1. That, the plaintiff filed the suit for partition, declaration and permanent
injunction against the defendant no. 2 and 3 in this Hon’ble court.
2. That, there has been an inordinate delay of ____ days in filing the Written
Statement by the Defendant No. 2 and 3 due to the prolonged illness and
several medications as they are the senior citizens located at distant places
from the court premises and Defendant no. 2 and 3 could not present their
WS/say in the Hon’ble court due to some lack of documents and
information which they were gathering for their defence in proper.
3. That, the delay in filing the Written Statement is neither intentional nor
willful but due to the righteous and adequate reasons shown herein above.
There can be an irreparable loss and injustice caused to the Defendant No.
2 and Defendant No. 3 if the delay is not condoned. Hence, the Interest of
Justice demands that the said Application for Delay Condonation on behalf
of Defendant No.2 and 3 be allowed and the delay in filing the Written
Statement be condoned so that the matter can be adjudicated upon its
merits.
