Similarly, the legal heirs of
Karuppa Gounder, namely, Ponnammal, Jagadambal,
Chandrakanthi and Shanmugam have entered into a registered deed of partition on
06,:t1.tr995 whereby dividing .the propert.ies ar$ong -themselve+ under
doc.No.2758/1995. ln and by the said partition, Schedule A mentionpd. property was
allotted to the share of Shanmugam, Schedule B to Ponnammal, Schedule C to
Jagadambal and Schedule D to Chandrakanthi absolutely. Subsequent thereto, the
aforesaid Mr.shanmugam along with his daughters, namely, Geetha and Anitha have
jointry conveyed about 2.70 acres in SF Nos.155110 and 155/1 to one Mr.A.l(anqaz$,
Kumarasamy and C.shanmugam in and by a sale deed dated 11.07.2005 under doc.
No.4006/2005. T-heabr€said {Ur.foganathan; ssn sf Mr'Natesa Gounder alsng with his
children, namely, Sumathi, Velumani and Sachithanandam, the aforesaid Shanmugam
along with his daughters Geetha and Anitha, the aforesaid Gopalan along with his
daughter Punithavathi through their power agent Mr.Gopal have jointly conveyed about
1.00 acre in SF No.155717,1O"O2 acres in SF No.155/6, 1.10 acres in SFN o.15518 to
one lltrADhardapani, Kumarasamy, Shanmugam and Kanagaraj in and by a sale deed
dated 07.10.2b0S under doc. No.6809/2005. Subsequent thereto, allthe aforesaid four
persons have parceled-thepoperty'-into-housesites and Site.Nos.l3'& 14 adrneasu*ng
about 5600 sq. ft. was conveyed to Ms.Nithya Venkataraman, represented by her power
agent Mr.Venkataraman in and by a sale deed dated 09.08.2006 under
doc. No.4244l2006. Ever since the date of sale, the aforementioned
Ms.Nithya Venkatraman has been in Absolute possession and beneficial enjoyment of
the prryerty.

AND WHEREAS the PURCHASER herein has approached the VENDOR and has
offered to purchase Site No.14 and which is more fully described in the Schedule
annexed hereto and hereinafter referred to as the SAID PROPERW for brwity sake
for a sum of Rs.42,06,400/- (Rupees Forty-Two Lakhs Six t$ousand and Four
hundred only) nett free of all enour+br.aRoes, clairns and dernandsof all kinds.

AND WH:EREAS the VENDOR has accepted the said offer of the Purchaser and luas
agreed to sell to the Purchaser the said property and which is more fully described in
Schedule hereunder written for the said sum Rs.42;0640O- (Rupees Fotty.Two
Lakhs Six thousand and Four hundred only) nett free of all encurnbran@s. claims
and demands of all kinds,

NOW THIS DEED OF ABSOLUTE SALE WITNESSETH that in pursuance of the


aforesaid agreement and that in consideration of the sum of Rs.42,06,4001- (Rupees
Forty-Two Lakhs Six thousand and Four hundred only) paid by the Purchaser unto
the Verdor in the following manner viz'

'1. A sum of Rs38,83,988/' {Rupees Thirly Eght Lakhs Eighty T.hree Thousand Nine

Hundred and Eighty Eight Only) paid by DD vide DD No.516087, dated 06-09-2018
drawn on Axis Bank favouring the vendor.

2. A surn of Rs.3,22,41?- (Rupees Three Lakhs Twenty T-wo T-housand Four l-lundred
and T$aetve Onlyi paid into the Coffers of Government of lndia by way of TDS for
and on behalf of the Vendor as per the Certificate No.0318AR7551 dated
26-0T-2A16 under Sec-tion 197(1y195 of the lncome Tax Act issued by the Office of
the lncome Tax Officer lntl Tax Ward2(2) CHE. vide CBDT E-Receipt for e-tax
payment under Axis Bank lnternet Tax Payment reference No.8706600 dated
06-09-2018.

Thus, the receipt of which sum of Rs.42,06,400/- (Rupees Forty-Two Lakhs Six
thousnd and Four hundred only) the Vendor does hereby admit, acknowledge ard
acquit of and trom the same and every part thereof ; does for ever acquit, release and
discharge the Pur,chaser.. The Vendsr does hereby SELL, CONVEY, GRANT,
TRANSFER, ASSIGN and ASSURE unto the Purchaser herein by way of an
ABSOLUTE SALE and free of all claims and encumbrances of all her right, title and
interest in all that piece and parcel of land which is more fully described in Schedule
hereunder written hereto unto and to the use and benefit of the Purchaser herein
absolutely and for ever together with all the water courses, drains, minerals, plants,
hedges and all the easement rights, advantages and privileges now or hitherto before
held, ue€d or reputed to have boen used or enjoyed therewith and all th€ ESTAIE,
RIGHT, TITLE, INTEREST, CLAIM ahd DEMAND of the vendor herein, in, to and upon
the said property more fully described in the Schedule hereunder and every part thereof
TO HAVE AND TO HOLD the same unto the use and benefit of the Purchaser
absolutely and for ever.

The Vendor does hereby covenants with the Purchaser that the Purchaser shall and
may at all times hereafter peaceably and quietly own, possess and enjoy the said
property and rec,eive the rents and profits thereof without any lnterruption, let or
hindrance or claim through or under them or through or under any Person or persons
through vyhom the vendor has derived title either immediately or remotely.

The Vendor does hereby covenants with the Purchaser that she has a good, valid, full
and unimpeachable title to sell and convey the said Schedule mentioned property and
every part thereof to the Purchaser in the manner aforesaid and that she has not done,
omitted or knowingly stlffered or has been party or privy to any act, deed, matter or
thing whereby the said property or any part thereof is or may be impeached,

encumbered or affested in Estate, Title or otherwise or whereby the Vendor ean in any
way be hindered from conveying, granting or assigning the said Schedule mentioned
property absolutely and in the manner aforementioned to the Purchaser.

The Vendor herein agrees and undertakes to fully indemnify and save harmless the

Purchaser herci{1 at all tirnes free of atl litigationrs, clairns and dernandswhatssever and
to indemniff the Purchaser against any loss, liability, expenses and damages, that may
be incuned by the Purchaser by reason of any defect or deficiency in title or lack of
power I right on the part of the Vendor herein to sell and convey the said property
hereby conveyed or by reason of any mistake or deficiency in the description or other
particulars of the said property or any proceedings by the authorities acting under the
lncome Tax Act, Tamilnadu Urban land (Ceiling and Regulation) Act or under any other
law for the time being in forc,e or by reason of any claim or demand that may hereinafter
be made by any person on, over and to the said property described in the Schedule
hereunder. The Vendor herein agrees and undertakes to fully indemniff the Purchager
against any loss, damages or expenses that may be incurred by reason of any
encumbrances, lien, charges, acqujsition or requisition proceedings, attachment of
coufis or any public authorities whatsoever against the said property which is hereby
conveyed by the Vendorto the Purchaser.
