While confirming the minutes for item 8.01, it was


commented by some Directors that only Second level
Officers should have been minuted for Sub-Committee.

To this, management explained to Board that the


objective behind the constitution of Sub-Committee of
the Board was to facilitate the Board to understand
entire issue in an independent and fair manner.
Moreover since it was Sub-Committee of the Board only
independent Directors could have been the Members.
Second level Officers were proposed only for field
inspection while management Officers were there to
furnish all necessary particulars. With these
obervations, Board confirmed the minutes as it is.

On the second issue for item No. 9.07, specific


comment of the Secretary to Government, Housing and
Urban Development Department vide D.O.Lr.No. 858 / HB-5
(1)/2006 – 1 dated 9.1.2006 was brought to the notice of
the Board. After detailed discussion, the Board
resolved to modify the earlier resolution as follows:

In item no.9.07 Board resolved to amend the para 2

school sites etc. will only be disposed of through
Public auction.

Board discussed the issue in detail and noted that


Enhanced Compensation cases involves huge financial
outflow with higher rate of interest to be paid by
Board. Sinking fund is constituted to take such
unexpected contingencies into account. Considering
above, Board resolved to deposit the sinking fund in
Banks where the rate of interest offered is higher.

6.03 Tamil Nadu Housing Board - Dearness Allowance sanction of


enhanced Rate of Dearness Allowance from 1st January 2006
@71% of Pay(per month)–Orders–Issued–Payment of Enhanced
Dearness Allowance to the employees of Tamil Nadu Housing
Board – Matter placed before the Board for approval.

After considering the financial position of the


Board, the Board resolved for the payment of D.A. at
71% to the employees of Board with effect from
1.1.2006.

Payment of consolidated pay to the Legal Consultant for

Board resolved to give enter upon permission to the


Chief Engineer, Highways (Project) for conducting pile
load test and confirmatory bore test etc., in the
portion of TNHB lands required for the construction of
Railway over bridge, subject to the folowing conditions:

1. The actual extent of TNHB land required for the


Railway over bridge may be confirmed by the Highways
Department by having joint inspection with Executive
Engineer & Administrative Officer, A.A.Nagar
Division.

2. The Board will fix the land cost as per the rules in
practice, based on the guideline or market value
whichever is higher. The Costing will be done
separately and informed to the Highways Department
shortly.

3. The Highways Department should construct new


compound wall on the new alignment and to be joined
with old compound wall.

8.04 Tamil Nadu Housing Board – Land Acquisition – Erode


District – Erode Taluk and village – LAOP cases
30/3,31/03 and 4/04 – Appeal preferred in Appeal Suit
No.488-450 of 2005 – WA in WAMP No.3167/05, 3168/05 and
3169/05 filing of WA and modification petitions before

The Board discussed entire issue with deliberations on


rules and regulations of the Board, correspondence bet-
ween Board and Government and all the related issues in
detail. Specific reference on pendency of the proposal
in Government letter No.26518/LA1-2/02-9 dt. 6.6.2005
asking various particulars and Board reply vide letter
No. LAI.5/44935/96 dated 29.07.05 giving exhaustive
details was looked into. Management viewpoint as well as
report of Sub Committee was deliberated in its entirety.

1. Board accordingly takes on record the following:

(i) The Board takes on record the management


views as elaborated in detail at para–10
of the Board agenda indicating rejection
of petitioner’s request, pendency of the
writ appeal filed by Board and financial
aspect. These have been taken as
dissenting views of the management.

(ii) Board also feels that it may not be


possible to decide on the request of the
petitioner for the exclusion / deletion
as suggested by the Government vide its
letter No. 26518/LA 1(2)/2002 – 14 dated
27.9.2005 for consideration. Since any
such exclusion / deletion has to be done
on a general principle with full
justification.

(iii) Board also notes that general procedure


for exclusion/ deletion is done based on
specific Government direction as
enumerated in para 9 of the agenda as
precedences. These procedures and
precedences prevent Board from taking a
final decision.

(iv) Board also notes that sub-committee has


given only general recommendation on
deletion as mentioned in its report on
pages 7 to 11.

2. With due consideration to points mentioned in the


para – 1 above, Board after critical examination,
arrives at following possible alternatives:

i) Earlier request of the petitioners asking for


exclusion was already rejected by the
management. Writ appeal filed by management
is also pending and financial viability as
worked out by EE clearly indicates against any
deletion / exclusion. To accept the
management’s view point as reasoned out in
para 10 of Board agenda and continue with the
‘Sholinganallur Satellite Town Scheme’ without
any deletion/exclusion. No exclusion /deletion
should be done from originally proposed
scheme.

i) As suggested by the Sub-Committee of the Board
in its report at pages 7 to 11 indicating
that CMDA in its authority meeting dated
2.7.2004 has suggested 500 meters boundary
from OMR for I.T. corridor and the same is
under consideration of the Government.
Furthermore, Government vide its order
G.O.Ms.No. 81 dated 24.4.2003 of Highways
Department have declared OMR as Cyber
corridor of Chennai. Government has also
issued order vide its G.O.Ms.No. 287 dated
8.7.2004 taking similar line for Master Plan
for Mamallapuram Local Planning area.
Considering these policy decisions and also
considering abnormally high land cost, 500
metres depth from OMR may be deleted from
originally proposed boundary for satellite
town scheme to be in consonance with IT
policy of the Government.

