Employment Pass (Category I, II and III), under the purview of Ministry of Home Affairs
(MOHA) and Immigration Department of Malaysia will commence as follows:-

EXPATRIATE IN MALAYSIA

i. Please check the validity of current visa/pass. The current visa validity (Employment, Dependent &
Student Pass) should be 30 days for Category I & II.

ii. As for Category III, expatriate have to be in country of origin when applying for Employment Pass.

iii. Validity of passport must be 12 months or above when applying for Employment Pass.

iv. If the Principal (expatriate) wants to bring the family to Malaysia, please apply together with your
application for dependent pass or the principle has the Employment pass sticker in their passport
then apply for the dependent pass application, which they are still in their country of origin. The
principal’s family has to wait for the Visa With Reference (VDR) to be approved and to be sent to
Malaysian Embassy/High commissions in your country of origin.

EMPLOYMENT PASS ( CATEGORY I )

Eligibility 1. Expatriate must earn a basic salary of minimum RM10,000 per month; AND
criteria 2. Expatriate must have an employment contract valid for a minimum of 5 years

criteria 2. Applicant’s employment contract must be 12 months

DEPENDENT PASS (DP)

Features 1. Allows the holder to stay in West Malaysia

3. For social and welfare purposes, the holder may request for special permission to undertake
activities from the Immigration Department of Malaysia

SOCIAL VISIT PASS (LONG TERM)

Eligibility 1. Children above 18 years old and unmarried of Employment Pass holder; OR
criteria 2. Parents & Parents-in-law of Employment Pass holder.; OR
3. Common law spouse of Employment Pass holder can be considered

Features 1. Allows the holder to stay in West Malaysia


2. Employment is not allowed and requires conversion to Employment Pass
3. One (1) time application and change of partner is not allowed for common law spouse

PROFESSIONAL VISIT PASS (PVP)

Eligibility 1. Expatriate applicant fulfills one of the following categories:

Category I: Expertise Transfer
Category II: Research
Category III: Training
Category V: Volunteers

Features 1. Contract is for 3 months to 12 months, and is restricted to one contract / project at a time.
2. The position is non salaried.
3. Freelancer or unemployed applicant will be denied to engage in contracted activity in
institution
4. Not eligible to get Dependent Pass for spouse / children / biological father & mother

Conditions 1. The maximum duration for an expatriate to hold PVP is 12 months. No extensions are
allowed after the contract/project finished or beyond 12 months.
2. All PVP applications must obtain an Approval Letter (VDR) before entering Malaysia.
3. Applicants who have entered the country will have 3-7 days from entry date to endorse
PVP sticker.
4. In case of change of employer while the pass is still valid, the PVP holder must cancel the
current pass and served 3 months of Cooling Off Period in your country of origin before
applying with new employer.

FOR SPECIFIC
ACTIVITIES
COOLING-OFF PERIOD REQUIREMENT

1. Employment Pass Category III holders whose pass have been renewed for two (2) times or 3 years in a row
MUST leave the country and serve 3 months cooling off period to be able to apply for Employment Pass
Category III again. Exemption is only given for cases of Employment Pass Category III converting to
Employment Pass Category I / II.

2. Employment Pass Category III holders who are changing employers MUST leave the country and serve 3
months cooling off period to be able to apply for Employment Pass Category III with different employer. –
NO LONGER AVAILABLE

3. Student Pass or Dependent Pass holder have to cancel the current pass and MUST leave the country to be
able to apply for Employment Pass Category III. NO LONGER AVAILABLE

3. Visit Pass (Temporary Employment under Professional Visit Pass) holders who wanted to convert to
Employment Pass (all categories) MUST leave the country and serve 3 months cooling off period to be able
to apply for Employment Pass (all categories). –NO LONGER AVAILABLE

4.a Social Visit Pass visa holders who wanted to get an Employment Pass (for Category I and Category II only)
have to pay for the Journey Performed fee. (Depends on countries applied)

