EThames Harvard Edge Learning Contract

On this day dated May 9th, 2023, this Learning Contract is hereby assented to,

WHEREAS APoojitha having EDC2021-316 and residing at

17-1-391/T/96, Saidabad,Hyderabad from Batch of 2021 in B.Com Computer
Applications is desirous of taking additional courses and attending additional
classes as part of EThames Educational Society’s “Harvard Edge Program”
with the aim of becoming a career-ready professional and on successful
completion earning certifications from Harvard Business Publishing
Education; and
WHEREAS EThames Educational Society is desirous of providing to its
interested students, who meet and continue to meet the criteria set forth, the
“Harvard Edge Program” with the aim of developing such students into
career-ready professionals who on successful completion of those courses in
“Harvard Edge Program” will earn certifications from Harvard Business
Publishing Education; and
WHEREAS A Srinivas Reddy is desirous of seeing their A Poojitha become a
career-ready professional through the “Harvard Edge Program” and support
them in the successful completion of courses within the program to earn
certifications from Harvard Business Publishing Education; do hereby agree:
1. EThames Educational Society will bear the costs of the “Harvard Edge
Program” on behalf of A Poojitha , including student license purchase,
material, instructors, infrastructure costs including classroom, projector,
smart board, and security;
2. EThames Educational Society will manage the execution of the Harvard
Edge Program including planning, instructional design, course selection,
learning path construction, course content access, course content delivery,
class scheduling, doubt solving, technical issue troubleshooting, and
communication with A Poojitha and A Srinivas Reddy ;
3. A Srinivas Reddy agrees to meet and continue to meet the eligibility
criteria for entrance into and continued eligibility for participation in the
“Harvard Edge Program”, namely, A. If belonging to Batch of 2021 or 2022,
(i) to maintain an attendance percentage of 75 or higher in all regular
subject classes scheduled, the 75% or higher attendance percentage
requirement starting from May 9th, 2023, and continuing till the end of
the Harvard Edge
Program;
(ii) to maintain a CGPA of 80% or higher in regular subjects scheduled in each
semester, starting from May 9th, 2023, and continuing till the end of the
Harvard Edge Program;
(iii) to achieve and maintain 80% marks in all the assessments conducted as
part of the Harvard Edge Program; and
(iv) Criteria as may be notified or changed from time to time;
B. If belonging to Batch of 2023 or subsequent years’ batches, as may be
notified.
4. A Poojitha further agrees to
(i) diligently attend and participate in every special class scheduled and
conducted as part of the Harvard Edge Program, and if unable to attend for
any particular reason to furnish such reason before the class start time; (ii) to
be on their best behaviour during regular class hours and during special
classes scheduled for Harvard Edge Program;
(iii) Not violate the terms of their student license of Harvard Business
Publishing Education including but not limited to unauthorized sharing of
materials;
(iv) to complete the assigned course material, assignments, assessments,
and quizzes for each course in the Harvard Edge Program; and
(v) work co-operatively with EThames College management in successful
completion of the Harvard Edge Program.
5. A Poojitha further agrees that if they fail to meet or continue to meet
the criteria set forth in Clause 3 or 4 of this agreement, or they choose to
discontinue their participation in the Harvard Edge Program after assenting
to this agreement, they shall stand in breach of this agreement, and agree to
pay EThames Educational Society reasonable liquidated damages amounting
to Rs. 35,000 (Indian National Rupees Thirty-Five Thousand) as consequence
of their breach.
If A Poojitha is unable to pay the liquidated damages set forth in Clause 5 in
the reasonable time period of 1 month, A Srinivas Reddy agrees to stand
guarantor for A Poojitha and pay the liquidated damages amount to EThames
Educational Society within a reasonable time period of an additional 1 month.
6. It is at the sole discretion of EThames Educational Society as to which
students would be allowed to continue in the Harvard Edge Program, and if it
is deemed a student has failed or is failing to meet the requisite criteria for
continued inclusion in the Harvard Edge Program, such student shall be
deemed to be in breach of this agreement and be liable to pay the liquidated
damages to EThames Educational Society.
7. A Poojitha and A Srinivas Reddy agree to indemnify and hold harmless
EThames Educational Society for any loss or damage suffered.
9. No parties make any warranties or guarantees to any aforementioned or
third-party by virtue of this agreement other than the above stated.
10. Any dispute arising out of this agreement shall be referred to the
jurisdiction of the courts of Hyderabad, Telangana.
11. The Clauses in this agreement are severable.