OR

ii) The Government announced the scheme in


Legislative Assembly on 21.8.1996. This
scheme is still under pre 4(1)stage and
there are numerous correspondence,
clarifications, further particulars between
CLA office/Board and Government. Meanwhile,
the land value has become prohibitively high
and land cost alone is estimated to be
around Rs. 520.48 crores. In addition,
there will be problem of accompanying
litigation over compensation in the form of
LAOP cases. In view of this, Government may
consider and decide the dropping of entire
scheme itself.
OR

iii) Implementation of entire scheme is getting


prolonged due to issue of wet land involved
in the scheme. Out of 520.48 acres of land
involved in acquisition, 349.67 acres is wet
land and 84.20 acres is dry land. To avoid
delay and to expedite the implementation of
scheme, all the wet lands may be excluded
and scheme may be implemented in the dry
land alone.

Government may now be requested to take various


observations of the Board in para 1 above into

consideration along with relative merits and demerits of
the above four options in para 2 and take appropriate
decision.

9. ALLOTMENT

9.01 Tamil Nadu Housing Board – Allotment – Standardisation of


various forms of Lease Cum Sale Agreement and
Draft Sale Deeds approved and communicated for adoption –
Matter placed before the Board for information.

School building at Tiruvallur for the accommadation of
District Session and Chief Judicial Magistrate Court on

Board also resolved that before issuing allotment


order the EE concerned should verify eligibility criteria

9.06 Tamil Nadu Housing Board – SLC House No.49 at


Kancheepuram – Thiru V. Rajamani filed EP 10/2005
Compensation and cost for Rs.11,000/- ordered in
O.P.No.47/97 paid to the complainant sanctioned to
Executive Engineer & Administrative Officer, Vellore
Housing Unit – pending approval of Board – The matter is
placed before the Board for ratification of the action
taken on the payment of compensation.

Unit – R.M. colony Dindigul Part I – Case filed by Thiru

9.08 Tamil Nadu Housing Board – Board’s Rental – Allotment of


Office accommodation in Plot No.C-48 at Anna Nagar
(Ground Floor) requested by the Federal Bank Limited –
Matter placed before the Board for taking a decision

1. Board resolved to allot the office accommodation on


rent to M/s. The Federal Bank Limited for an extent of
2997 Sq.ft. at the rate of Rs. 29/- per sq.ft. to M/s.
The Federal Bank Limited,Anna Nagar,Cheennai subject
to revision of rent at 10% every year as per
Government order with usual other terms and
conditions.

2. To fix the lease period for six years as per the


conditions stipulated in the note and with the
condition that the renewal should be done once in two
years. And the notice period of six months in case of
intention to vacate the premises.

3. To permit them to install a ‘V’ SAT Antenna in the


terrace of the building for the ATM connectivity by
charging an additional rent of Rs. 400/- per month
subject to usual terms and conditions as stipulated in
condition 1 and 2 above.

9.09 Tamil Nadu Housing Board – Board’s Rental – Recovery of
rent from the staff members those who are occupying in
staff quarters revised order to recover the rent from
1.1.04 instead of 1.10.02 requested by the Tamil nadu
Housing Board Employees Union – Matter placed before the
Board for taking a decision.

Board deferred for further particulars on involvement of


financial implication for chanage of period.

9.10 Tamil Nadu Housing Board – Allotment – Allotment of plots


to 773 Special Task Force Personnel – Orders issued –
Sanction of cost Rs.54,29,88,200/- Adjustment of the
amount against Government loans – Orders issued – Matter
placed before the Board for orders.

Board resolved to hand over the plot to the STF personnel


and to issue sale deed pending adjustment of the amount
sanctioned against the loans due to the Government. Board
also resolved to ensure the approval of layout and the
approval of the local body etc., before handing over of
the site.

9.11 Tamil Nadu Housing Board – Allotment – Plot No.20 and 21


in Padi Land Bank scheme at Anna Nagar Western Extension
– Request for allotment – Matter placed before the Board
for taking a decision.

Board taken on record the management view of bringing


such plots under auction. Howerver, overuling these
views Board notes that these plots are only meant for
Economically weaker section (EWS) and smaller extent and
Government may take a appropriate view. Board
accordingly resolves to send detail report to Government
for its decision.