4.b Social Visit Pass visa holders who wanted to get the Professional Visit Pass must leave the country to be
able to apply for Professional Visit Pass from country of origin.
PROCESS OF VDR (outside of Malaysia)

STEP 1 ISSU received complete expatriate documents from HRD and PPGP

STEP 2 Prepare to complete the document and payment through e-procurement


* Stamping from LHDN for the contract ( 1 day)
* Official letter to Expatriate Service Division (ESD) (1-2 days)
* Online for visa payment through e-procurement (4-5 days after receiving the
document)

STEP 3 Complete document submission to Expatriate Service Division (1 day)

STEP 4 Waiting for the VDR approval from ESD (3-7 days after submission)

STEP 5 Collect VDR letter from ESD (1 day)

STEP 6 Sending the VDR letter via expatriate email. Expat have to print in colour before
proceed to the Malaysian Embassy/High Commissioner

STEP 7 Malaysian Embassy/High Commissioner/Consulate will process and stamp into


expat passport for the Single Entry Visa under Employment Pass

STEP 8 Expatriate arrived Malaysia, submit passport within 3-5 days after arrival to ISSU
counter at Examination Building for EP/Dependent/PVP sticker

STEP 9 Submit AP/passport/payment together to ESD for EP/Dependent Pass sticker (1


day)

STEP 10 Collect complete passport with EP or dependent pass from ESD (5 days)

STEP 11 Expatriate collect passport with EP/Dependent/PVP once ISSU email for
collection at Visa Unit.
PROCESS OF EXTENSION OF EP AND DEPENDENT

STEP 1 ISSU received complete documents from HRD and PPGP.

STEP 2 Prepare to complete the document and payment through e-procurement


* Stamping from LHDN for the contract ( 1 day)
* Official letter to Expatriate Service Division (ESD) (1-2 days)
* Online for visa payment through e-procurement (4-5 days after receiving the
document)

STEP 3 Complete document submission to ESD by ISSU. Acknowledgement letter (AP) will
be given by ESD as a prove for the submission of application (1 day)

STEP 4 Checking for the approval from ESD (3-7 days after submission)

STEP 5 After getting the Approval from ESD (estimated maximum 14 working days)
* Email to expatriate/Dependent to submit passport to ISSU (1 day)
* Prepare the payment to be included with AP and passport/s before submitting to
ESD

STEP 6 Submit AP/passport/payment together to ESD for EP/Dependent Pass sticker (1day)

STEP 7 Collect complete passport with EP or dependent pass from ESD (3-5 working days)

STEP 8 ISSU will email to expat to collect passport at the ISSU service counter.
PROCESS OF EXTENSION WITH DIFFERENT POST IN THE INSTITUTION

STEP 1 ISSU will receive complete Cancellation documents from HRD and PPGP.

STEP 2 Prepare for the cancellation document of the previous EP (no payment for this
process)

* Official letter to Expatriate Service Division (ESD) (1-2 days)

STEP 3 Submit and collect application with passport to ESD for cancellation (1day)

STEP 4 Expatriate shall collect their passport with EP at counter service ISSU once ISSU
emailed to expatriate for passport collection.

STEP 5 Expatriate shall submit the cancellation EP back to HRD and PPGP for next

COMPLETION OF SERVICE TENURE / RESIGNATION

Expatriate have to make preparation before comply with the standard administrative
procedures and requirements of the University before your services ended in the University
of Malaya. University of Malaya have the right to take prompt action against any expatriate
who doesn’t comply with the term 4.(2) written in the Human Resource Division Completion
of Service Tenure or Resignation letter.

