Yadav under Order 1 Rule 10 [2] CPC, Read with
section 151 CPC for impleadment of applicant
company in the above Writ petition.

RESPECTFULL YSHOWETH

1. That the applicant company is a Pvt Ltd Company

incorporated under the provisions of Indian Companies Act

1956. The Registered office of the company is situated at 14


Bhera Enclave, Paschim Vihar, New Delhi. The certificate of

incorporation of the company is ANNEXURE A

2. That the applicant company has passed a Board resolution in

the meeting of the Board of directors of the company held

on 10/11 /23 deciding to commence legal proceedings for

impleadment of applicant company in the above writ

petition and for such purpose has authorized and

empowered Shri Nitin Yadav, Authorised Signatory of the

company to institute the present application, sign and verify

the application, appoint Advocate [s] and to do all other acts,

things and deeds as are necessary and required for the

conduct of the legal proceedings before the Honble High

court of Delhi. The Board resolution is ANNEXURE B

3. The brief facts which lead to filling of the present application

is as under:

A. That the applicant company applied for Residential plot by

way of E-auction held on 22/4/2022. The respondent

confirmed applicant company bid and applicant company

was declared as successful bidder in theE-Auction conducted


by the respondent in respect of Plot no 39, Pocket 4, Sector

23 B, Dwarka, New Delhi. The application form is ANNEXURE

B. That the respondent vide LOI letter dated 19/5/2022 sent to

applicant company whereby respondent requested applicant

to pay the difference amount i.e. the amount by which 25%

of the quoted price. The applicant company bid for an

amount of Rs 7,48,85,120/- ( Rupees Seven Crore Forty Eight

Lacs Eighty Five Thousand One Hundred Twenty Only) and

was declared successful bidder and as per the LOIIetter, the

applicant company was required to pay the 25% amount

within a period of seven days of the issue of LOI letter dated

19-05-2022. The said letter is ANNEXURE D

C. That applicant company in compliance of correspondence

with the respondent had paid the total amount of Rs

1,87,21,280/- (Rupees One Crore Eighty Seven Lacs Twenty

One Thousand Two Hundred and Eighty Only) in various

installments [being the total of 25% amount of the successful

bid] to the respondent without any delay and well within the

timelines given by the respondent. The respondent has never

denied the acceptance of that payment.


D. That as per the terms & conditions, applicant company was

required to pay the balance amount (75% of the total price)

of Rs 5,61,63,840/- (Rupees Five Crore Sixty One Lacs Sixty

Three Thousand Eight Hundred and Forty Only) within 90

days from the date of demand letter as and when issued by

the respondent. The applicant company after the payment of

25% of the bid amount was eagerly waiting for the demand

letter to be issued by the respondent for the payment of the

balance amount of Rs 5,61,63,840/- (Rupees Five Crore Sixty

One Lacs Sixty Three Thousand Eight Hundred and Forty

Only) to be paid to the respondent to which there is no

response from the side of the respondent despite applicant

company had sent several reminders by way of e mails sent

to respondent and the same were duly acknowledged by the

respondent vide various inter department emails to which

the respondent was copied too. The said correspondence is

ANNEXURE J Despite all this the respondent failed to comply


with the correspondences sent by the applicant company

and in this manner almost one and a half year has elapsed

which raises suspicion in the mind of the applicant company

regarding the deposit of their hard-earned money and the

fate of plot which the applicant company has availed by E-

auction conducted by the respondent as per the terms and


conditions mentioned by the respondent at the time of the

auction. The said Terms and conditions is Annexure E

E. The respondent after receipt of the amount has failed to act

upon and discharge their liability which is cast upon them.

The respondent is under legal obligation to honour the E-

auction conducted by them.

F. That the applicant company has written to the respondent

time and again to do the needful by doing the exercise of

execution of sale- documents and issue the demand letter

in favour of applicant company by receiving the balance

amount of Rs 5,61,63,840[:(Rupees Five Crore Sixty One Lacs

Sixty Three Thousand Eight Hundred and Forty Only), which

the applicant company is willing to pay as soon as the

respondent issues the demand letter as per the terms and

conditions laid out by the respondent at the time of the

auction as annexed. The applicant is ready to perform their

part of contract by paying the balance amount and

simultaneously expects from the respondent to perform

their part of contract by executing documents for transfer of

the plot in the name of the applicant company.


