Karnataka Essential Commodities Licensing order, 1986

(amended upto 11-10-1999)


In exercise of the powers by Section 3 of the Essential Commodities Act, 1955
(Central Act I 0 of I 955) rcad with Orcler No. S. O. 681 (E) dared 30th Nove mber l9l4.
G S R No. 800 dated 9th June, 1978 of the Government of lnclia, Ministry of Agriculture
and Irrigation (Department of Food) New Delhi and S O 780 (E) dated 2l st November
1977 of the Govennment of India, the Government of Karnataka hereby makes the
following order, namely :-
I Short title extent and commencement:
(1) This order may be called the Karnataka Essential Commodities Licencing
Order, 1986
(2) It extends to the whole of the State of Karnataka
(3) It shall come into force at once
2 Definitions :
In this Order, unless the context other wise requires-
(a) 'Appellate Authority' lneans any officer appointed by the State Gove.n*.n,
in this behalf to exercise the powers of the Appellate Authority under this
order and different Appellate Authorities may be appointed for different
classes of dealers in different areas of the State.
(b) 'Bulk Consumer'means a hotel, a restaurent, halwai biscuit manufacturers
or confectioners an eclucational institution with hotel facilities, a hospital
or a religious or charitable institution :
(ba) 'Commission Agent' means a Commission Agent having in the customary
course of business as such agent authority to sell goods or to consign goods

(c) 'Dealer' means a person engaged in the business of purchase, salb or storage

for sale of any essential commodity whether or not in conjunction with any,
other bdsiness and includes his representative or agentt: ,, I
(d) 'Essential Commodity' means any commodity specified in Schedule-l :

(e) 'Form' means form appended to this Order :.


(f) 'Hawker' means a person who carries kerosene from place to placefor sale
to persons other than a dealer : provided that the Licensing Authority may
in public interest also specity the place or places in which, or hours during
which, the hawker shall sell kerosene :
(-e) 'Licensing Authority'*"un, any ofticer appointed by the State Government
in this behalf to exercise the powers and pertorm the cluties of the Licensing
Authority under this Order and different Licensing Authorities may be
appointed fbr ditferent areas or for diff'erent classes of dealers in dift'erent
areas of the State :
(ga) 'Producer' means a person carrying on the business of milling any of the
pulses or expelling or extracting, manufacturin_ei or refining any edible oil.

(h) 'Retail dealer' rneans a dealer dealing


in any one of the trade articles
mentioned in Schedule-r and who is not a whoresale
dealer ;
(i) 'schedule' means the Government
of Karnataka :
u) 'State Government' means the
Government of Karnataka :
(k) 'wholesaler' means a dealer who sells
any one or more of the essential
commodities specified in Schedule I to other dealers
or to bulk consumers.
Licensing of Commission Agents, Dealers & producer
No person shall after the commencement of this order,
caffy on business as a
commission agent, dealer and producer in any of
the essential commodities
mentioned in Schedule I except under in accordance
with the terms and conditions
of the license issued in this behalf by the Licensing Authority.
Provided that no such licence shall be required for
a commission agent, dealer and
producer who stores for sale at any one time
essential commodities in quantities
not exceeding the Iimits specified in Schedule_Il.
Provided further that no person who at the commencement
of this Order, is as
defined in sub-clause 3(ba) (c) and (ga) of the
order shall carry on business as
such Dealer commission agent, dealer and producer
without obiaining a licence
issued in his behalf by a Licensing Authoriiy
within a period of thirty days from
the commencement of this order.
Provided also that no wholesale dealer or retail dealer
or producer or commission
agent shall, either by himself or by any person
on his behalf, store or have in his
possession essential commodity at any time
not more than the quantity as specifiea
in Schedule IV.
Issue of Licences
(l) Every application fbr a licence or renewal thereof
shall be made to the
Licensing Authority, in form 'A'along with the prescribed
fee.
(2) Every licence issued or renewed under this Order shall
be in form 'B, in
respect of a wholesale Dealer commission agent
and producer in form ,D,
in respect of Retail Dealer and shall be subjlct to the
condition specified
therein
(3) A wholesale Dealer commission agent and producer
or Retail Dealer may
obtain the licence for any one or more of the essential
commodities
mentioned in Schedule_I
(4) Wholesale dealers, commission agents, producers
and retail dealers licences
of the same essential commodity for the same place of
business shall not
be obtained
(5) More than one licence in the same essential commodity
at one place of
business in the same or difTerent names shall not
be obtained.
(6) A separate Iicence shall be necessary tbr each place of business except in
the case of a Hawker.
Provided that:-
(i) the whoresare ricence for kerosene shail be given
onry to a person who
has been appointed as a kerosene dearer
by one of rhe oir cornpanies

