UPDATED PROCEDURES FOR APPEAL PROCESS

New Screening Tests for Fomema Medical Examination
We hope this message finds you well. We would like to inform you that effective 16 th
December 2023, under the latest directive from Ministry of Health, foreign workers are required
to undergo three (3) new screening tests i.e. blood screening tests for Hepatitis C and
Filariasis (to curb incident of infectious diseases) and urine screening test for
Methamphetamine (to curb incident of drug abuse). Those foreign workers found with positive
screening test results shall be certified as Unsuitable for employment in Malaysia.
Updated Procedures for Appeal Process
Starting on 16th December 2023 too, under the directive from Ministry of Health, there shall be
new procedures for appeal cases whereby the fees for additional tests for appeal cases shall
be regulated by FOMEMA to streamlining and strengthening the integrity of appeal process.
The new procedure is believed able to curb issues in regards to unnecessary charges by
irresponsible parties in processing appeal cases. Please refer to the attached new appeal
process flow chart for details (Attachment 1)
In the preliminary phase of the implementation of this new appeal procedure, we would like to
advise employers/ agency that a standard processing fee of RM15 for each appeal case shall
be payable to FOMEMA during appeal registration at the respective portal. Subsequently,
employers/ agency shall make additional payment to the respective Appeal Panel prior to the
execution of the required additional tests/ consultation/ referral as per the attached fees
schedule (Attachment 2).
Rest assured that the above appeal procedures is only for a temporary period until our new
Appeal Online System is deployed in near future. We would also like to highlight that any
referral to medical specialist shall be made only to the private specialist hospital appointed by
FOMEMA.
