14. Handing over of GCC, Clause The efforts will be made by the NPCC to
the site by client 2.2, Sub- handover the site to the Contractor free of
clause 2.2.2 encumbrances. However, in case of any
delay in handing over of the site to the
Contractor, the NPCC shall only consider
suitable extension of time for the execution

of the work. It should be clearly understood

that NPCC shall not consider any revision in
contract price or any other compensation
whatsoever viz. towards idleness of
Contractor’s labor, equipment etc.
15. Acceptance of GCC, Clause The NPCC reserves to itself the authority to
Tender 5.0 reject any or all the tenders received without
assigning any reason. The acceptance of a
tender shall be effective w.e.f. the date on
which the telegram/ letter of intent of
acceptance of the tender is put in the
communication by the NPCC. NPCC also
reserves the right to Split the work among
two or more parties at lowest negotiated rate
without assigning any reason thereof. The
contractor is bound to accept the portion of
work as offered by NPCC after split up at
the quoted/negotiated rates.
15. Price variation GCC, Clause The item rates quoted by the tenderer shall

work. No revision to Percentage rates or any
escalation shall be allowed on account of
any increase in prices of materials, labor,
POL and Overheads etc. or any other
statutory increase during the entire contract
period or extended contract period.
16. Jurisdiction GCC, Clause The agreement shall be executed at Mumbai
26.1 on non-judicial stamp paper purchased in
Mumbai and the Courts at Mumbai alone
will have jurisdiction to deal with matters
arising there from, to the exclusion of all
other courts.
17. Transfer of Bid SCC, Clause Transfer of bid documents purchased by one
documents 5.0 intending bidder to another is not
permissible.
18. Mode of Payment SCC, Clause The rate quoted by the contractor shall be
13.1, 13.2 excluding WCT and Service Tax which
shall be paid at the rate of 5 %( Five
percent) and 4.12 %( Four point one two
percent) of the value of bill respectively. All
other taxes shall deemed to be included in
the rates of the agency and nothing extra
shall be paid except as stated above.
The stamp duty if any on the contract
agreement levied by the Government or any
other statutory body shall be paid by the
contractor
