Case Title : GOVT. OF NCT OF DELHI vs. LALIT KUMAR

Facts: Lalit Kumar, the petitioner, disputes the respondent's decision to deny
his request for the allotment of a different land.The application was turned
down on the grounds of tardiness because the petitioner submitted it on
September 28, 2005, more than a year after receiving the land's acquisition
compensation.The petitioner submitted a request for review of his application,
but nothing was done with it.

Court Observed:- The petitioner's attorney claims that the calculation of the
limitation period was incorrect and that the petitioner received payment on
November 23, 2004, which extended the limitation period to November 24,
2005, for another piece of bought land.Regardless of whether the petitioner
received compensation on November 23, 2004, the court concludes that his
application, dated September 28, 2005, was nonetheless made within a year
after getting compensation.The court determines that the petitioner's application
was wrongfully denied as time-barred and without due deliberation.

Held by Court: The court overturns the respondent's decision to deny the
petitioner's application on the grounds that it was past its expiration date.Within
eight weeks, the respondent is required to follow their policy and reevaluate the
petitioner's application on its merits.The court makes it clear that the respondent
cannot deny the petitioner's application since it is past its expiration date.