or who holds a letter of indent for such appointment from one of the
oil.companies, Similarly, a kerosene rerailer will be appointed
by the
State authorities' Both the wholesaler and retailer of kerosene
should
hold valid stortage licences as prescribe under the petroleum Act
and
Rules made thereunder.
(ii) for a domestic consumer, the maximum limit for storage shall be 20
litres. Similarly, a non-domestic consumer in respect of whom the
state Government has made an order under clause 4(l) of the
kerosene (Restriction on use) order, r 966 may store kerosene
noe
exceeding l5 Kls. He should also obtain the required storage licence

(iii)this order shall not contravene the provisions contained in any of


the
orders instructions, etc., issued by the Central Government on
distributions, pricing, etc., of kerosene.
Period of Licence
(l) 'Erery licence issued under this order shall be valid for a perio.d
ending with the 3lst December of the years in which it is issued
and
may be renewed for a period of one year at a time

If the licence issued under this order is defaced, Iost or destroyed,
an
application furnishing true and correct information in such from
as may be
required by the Licensing Authority may be made to him for
issue of a
duplicate licence after paying the fees specjfied in sub-clause (2)
of CIause
5 and the Licensing Authority may after making such enquiry has
it deems
fit, issue a duplicate licence
"7 Power to Refuse License
(l) The Licensing Authority may, after giving the person affected an
apportunity of being heard, and for reasons to be recorded by him
in
writing, refuse to grant or renew a licence
(2) The Licensing Authority shall refuse to grant or renew a licence,
(a) the applicant is a minor or a runatic or is of unsound mindif,, :
(b)
the applicant is an undischarged insolvenr ; or
(c)
three years period has not expired from the date or conviction
of the applicant under the Essential commodities Act, 1955
(Central Act l0 of 1955)
(3) The Licensing Authority shall also refuse to grant a licence for a
particular trade article, if,
(a) a licence has already been issued to another dealer at the same
place of business for the trade articles for which the applicant
has applied for :
or
(b) the applicant has applied for both wholesale and retail licence
for the same trade article.
Deposit of Security
(I ) For the due performance of the conditions subject to which the licence
is granted, every Dealer lcommission agent or producer applying for
a licence shall before the licence is issued to him, deposit with the
Licensing Authority for each essential commodity, a security or the
value of.
(a) three hundred rupees, for a Wholesale Dealer's Licence
lcommission agent licence and producers licence ; and
(b) fifty rupees for a Retail Dealer's Licence
(2) The amount of security to be deposited may be in the form of National
Savings Certificates or Savings Bank Deposit
9 Contravention of conditions of licence
(l) No holder of a licence issued under this Order or his agent or servant
or any other person acting on his behalf, shall contravene any of the
terms of conditions of the licence or the provisions of this Order and
if any such holder or his agent or servant or any other person acting
on his behalf contravenes any of the said terms or condition or
provisions, then without prejudice to any other action that may be
taken against him, his licence may be cancelled by order in writing
of the Licensing Authority in respect of one or more of the essential
commodities covered by that licence
Provided that no order shall be made under this Clause unless the
licensee has been given a reasonable opportunity of being heard.
10 Maintenance of accounts, display of privces and stocks, issue of cash
memo, receipt or invoice, with hold of stocks from sale etc.,
The Provisions of the Karnataka Essential Commodities Maintenance of
Accounts, Display of prices and Stocks order, l98l shall mutatis apply to
every licence under this order
11 For Feiture of security deposit
(1) without prejudice to the provisions of Clause 9, if the Licensing
Authority is satisfied that the licensee has contravened any of the
terms of conditions of the licence or the provisions of this Order and
a ad

