COMPROMISE AGREEMENT

I. PARTIES. The parties to this Compromise Agreement are:

1. DIANNE CARLA SY VELEZ (First Party), of legal age, Filipino, with


address at c/o Unit 2E New Domain Bldg., No. 19 Holy Spirit Drive,
Don Antonio Heights, Brgy. Holy Spirit Drive, Quezon City; and

2. ARWIN DOMINGO VELEZ (Second Party), of legal age, Filipino, with


address at No. 1519 Sulu St. Sta. Cruz, Manila.

II. RECITALS. The parties acknowledge that:

1. The First Party is the complainant and the Second Party is the
respondent in NPS No. XV-03-INV-19E-04586, entitled, “Dianne
Carla Sy Velex, Complainant, versus Arwin Domingo Velez,
Respondent,” which is for alleged Violation of R.A. 9262, pending
before the Office of Quezon City Assistant City Prosecutor Diovie M.
Macaraig-Calderon.

2. The First Party is also the complainant and the Second Party is the
respondent in NPS No. XV-03-INV-19G-05839, entitled, “Dianne
Carla Sy Velez, Complainant, versus Arwin Domingo Velez,
Respondent,” which is for commission of “Concubinage” punishable
under Article 334 of the Revised Penal Code, pending before the Office
of Quezon City Assistant City Prosecutor Maria Cecilia Gertrudes R.
Salvador.

3. The First Party is the petitioner and the Second Party is the respondent
in Civil Case No. 7000-19, entitled “Dianne Carla Sy Velez, Petitioner,
versus Arwin Domingo Velez, Respondent,” which is a petition for
legal separation, pending before the Regional Trial Court of Imus,
Cavite, Branch 4.

4. The parties have one three year old child named Arianne Denise Sy
Velez.

5. The parties have been living separately since August 2018, and their
reconciliation is highly improbable.

6. The parties recognize their rights and obligations as parents to Arianne


Denise, and they herein agree on their exercise of parental authority,
custody, and visitation rights over their children and the manner of
providing them support.

III. TERMS. The parties agree that:

1. They shall observe mutual respect for each other. They shall encourage
a close relationship with their child and both parties shall refrain from
performing any act that would strain that relationship.

2. This Compromise Agreement was executed freely and voluntarily and


in accordance with law and not contrary to morals, public policy and
good custom.

3. The First Party shall withdraw all the charges filed as NPS No. XV-03-
INV-19E-04586 (For Violation of R.A. 9262) and NPS No. XV-03-INV-

19G-05839 (Fore Concubinage) against the Second Party. Both charges
are filed before the Office of Quezon City Assistant City Prosecutor.

4. The First Party shall also withdraw the petition for legal separation
docketed as Civil Case No. 7000-19 before the Regional Trial Court of
Imus, Cavite where the Second Party is the respondent.

5. The First Party, her family, friends or anyone related to her in any
manner will delete, remove, and, at any time, will not post or publish in
any social media platform anything that is in any way connected,
related, or have anything to do with the Second Party. No calls, sms
messages or messages through any social media platform by the First
Party, her family, friends or anyone related to her shall also be sent to
the Second Party.

6. The First Party also undertakes that she will not, at any time,
commence, maintain, initiate or prosecute, any action, lawsuit,
proceeding, charge, petition, complaint or claim before any court,
agency or tribunal against the Second Party arising from acts or
omissions which are the subject matter of the charges mentioned
above.

7. The Second Party, on the other hand, will take sole responsibility of all
the debts incurred by both parties up to the time of their separation.

8. The Second Party will delete, remove, and, at any time, will not post or
publish in any social media platform anything that is in any way
connected, related, or have anything to do with the Frist Party. No
calls, sms messages or messages through any social media platform by
the Second Party, his family, friends or anyone related to him shall also
be sent to the First Party.

9. The Second Party also undertakes the he will not, at any time,
commence, maintain, initiate or prosecute, any action, lawsuit,
proceeding, charge, petition or claim before any court, agency or
tribunal against the First Party.

10. The existence and the terms of this “Compromise Agreement” and any
oral or written information exchanged between the Parties in
connection with the preparation and performance of this “Compromise
Agreement” are regarded as confidential information and shall not be
construed as an admission of guilt on the part of either Parties.

11. They shall maintain the confidentiality of all such confidential


information, and without obtaining the written consent of the other
Party, the information contained in this “Compromise Agreement”
shall not be disclosed to any third parties.

12. This “Compromise Agreement” shall be governed and construed in


accordance with the laws of the Republic of the Philippines and the
parties shall, in good faith, strictly abide by the terms hereof.

13. In case of failure to comply with the terms and conditions of this
Agreement or a breach thereof, the aggrieved party may seek judicial
relief against the erring party and shall have the right to enforce the
same. The erring party shall bear the cost of litigation, attorney’s fees,
interest and other expenses incurred as a consequence of the breach.

The parties sign this agreement at the date and place of their notarial
acknowledgment hereof.