G. That the applicant company through their counsel sent a

legal notice to the respondent on 06/10/23 but despite

receipt of the said legal notice, the respondent failed to

honour its commitment or give any reply to the said legal

notice. The conduct of the respondent is not bonafide as the

respondent has failed to adhere to its own schedule as

mentioned in the terms and conditions of the E-auction. The

delay on their part has raised serious doubts in the mind of

applicant company, that they will not honour the

commitment nor follow through the terms and conditions of

the E Auction as laid out by the respondent. The applicant

company feels that the respondent has become dishonest

and they wanted to enrich themselves with applicant

company hard earned money. The applicant is ready to

comply with their part performance and expect from the

respondent to do their part of the contract to complete the

auction process by accepting their money and

simultaneously execute transfer documents in favour of the

applicant. The legal notice is ANNEXURE F

H. In the background of this the applicant company came to

know about the filling of writ petition in the Honble High

court of Delhi by the petitioner. The applicant company

searched for the records in the Delhi High court and found
orders which affects their right in the plot in question which

they were declared as successful bidder through e- auction

and have paid a handsome amount of 25% ie Rs


1,87,21,280/- (Rupees One Crore Eighty Seven Lacs Twenty
One Thousand Two Hundred and Eighty Only) of the total bid

amount i.e. Rs 7,48,85,120/- ( Rupees Seven Crore Forty

Eight Lacs Eighty Five Thousand One Hundred Twenty Only)

already as per the terms and conditions of the E-auction as

laid by the respondent and conducted by the respondent for

general public. The bank statement is ANNEXURE G

I. That the applicant came to know of the order dated

10/9/2021 in which Mr Justice Najmi Waziri then High court

Judge, Delhi High court vide its order had put a stay on the 1

Bigha land Khasra no 6/6/2, Village Bharthal, New Delhi. The

matter is pending in the Honble High court and the next date

in the matter is 06/12/2023. It is relevant to mention here

that the auction plot comes under this Khasra which has now

become the subject matter in dispute.The order is

ANNEXURE H

4. That even the petitioner has also not approached the Honble

court with clean hands. The petitioner has stated in their

plaint that there is an immoveable structure raised on the


said land which is also narrated in the order dated

10/09/2021 but the fact is that the said land is a vacant plot.

5. That the respondent on the day of E-auction has conducted

E-auction not only of this plot but has also conducted E-

auction of two more plots in which the applicant had entered

their bid but were declared as unsuccessful. It is only in this

plot which is in dispute before the Honble High court, that

the applicant was declared as successful bidder in the E-

auction conducted by the respondent. It is relevant to

mention that the plot is still in possession of RESPONDENT

and the sign board of the respondent, stating that the said

land belongs to the respondent is also installed in the subject

plot. This all shows that the plot is still with the respondent.

ANNEXURE I

6. That the site plan as depicted in the order dated 10/09/2021,

if carefully been perused then that area ear marked by the

petitioner is actually encroaching two roads which falls next

to the two plots on E-auction that day by the respondent on

each side. If the petitioner succeeds in getting favorable

order then the entire residents and owners of various plots

in Pocket-4, of sector -23, Dwarka, New Delhi, will be blocked


to access the main road and nobody will be able to come out

from the entire pocket mentioned above using right of way

as depicted in the sector plan by the respondent. The plots

which falls at the back of the plot are also auctioned and sold

by the respondent on the same date of E-auction and there

is a huge population already living there in the entire Pocket-

4, of sector -23, Dwarka, New Delhi. if the said area is not

cleared then the ingress and outgress of the said residents

and owners will be seriously affected and in that background

acquisition is indispensable. The existing owners and the

residents of the Pocket-4, of sector -23, Dwarka, New Delhi

will be cheated because of false depiction of right to way and

connectivity from the main roads for the said pocket in this

sector of Dwarka by the respondent.