communicate a copy of the order to the licensee.
(2) The licensee shall if the amount of security at any time fails
short
of the amount specitiecl in Clause 8 forth with deposit further security
to make up that amounr on being required by the licensing Authority
to do so.
(3) Upon rhe compliance by the licensee with all the obligations
under
the licence, th amount of security or such part thereof, which is
not
tbrfeited as afbresaid shall be returned to the licensee after
the
termination of the licence
12 Ceiling on possession of any one or more essential commodities
by
person other than a dealer, permit holder and bulk
consumer
No person shall hold any one or more essential commodities in his
possession for any purpose more than such of the quantity
as may be
prescribed by the Central or State Government by Notification
in this behalf

l2A Restriction of sale of sugar by a wholesale dealer to another
wholesale
dealer in urban area
No wholesale dealer in a urban area shall sell sugar to any other
wholesale
dealer in the urban area
Provided that a wholesale dealer is perrnitted to have not
more than one
sale transaction in sugar with any other wholesale dealer
in another urban
area within a period specified under the sugar (control)
order, 1966 subject
to physical delivery of stock
Explanation :' Urban area for the purpose of this crause. An urban
Area
means the city consitituted under the Karnataka Municipal
Corporation Act,
1976- (Act 14 of rg77) or a city Municipality or a Sanitary
Board

13 Appeal "f
(l) Any person aggrieved by an order of the Licensing Authority refusing
to issue or renew a licence or cancelling or suspending u ii.rn."

of this order may appeal to the Appellate Authority within tfri.ty

of the date of receipt by him of such order.
(2) No such appeal shall be disposed of unless the aggrieved person
has
been given a reasonabre opportunity of being heard

l4 Powers of entry, search, seizure, etc.,
(l) The Licensing Authority or any other officer of the Department of
Food and civil supplies not below tlre rank of a Food Inspector

authorised by the Director of Food and Civil Supplies
or any police
officer not below the rank of a Sub-lnspecror or any officer
Revenue Department not below the rank of a Revenue
of the
Inspector
within their jurisdiction may with such assistance. if any, ,
as he thinks
fit and if he has reason to believe that there is or has been any
contravention of the provisions of this order or with
a view to securing
compliance with this order or to satisfying himself that
there is or has
been any contravention of the order.
(a) require the owner, occupier or any other person incharge of any
place, premises, verricle or vesser in which he has
reason to
believe that any contravention of the provisions of this
order or
of the conditions of any licence issued thereunder has been, is
being or is about to be committed, to produce any
books,
accounts or other documents showing transaction
relation to
such cantraventions :
(b) enter, inspect or break open and search any place or premises,
vehicle or vesser in which he has reason to berieve
that any
contravention of the provision of this order or of the
conditions
of any licence issued thereunder, has been is being or is
about
to be committed :
(c) take or cause to be taken extracts from a copies of any
documents showing transactions relating to such
contraventions
. which are produced before him :
' (d) search, seize and remove stocks of essential commodity and the
animals vehicles vessels or other conveyances used
in carrying
the said essential commodities in contravention
of the provisions
of this order, or of the conditions of the licence issued ihereunder
and thereafter take or authorise the taking of all measures
necessary for securing the production of stocks
of essential
commodity and the animals, vehicles, vessels or other
conveyances so seized in a court and for their safe
custody

seizure shall, so far
may be applt to searches and seizures under.this clause
l5 Exemptions
(l) The State Government may if it is necessary in public
interest so to
do by order exempt any person or class of p"rron from
the operation
of all or any of the provisions of this order for such p.egod
and subject
to such conditions. if any, as may be specified ano' *h*u,
any time
suspend or cancel such exemption.
' Provided that no notification under the Clause shall
be issued except
with the previous approvar of the centrar Government
(2) Nothing in this order shall apply_
(a) to the purchase, sale or storage for sale of essential commodities
by or on behalf of

