EXTRAJUDICIAL SETTLEMENT WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This Extrajudicial Settlement with Waiver of Rights is made and entered into by and among
the heirs of the late spouses Martin Acebron Adato and Trinidad Mirafuente Adato
(hereinafter as "Trinidad" and "Martin", and whose Death Certificates submitted herein as
Annexes "A" and "E" respectively), namely:

Gerry Anthony M. Adato, of legal age, married and residing in Boac, Marinduque;

Rommel Tomas M. Adato, of legal age, married and residing in Antipolo, Rizal;

Ma. Corazon A. Borja, of legal age, married and residing in Tabi, Boac, Marinduque;

Maria Charina A. Bautista, of legal age, married and residing in San Jose Del Monte,
Bulacan,

Ma. Kristine A. Reyes, of legal age, married and residing in San Jose Del Monte, Bulacan;
and

Martin M. Adato, Jr., of legal age, married and currently residing in Antipolo, Rizal;

with the inclusion of:


The late Amelito Ramon M. Adato (whose Death Certificate is submitted herein as Annex
"B"), whose Heirs are represented by his spouse, Fidelity Marie G. Adato, of legal age,
widowed, and residing in Agoo, La Union.

The above-mentioned parties shall hereinafter be collectively referred to as the "Heirs."


W I T N E S S E T H:

WHEREAS, the decedent spouses, Martin and Trinidad, were the compulsory heirs of their
eldest daughter, Anneli Emiliana M. Adato, who was single and died intestate on November
30, 2001 (Anneli's Death Certificate is submitted herein as Annex "C"). Anneli's death left
Trinidad and Martin with two parcels of land with the following technical descriptions:

Parcel 1 - an area of 35 square meters, more or less, covered by Transfer


Certificate of Title No. [TCT No. T-T289859] and Original Certificate Title No [OCT
No. 765], located at Blk 105, Lot 12 Melody Plains, San Jose Del Monte, Bulacan;
and

Parcel 2 - an area of 35 square meters, more or less, covered by Transfer


Certificate of Title No. [TCT No. T-T289858] and Original Certificate Title No [OCT
No. 765], located at Blk 105, Lot 14 Melody Plains, San Jose Del Monte, Bulacan.

Both parcels of land shall hereinafter be referred to as the "Properties;"

WHEREAS, Martin died intestate on 17 July, 2002, leaving his share of the Properties to his
children and to his spouse, Trinidad as compulsory heirs;

WHEREAS, Trinidad herself died intestate on 21 January, 2017, leaving a handwritten


letter(herein as Annex "D") dated March 4, 2015 in which she expressly assigns the above-
stated parcels of land to Ma. Kristine, without prejudice to other properties that the Heirs
may inherit from the decedent's estate;

WHEREAS, the Heirs are the heirs of the late Martin and Trinidad, and they have agreed to
honor the wishes of the latter decedent: that ownership of the Properties shall be entrusted to
Ma. Kristine, free from liens and encumbrances, and waive their respective rights and
interests as heirs regarding the Properties in favor of Ma. Kristine;

WHEREAS, to avoid any future conflict or controversy among the Heirs, they have agreed to
enter into this Extrajudicial Settlement with Waiver of Rights, voluntarily and without any
coercion, intimidation, or undue influence;
NOW, THEREFORE, for and in consideration of the foregoing premises and mutual covenants,
the Heirs have agreed as follows:

1. That the ownership of the Properties shall be left to Ma. Kristine, in accordance to the
wishes of the late Trinidad as manifested in Annex "D";

2. That each heir acknowledges and declares that he/she has no further claims or
demands against the other Heirs or against the Estate of the late Martin A. Adato,
except for the rights and interests specifically granted to him/her in this Extrajudicial
Settlement. Accordingly, each Heir also acknowledges and declares that he/she has no
further claims or demands against the other Heirs or against the Estate of the late
Trinidad M. Adato, except for the rights and interests specifically granted to him/her
in this Extrajudicial Settlement.

3. That each Heir waives and renounces any and all rights, interests, participation
and claims he/she may have over the Properties, whether by virtue of
inheritance, donation, sale, or any other mode of transfer, in favor of Ma. Kristine,
free from any and all liens and encumbrances.

4. That each Heir agrees to execute and sign any and all documents necessary or
desirable to effect the transfer and registration of his/her share in the Property in favor
of Ma. Kristine, including but not limited to a Deed of Absolute Sale, a Deed of
Assignment, a Special Power of Attorney, and an Affidavit of Waiver and Renunciation.

5. That each Heir warrants and represents that he/she is the compulsory heir regarding
his/her share in the Properties, and that he/she has the full right, power, and authority
to transfer and convey the same to Ma. Kristine.

6. That the Properties are free and clear from any liens, claims, or encumbrances, and
that Ma. Kristine shall indemnify and hold harmless the other Heirs from any and all
claims, demands, suits, or actions arising from any defect or adverse claim regarding
the Properties.

7. That Ma. Kristine agrees to assume all taxes, assessments, and other charges due
regarding the Properties up to the date of transfer, and that she shall hold the other
Heirs free and harmless from any liability or obligation arising therefrom.
8. That this Extrajudicial Settlement with Waiver of Rights shall be binding and conclusive
upon the Heirs and their respective heirs, executors, administrators, successors, and
assigns.

9. That any dispute or controversy arising from or in connection with this Extrajudicial
Settlement with Waiver of Rights shall be settled amicably by the Heirs, and in case of
failure to do so, the same shall be referred to arbitration in accordance with the rules of
the Philippine Dispute Resolution Center, and the decision of the arbitrator/s shall be
final and binding upon the parties.

10. That this Extrajudicial Settlement with Waiver of Rights shall be executed in ten (10)
original copies, one for each Heir, one for the notarizing authority and one for
registration with the Register of Deeds.
