in accordance with B.S 12 shall be supplied for
each consignment delivered to the site. Should the
Contractor require using cement of the Rapid
Hardening variety, he shall obtain the approval of
the Engineer and also obtain any instructions
regarding cost modifications to the preambles
caused thereby. Any additional cost that may be
caused by the use of Rapid Hardening cement shall
be at the Contractors expense. Cement may be
delivered to site either in bags or in bulk. If
delivered in bags each bag shall be properly sealed
and marked with the manufacturers name and on
the site is to be stored in waterproof shed of
adequate dimensions with a raised floor. Each
consignment shall be kept separate and marked so
that it may be used in the sequence in which it is
received. Any bag found to contain cement which
has set or partly set shall be completely discarded
and not used in the works. Bags shall not be stored
more than 1.5 metres in height. If delivered in bulk
the cement shall be stored in a weatherproof silo
either provided by the cement supplier or the
Contractor but in either case the silo shall be to the
approval of the Engineer

Aggregates

Aggregates shall conform to the requirements of


B.S 882 and the sources and types of all aggregates
are to be approved in all respects by the Engineer
before work commences. The grading of aggregates
shall be one within the limits set out in the B.S 882

NO shall be one within the limits set out in the B.S 882
and as later specified and grading, once approved,
shall be adhered to throughout the works and not
varied without the approval of the Engineer. Fine
aggregate shall be clean, coarse, siliceous sand of
good, sharp, hard quality and shall be free from
lumps of stone, earth, loam, dust, salt, organic
matter and any other deleterious substances. It shall
be graded within the limits of Zone 1 or 2 of table 2
of B.S. 882. Coarse aggregate shall be good, hard,
clean, approved black trap or similar stone, free
from dust, decomposed stone, clay, earthy matter,
foreign substances or friable thin elongated or
laminated pieces. It shall be graded within the limits
of Table 1 of B.S.822 for its respective nominal
size. If in the opinion of the Engineer, the aggregate
meets with the above requirements but is dirty or
adulterated in any manner it shall be screened
and/or washed with clean water at the Contractors
expense. Aggregate shall be good, hard, clean,
approved black trap or similar stone, free from dust,
decompose stone, clay, earthly matter, foreign
substances or friable thin elongated or laminate
pieces. It shall be graded within the limits of Table
1 of B. S. 882 for its respective nominal size. If in
the opinion of the Engineer, the aggregate meets
with the above requirements but is dirty or
adulterated in any manner it shall be screened and /
or washed with clean water at the Contractors
expense. Aggregates shall be delivered to the site in
their prescribed sizes or grading and shall be
stockpilled on paved areas or boarded platforms in
separate units to avoid intermixing. On no account
shall aggregates be stock-piled on the ground. The
Engineer shall be entitled to require a Certificate
from approved testing laboratory in connection with
each source of fine and course aggregates showing
that materials comply with the specification. All
such testing shall be carried out at the Contractors
expense.

Fixing fabric reinforcement

The fixing shall be free from scale, rust, grease or


other substances likely to reduce the bond between
the steel and the concrete and shall be laid with
minimum 300mm laps and bound with No.
18.S.W.G annealed iron wire

Projecting reinforcement

Where reinforcement projects from a concreted


section of the structure and this reinforcement is
expected to remain exposed for some time. It is to
be coated with a cement grout to prevent rust
staining on the finished concrete. This grout too is
brushed off the reinforcement prior to the
continuation of concreting

Fixtures and indentations concrete

No openings, chases, holes or other voids shall be


formed in the concrete without the prior approval of
the Engineer. Details of any fixtures to be
permanently built into the concrete including the
proposed positions of all conduits 25mm and over
in diameter shall be submitted to the Engineer for
his approval before being placed.

Chases ,holes etc in concrete

The Contractor shall be responsible for the


coordination with the Electrical and other
Subcontractors for incorporating electrical conduit,
pipes, fixing blocks, chases holes and the like in
concrete members as required and must ensure that
adequate notice is given to the sub-contractors
informing them when concrete members
incorporating the above are to be poured. The
Contractor shall submit full details of these items to
the Engineer for approval before the work is put in
hand. All fixing blocks, chases, holes etc, to be left
in the concrete shall be accurately set out and cast
with the concrete

Position of electrical conduit

Unless otherwise instructed by the Engineer all


electrical conduits to be positioned within the
reinforced concrete shall be fixed inside the steel
cages of beams and columns and between the top
and bottom steel layers in slabs and similar
members. The proposed position of all conduits
25mm and over in diameter which are to be
enclosed in the concrete shall be shown accurately
on a plan to be submitted to the Engineer. Whose
approval shall be obtained before any such conduit
is placed.