7. That the entire area except the area which is in dispute

before the Honble High court was acquired by the

RESPONDENT for the purposes of Dwarka project. The other

portions have been acquired vide award no 2612002-03. The

area in question is to be acquired but the RESPONDENT is not

doing anything and is keeping silent and no useful work has

been done for the purpose of acquiring the said area for a

considerable time, to keep the public interest as top priority

as per the promises made by the respondent.


8. That the applicant has become a sandwich between the

petitioner and the respondent as the E-auction plot falls

under this khasra. It is relevant to mention here that the

some adjoining plots which the DDA has sold in the same E-

auction also falls in the same khasra.

9. That the applicant has also come to know through the

network of active real estate agents in the vicinity where the

plot exists, that the petitioner is trying to sell and create third

party interests in the said land in question and the petitioner

should be stopped from doing so and involving any other

persons in already disputed land and ongoing litigation

process.

lO.That in this present scenario neither the respondent is

complying with their commitment towards the applicant nor

the applicant is in a position to avail their legal remedies for

honoring the terms of the E-auction held by the respondent.

It is relevant to mention here that till date respondent has

not apprised to the applicant and company about the filling

of the present Writ petition in the Honble High court at any

point of time in regards to the said plot.


11.That the Honble High court may at any stage of the

proceedings and on the terms as may appear fit to the court

to be just, order that the said persons I institutions as the

case may be impleaded as party to the proceedings as this

will enable the Honble court to effectually and completely to

adjudicate upon and settle all questions involved in the

petition. The proceedings are at the initial stage and no

prejudice will be caused to any of the parties rather it will

facilitate in deciding the real controversy in the writ

proceedings and will also help in adjudicating the stakes of

the general people who are residing in the vicinity regarding

their access to their properties.

12.That the applicant has shown through the preset application

that adjudication of the "real controversy" between the

parties on record, the presence of the applicant is necessary

and in that background the applicant should be impleaded as

party in the above writ petition as all controversies arising in

the petition and all issues arising thereunder may be finally

determined and set at rest, thereby avoiding multiplicity of

proceedings over a subject matter which could still have

been decided in the pending proceedings itself In the fitness

of things indulgence of Honble High Court is required to


exercise its discretion and pass orders for impleading the

applicant as necessary party to the above writ petition.

13.That in the background of above scenario the applicant

wants to implead themselves as party in the above writ

petition as the applicant is directly affected by the outcome

of the writ petition. The applicant has purchased through E-

auction as successful bidder is subject matter in the present

writ petition and their legal and monetary stake are quite

high as the applicant has borrowed the amount on interest

for purchase of plot from the respondent.

14.That the applicant in these circumstances is a necessary and

proper party and if any order is passed in their back, will

seriously affect the rights of the applicant which cannot be

compensated in terms of money.

15.The applicant has a prima facie good case and has strong

substance in the present application and is likely to succeed

on the strength of the facts stated above.

16.That the applicant has been paymg huge interest on the


amount given to the respondent.
17.That the applicant has not filed any application in Honble
Supreme court of India or in Honble High court in respect of the
plot in question.
PRAYER
l.It is therefore prayed that in the light of the above background, the
Honble court may allow the application of the applicant and implead
the applicant in the above writ petition as the applicant is a necessary
and proper party and in the interest of justice.

2.Such other or further directions which the Honble court may deem
just fit and proper be also passed.