(i) the Central Government ; or
(ii) the State Government i or
(iii) a corporarion or cornpany held or controlled by the
Central Government or the State Government ; or
iv) any Central level or State level Co-operative Society
engaged in production, procurement, sale, purchase or
distribution of any one or more of the essential
commodities ; or
(v) an industrial undertaking engaged in the manufacture or
production of sugar and which is registered or licensed
under the Industries Development and Regulation Act,
l95l ; and
(b) to the sale by banks of essential commodities hypothecated to
it, provided that the Essential commodities are sold in
accordance with the terms and conditions applicable to
hypothecator
Provided that essential commodities means for the public distributlon
system shall be sold only with prior permission of the Director of Food
and
Civil Supplies
t6 Power to call for and examine Records

- The state Government may, suomoto or an application made to it by an


aggrieve person at any time call for an examinaiion of record of any under
this order, to suspend or cancel any licence issued for the purpose of
satisfying itself as to the legality or the propriety of any decision or order
passed by such officer and as to the regularity of the proceedings
of such
officer and may pass such order thereon as it thinks fit provioed ttrat ttre
State Government shall not pass any order under this clause which adversely
affects any person unless such person has been given a reasonable
opportunity of being heard
t7 Repeal and savings
The orders mentioned in Schedule-ilI are hereby repealed
Provided that such repealed shall not affect
(a) the previous operation of the said orders or anything duly done or
suffered thereunder ; or
(b) any right, privilege, application or liability acquire, accrued or
incurred under the said Order ; or
(c) any penalty, forfeiture or punishment incurred in respect of any
offence committed against the said orders ; or
(d) any investigation, legal proceedings or remedy in respect of any such
right, privilege, application liability, penalty,. forfeiture or punishment
as aforesaid ; and any such investigation, legal proceeding or remedy
may be instituted continued, or enforced and any such penalty,
forfeiture or punishment may be imposed as if the said orders have
not been repealed.

'Foodgrains' means any one or more of the foodgrains specified below,

'Edible oil', means any oil used for cooking for human consumption and
including hydrogenated vegetable oils and refined oils
Edible oil seeds
'Edible oil Seed', means groundnut in shall, groundnut seeds, safflower
(karadi or kusudi) sesane (gingely) and includes any orher seeds bearing
edible oils used for expelling, extractirtg or manufacturing of and oil used
for cooking for human consumption
Gur
'Gur', means articles commonly known as gur, gul, jaggery, polnyra jagery,
shokkar and rab, and include and uncrystalised sugar in any othei form
comprising of original and convertable molasses and other impurities
inherent'or forcillr. prepared by boiring cane or pamyra juice.

(5) The licensee shall not contravene any of the provision
of the

Karnataka Essential Commodities Licensing Order, 1986 or any other
Order relating to Essential Commodities issued under the Essential
Commoclities Act, 1955 (10 of 1955) either by the State or Central
Government.
(6) The licensee ..shall not
(a) have in his possession or under his control stock in excess or
short of the net quantity of scheduled revealed by his
(b) keep the stocks of scheduled commodities in his premises or
godowns when once they are sold by him
(c) have in Possession or under his control or shall sell Food articles
which do not conform to the Specification of the prevention of
foocl adulteration Act 1954, and the rule made there under from
time to time.
(7) The licensee shall comply with any direction that may be given to him
by the State Government of the Director of Food and Civil Supplies
or the Licensing Authority in regard 1to purchase, consign, sale, mill,
crush or process and storage for sale of any essential commodities and
in regard to the language in which the register, returns, receipts or
invoices mentioned above shall be written and the authentication and
maintenance of the registers etc.
(8) The licensee shall take adequate measures to ensure that stocks of
, essential commodities stored by him are maintained in proper
conditions and that damage to them due to ground moisture, rain,
insects, rodents, birds, fire and such other causes is avoided, Suitable
dunnage shall be used to avoid damage from ground moisture and
stocks of essential commodities thus stored shall be fumigated with
chemicals approved for the purpose by persons who have undergone
practical training in that behalf. The Licenses shall also ensure that
tertilisers, insecticides and poisonous chemicals are not stored
alongwith such stocks of essential commodities in the same godown
or in immediate juxtaposition of the said stocks of essential
commodities.
(9) This licence shall be valid upto the end of Deqember of the year of