9.12 Tamil Nadu Housing Board – Allotment – Disposal of


School/Commercial/Public Purpose sites through auction
by City & Mofussil units – auction sale confirmed –

9.14 Tamil Nadu Housing Board – Besant Nagar Division –
Indira Nagar High School site – converted into 20
residential plots apart from a Park site – allotments
made by Government under Government Discretionary Quota –

Board discussed the issue in detail with due


consideration to sequence of correspondence between the
Board and the Government.

1. After detailed discussion on various issues involved,


Board made a specific note on following points.

(i) Although while discussing Pricing Committee


agenda, Board passed a resolution No.6.02
dt.25.8.04 seeking Government direction for
allotment, however issue of putting entire
arising 20 plots at the disposal of the
Government was never put up to Board earlier
as a separate subject and no specific
resolution to that effect was passed. This
was also duly reported to Government vide
Board’s letter dt.25.5.2005

(ii) Management again requested specific


Government order in its letter dt.15.12.2005
for reserving these plots under GDQ which
was negatived in the Government letter
No.38814/HB5.1/2005-1 dt.6.1.2006. Detailed
reply to the above letter was sent to
Government vide Board’s letter No.A-1(7)-
55625/2004 dt.21.1.2006.

(iii) Management view point in following


G.O.Ms.No.1574 Housing & Urban Development
Department dt.24.12.2001 indicating general
policy of 15% for GDQ and 85% for Board is
taken note and recorded as dissenting view
of the management.

2. While giving due consideration to above points, Board


noted various precedences in arising plots.

(i) All the 11 additional residential plots


approved in PP/10(D)/No.71/93 by the CMDA in
Besant Nagar Extension Ph.I were also
allotted by the Government under
discretionary quota in the year 1995 at
ruling rate.

(ii) 17 additional plots in Besant Nagar approved
by CMDA in No.PP/L.O.2/98 dt.19.5.98 were
allotted by Government under Discretionary
Quota in the year 1998 at ruling rate.

(iii) 4 additional plots in part layout in Besant


Nagar Extension Phase I approved by CMDA in
PP No.10(D)53/95 during 1995 were allotted
by Government under GDQ in the year 1995 at
ruling rate.

(iv) 21 left over Board quota residential plots


in Mogappair Eri scheme as per Board
Resolution No.9.10 dt.18.11.2003 in the year
2003-04 were also allotted by the Government
under GDQ.

(v) 20 additional plots identified during


demarcation in Sholinganallur Ph.III during
the year 2005 was allotted by Government
under GDQ.

These are some of the many precedences which are


indicative of Government allotting arising plots
under GDQ.

3. The Government also made a specific decision in its


letter No.31053/HB 5-1/2004-7 dt.20-6-2005 that
Government have decided to allot these 20 plots with
the condition that value should be market value or
guideline value whichever is higher.

In view of above, overruling the various issues

3.02 Tamil Nadu Housing Board – Consolidated Demand


Collection and Balance statement for the month of
April 2006, May 2006 and June 2006 – Matter placed
before the for information.

Recorded. Board expressed that the revenue


collection is very poor and official responsible for
the poor collection must be pulled up. A special
report should be given in the next meeting.
Managing Director should issue a circular to all
the Executive Engineers to give special drive to
improve the collection. Further transfer and
disciplinary action should be initiated in the
deserving cases.

Board resolved to address the Government in the


Housing Department to take up the matter with the
Home Department which should instruct the Police

4.03 Tamil Nadu Housing Board -Anna Nagar Division –


Construction of 100 HIG flats at Stage IV and 152
HIG flats at Stage V at Padi village, Chennai-
Revised RFS for Rs.1172.75 lakhs – Matter placed

decided to take up the next meeting - matter again

Board resolved to file a Civil Suit against the


Tamil Nadu State Construction Corporation for their
failure to complete the project in time and also to
claim compensation before the Official Liquidator
for the losses incurred by the Board.

approving the RRFS value and to fix the price
without any loss to the Board since there will be
good demand for the flats.

Considering the financial implications which would have


caused heavy expenditure in the form of interest about
Rs.3,69 Crore in the Court. Hence, the Board resolved to
pay Rs.6,60,000/- as legal fees for the 43 batch cases to
the Advocate General.

Board further resolved that as regards to the legal fees to


the former Legal Adviser Thiru D. Veerasekaran, it has been
decided to withhold the amount since he has not yet
completed certain formalities with regard to the handing
over files and case bundles to the present Legal Advisers.

Board resolved to obtain the Government approval to


collect the entire balance amount of Rs. 6,24,312/-
outstanding on the date of cancellation and to revoke
the allotment of the shop with a penalty of Rs. 5000/-
since it is not reallotted to anybody till date. The
Board took note of the fact that
(a) balance amount repayable on the date of revocation
is more than 4 lakhs and is still with the Board.
(b) The allotment made in favour of someone else did
not materialised and that this individual is a widow
who deserves some sympathetic consideration. Also,
the Board noted that this would avoid loss of revenue
to the Board.