Formwork

The method and system of framework which the


Contractor proposes to use shall be approved by the
Engineer before construction commences.
Formwork shall be substantially and rigidly
constructed of timber or steel or precast concrete or
other approved material.

Stones

Stone for walling shall be hard, dense, dark grey


stone from an approved quarry or other equal and
approved. Stone walling described as load-bearing
shall have a minimum crushing strength of 7.00
Newtons per square millimeter and shall comply
with part 2

Mortars

Cement mortar shall consist of one part of Portland


cement to three parts of sand by volume. The
cement/lime mortar shall consist of one part of
Portland cement, one part of lime and six parts of
sand by volume. The ingredients of mortar shall be
measured in proper gauge boxes on a boarded
platform, the ingredients being thoroughly mixed
dry, and again whilst adding water. In the case of
cement/ lime mortar, the sand and lime shall be
mixed first and then the cement added. All mortar is
to be thoroughly mixed to a uniform consistency
with only sufficient water to obtain a plastic
condition suitable for troweling. No mortar that has
commenced to set is to be used or remixed for use

Bonding walling

All blocks shall be properly bonded together and in


such a manner that no vertical joint in any one
course shall be within 100 mm of a similar joint in
the courses immediately above and below.
Alternate courses of walling at all angles and
intersections shall be carried through the full
thickness of the adjoining walls. All perpends
reveals, quoins and other angles and joints of the
walls etc shall be built strictly true and square

Laving and jointing

All blocks are to be well-wetted before laying and


tops of walls where left off shall be well-wetted
before commencing building. All joints are to be 10
mm thick and flushed up and grouted in solids as
the work proceeds. All exposed faces of walls for
plastering are to be left rough and the joints raked
out while mortar is green to form adequate key. All
other faces shall be cleaned down on completion
with a wire brush or as necessary and mortar
drippings, smear marks etc removed and rates must
include for this

METAL WORK

Mild steel

For balustrades, etc. shall comply with B.S 15. No


work shall be fabricated until site dimensions have
been checked and no additional claim will be
accepted should final dimensions differ from those
on the drawings. All welds shall be ground smooth
and the Contractor shall ensure that the metal work
is prepared for painting as described in painting and
decorating. The Contractor is to ensure that all work
is erected Carried to Collection plumb and true and
be so maintained until properly secured by
permanent fixing

Preparation and priming of plaster

Plaster surfaces shall be perfectly smooth free from


defects and ready for decoration. All such surfaces
shall be allowed to dry for a minimum period of six
weeks, stopped with approved plaster stopping
compound and rubbed down flush, as necessary and
then be thoroughly brushed down and left free from
all efflorescence, dirt and dust immediately prior to
decorating. Plaster surfaces which are to be finished
with emulsion, oil or enamel paint, shall be primed
with Leyland Primoplas P.20 or other equal and
approved and applied in accordance with the
manufacturers instructions

Preparation and priming of fibreboard

Fiberboard or similar surfaces shall be lightly


brushed down to remove all dirt, dust and loose
particles and have all nail holes or other defects
stopped with an approved plaster stopping
compound rubbed down flush and left with a
texture to match surrounding materials and shall
receive one coat primer at last

GLAZING

Glass

All glass shall be of British Manufacture complying


with B.S. 952 free form flaws, bubbles, specks and
other imperfections. All glass shall be delivered in
proper container with makers name guarantee, type
of glass and thickness or weight attached to the
outside of the containers. Glass panes shall be cut to
sizes to fit the opening with not more than 1.50mm
play all rounds and where puttied shall be sprigged
to wood or clipped to metal frames. Clear sheet
glass shall be rough cast plain rolled glass 4 mm
thick. Wire glass shall be polished Georgian wired
glass 6 mm thick

Beads and wash leather

The glass to doors and screens and other places


where vibration may occur shall be bedded in wash
leather with beads and fixed with brass cups and
screws. The timber rebates shall be cleaned, primed
and painted with one coat of oil paint

Putty

Putty for glazing in wood frames shall be composed


of pure linseed oil and powdered whiting free from
grittiness in accordance with B.S. 544 type 1 putty.
Putty for glazing in metal frames shall be quick
hard setting tropical putty specially manufactured
for use with steel windows. Rebates of metal frames
receiving glass shall be prepared and treated with
primer for putty prior to glazing and putty shall be
primed ten days after glazing

Bedding strips

Shall be of plastic or wash leather approved by the


Architect and shall be cut to fit exactly the line of
frame and beads.

On completion

Remove all broken, scratched or cracked panes and


replace with new to the satisfaction of the Architect.
Clean inside and out with an approved cleaner. On
no account shall window be cleaned by scraping
with glass