Note :- ( l) The addresse of the godowns within the jurisdicrion of the
licensing Authority shoulcl only be mentioned
(2) If tlre Iicensee intends to store the Cornmodities in goclowns
othc'r than those specified above, the Iicensee shall give
intimation of the actual occupation of suclr godown/s within
lbrty-eight hours of the actual occupation thereof ancl shall
'produce the licence tor
making changes therein, to the licensing
authority.
(3) In the case of Hawkers the licensing Autlrority may specity the
place or places in whicli or hours durihg which the iicensee
shall
carry on business.
(4) The licensee shall subrnit in the prescribed tbrrn ,E, to r.he
licensing Authority concerned, a true return showing the stock,
receipts and delivered of a scheclulecl commoditiel every of
fortnight (l5th and the last of the montlr). The fortnight returns
should be subrnitted, so as to reach the concerned authorities
within 4 days of the stipulated date

(6) The licensee shall use the weights ancl measures only approved
by the weights and Measures Departmenr only while supplying
essential commodities to the consumers
(7) The licensee shall not contravene the provisions of the Karnataka
Essential commodities Licensing order, 1986 or any other order
relating to essential commodities issuecl under the Essential
commodities Acr, 1955 ( l0 of 1955) eirher by the Srate or
Central Government
(8) The licensee shall not have in his possession or under his control
any essential commodities in excess or short of the net quanity
revealed by his accounts
(8n1 Have in possession or under lab control or shall sell food articles
which donot conform to the specitication of the prevention of
food adulteration Act 1954 and the rules made there under from
time to time.
(9) The licensee shall comply with any direction rhar may be given
. to him by the State Government to the Director of Food and civil
supplies, or the Licensing Authority in regard to purchase, sale
and storage for sale of any essential commodities ancl the hours'
of sale or any other matter relating to essential commodities
which the State Government or Licensing Authority may thinks
fit to regulate.
( l0) The Licensee shall take adequate measure to ensure that stocks
of essential commodities stored by him are maintained in proper
condition and that damage to them due to ground moisture, rain,
insects, rodents, birds, fire and such other cause is avoided,
Suitable dunnage shall be used to avoid clama,ee from ground
moisture and stocks of essential commodities stored shall be
fumigated with chemicals approved for the purpose by persons
who havc under-gone practical training in that beharf, The
licensee shall also ensure that fertilisers, insecticides and
poisonous chemical are not stored alongwith such stocks of
essential commodities in the same godown or in immediate
juxta-position of the said stocks of essential commodities.
(lt) In addition to the above conditions,.the foilowing conditions
shall be fultilled by the Hawkers
,l\
(a) A passport size phoro of the licensee (Hawker) shall be
affixed in the rnarginally noted space attesting his signature
by the Licensing Authority.
(b) The Licensee shall maintain a 'Hand Book' showing his
narre, address Licence No, in the I page of the book ancl
there after write the details of transaction in kerosene
done on each day showing the date, opening stock, on each
day, purchase rnade during the day, total sales macle
durin-e the day and closing balance, and shall produce this
Hand Book for verification when clemandecl 'by the

Licensing Authority or any officer authorised in his
behalf.
(c) The Licensee shalr dispray his name and address
with the
Departmentar Licence No. and the price per
litre fixed by
the Government on the barrer o. ury oih.. container
in
which he carries the kerosene for selling purpose.
(d) The Licensee shall carry with him the license and the
'Hand Book' referred to under condition
4, and produce it