1. Allowed, subject to all just exceptions.
2. The application stands disposed-off.

3. The petitioner claims to be in possession of the 1 Bigha land Khasra
No.6!/6!2, Village Bharthal, New Delhi. Immovable structure
constructed in the said land by him, was demolished by the DDA and
possession of the said land was taken over by the latter on
17.02.2020. it is the petitioner's case that his land was is non-
acquired. It has been so depicted in the site plan prepared by the
Revenue Department, GNCTD and counter-signed at site by an
officer of the DDA. The said document is reproduced hereunder:

4. The non-acquired land has been marked by the Revenue Officer as


the coloured rectangular portion as reflecting the Revenue records.
5. A subsequent demarcation report of 10.06.2015, also shows the non-
acquired land in a highlighted rectangle. It is reproduced hereunder:
6. Despite the non-acquisition of the land and it being in the possession
of the petitioner, the DDA went ahead and demolished the
petitioner's structures on it and took its possession. The said action is
contended to be arbitrary and illegal.
7. The petitioner is a decree holder in a suit, in which it was directed
inter alia, as under:
" .. .ISSUE NO. 3
Ld. Counsel for DDA submits that this land in Khasra No.
61612 is required for the purpose of development and the
DDA has also written to competent authorities in this
respect for acquisition of land and handing over the same
to DDA for development. However, it is admitted during
the course of arguments as well as in the WIS that so far
the land of 1 Bigha, falling in K.hasra No. 61612 has not
been acquired, it is stated in the WIS that out of the total
land of 5 Bighas 7 Biswa bearing Khasra No. 61612 land
measuring 4 Bigha 7 Biswa has been acquired vide award
No. 2612002-03. Whereas the remaining land measuring 1
Bigha is required to be acquired as the same is also
needed for the development of Dwarka project. As per the
fact brought on record till today no acquisition of the suit
land has taken place. Unless the acquisition of land is
done by the competent authority, the right of the Plaintiff
over the land cannot be interfered with. Since in the
present case, no acquisition proceedings are initiated
therefore the Plaintiff has every right to have his land
protected till the acquisition proceedings take place. I
therefore, decree the suit by granting injunction in favour
of the Plaintiff The Defendants are directed not to
interfere in the possession and enjoyment of land of the
Plaintiff measuring 1 Bigha bearing Khasra No. 6/612 of
village Bharthal, Delhi till the acquisition of land takes
place and the land is placed at the disposal of DDA. Ld.
Counsel for DDA has requested for clarification that the
decree passed today would not effect initiation of any
proceedings with respect to acquisition of land if initiated
by the competent authority, it is clarified as such. Decree
sheet be prepared accordingly. File be consigned to
Record Room ... "

8. The petitioner was already in possession of the said land.


9. The learned counsel for the DDA submits that the land apropos which
a decree has been passed and possession of which has been taken by
the DDA is not the suit land.
1O.Issue notice. Notice is accepted by the learned counsel for the
respondent/DDA. Counter affidavit be filed within two weeks.
Rejoinder thereto be filed in four weeks thereafter. Let the DDA
identify the land which it has acquired, and the land which otherwise
remained unacquired in Khasra No.6//6/2 in admeasuring 1 Bigha in
Village Bharthal, New Delhi. Let Director, DDA look into the matter
and file an affidavit.
ll.Renotify on 09.02.2022.
12.Till the next date, status quo apropos the land in question shall be
maintained, lest the interest of the petitioner be injured irreparably.

Pocket 4, Sector 23b Dwarka (Plot 10: 794 ).

It has been a few days since i have had no update from DDA for my bhoomi portal login details.

I request you to kindly update me with the details cause according to the terms and conditions of the DDA e-Auction. i was
supposed to deposit 25% of EMD within 7 days of the auction after receiving the LOI and being declared as H1.

I have not received LOI or bhoomi portal login and I have my 25%EMD ready. I do not want DDA to forget about it for any
reason and as a result my 5% EMD deposited before auction is forfeited by DDA as a mistake.

I have also called customer care a few times to ask. They have asked me to stay put. But its been 10 days and I have not
heard back from DDA after thee-auction.

Please let me know the update.

I was participating in an auction held by dda on 22-04-2022 for a residential plot in Dwarka, Sector 238, Pocket 4.

I was declared as H1 in e-auction on tender wizard. and the tender wizard portal says the bid has been accepted.

However, as of today I have not received any email communication from DDA for my bhoomi portal login details, or the
LOI.

As per the terms and conditions for the auction i was to deposit 25% of total price within ?days. My payment is ready,
please share the details with me at earliest.