ISSU will file a report to the police department and to the Malaysia Immigration department if
the expatriate does not submit (whatever any reason/s given) for the cancellation of the
active visa under the name of University of Malaya. This is to insure the visa is not been
misuse by expatriate and to uphold the good name of the university.
OVERSTAY CASES PROCESS

i. Expatriate with 1-6 days overstaying case from the expiry of EP/Dependent pass
shall pay the Special Pass fee of RM100.00 only. Expatriate/Dependent can resume
processing their application while still in Malaysia.

ii. Expatriate with 7-30 days or more have to come to the Enforcement Unit at Level 4,
Immigration Department in Putrajaya to settle the compound payment and Special
Pass. (14 working days process or more)

iii. Blacklist means the name of expatriate/dependent shall be banned for 3-5 years from
re-entering Malaysia again.

iv. Under the Section 15(1)(c) Immigration Act 1959/63 with the overstaying cases by
expatriate/dependent, the institution can be charge for protecting the employees
under Immigration Act Section 56(1)(d). The institution shall be made to pay for
compound payment of RM5,000.00 apart from the expatriate/dependent compound
payment.

B EXTENSION OF EP/DEPENDENT PASS (7 to more than 30 days)

B1. NOT BEEN BLACKLISTED


1. Visa Unit,ISC received overstay documents from HRD and PPGP.
2. Prepare for the overstay with new offer letter document
* Official letter to Expatriate Service Division (ESD) for a Memo letter (1 day)
4. Visa Unit shall call the expatriate/dependent to confirm the date to go to
Enforcement Unit, Level 4
Immigration Department in Putrajaya after receive the Memo letter
5. Expatriate and UM representative shall present at the Enforcement Unit, Level 4,
Immigration
Department in Putrajaya for submitting the overstay application. After complete
filling the
overstaying form given by the Immigration officer, the officer will give back the
passport with a
small receipt containing the immigration file number. Only after that, expatriate and
representative
can leave the Enforcement Unit. The Immigration officer shall process the case
within 14 working
days.
6. Visa Unit will be notified through a phone call from the Immigration officer stated
the Malaysia
court decision regarding the amount of payment and whether to leave the country
or not. If, the
decision was to leave the country, expatriate have to buy the flight ticket (duration
of 7 days from
the day coming to Enforcement Unit for the second time.
7. Visa Unit will inform the expatriate/dependent on the same day after receiving a
call from
immigration officer when is the date to go to Enforcement Unit again. Expatriate
will be informed
the sum to pay for the compound payment to Enforcement Unit. Thumbprint and
face recognition
photo shall be taken at the Enforcement Unit together with the payment of
compound (paid in cash
by the expatriate/dependent to the cashier in Enforcement Unit). Passport with
Special Pass
‘Leaving the country’ within the said date of the flight ticket shall be given on the
same day. (1 day)
8. Expatriate shall scan the passport pages that has the departure stamp from KLIA
and arrival stamp
in country of origin. Submit the both pages to HRD/PPGP for applying the
application to HRD and
PPGP.
9. Visa Unit,ISC received the complete documents from HRD and PPGP.
10. Prepare for the complete document before sending to Expatriate Service Division
(ESD)
* Online for visa payment through e-procurement. (after receiving the

* Official letter to Expatriate Service Division (ESD) (1-2 days)
11. Submit application to ESD. Receiving AP from ESD (1day)
12. Waiting for the VDR approval from ESD (7 days or more after submission)
13. Collect VDR letter from ESD (1 day)
14. Sending the VDR letter via postage to expatriate address in country of origin (3-5
days)
15. Expatriate have to submit the VDR and passport to Malaysian Embassy/High
Comm/Consulate in
their country. The Embassy will process for the Single Entry Visa under
Employment /
Dependent (3-12 days)
16. Expatriate/dependent arrived Malaysia, submit passport 3-7 days after arrival to
Visa Unit,ISC for
EP/Dependent sticker.
17. Submit AP/passport/payment together to ESD for EP/Dependent Pass sticker (1
day)
18. Collect complete passport with EP or dependent pass from ESD (5 days)
19. Expatriate collect passport with EP/Dependent once Visa Unit email for collection
at Visa Unit.

B1. BLACKLISTED BY MALAYSIAN IMMIGRATION


1. Visa Unit,ISC received overstay documents from HRD and PPGP.
2. Prepare for the overstay with new offer letter document
* Official letter to Expatriate Service Division (ESD) for a Memo letter (1 day)
4. Visa Unit shall call the expatriate/dependent to confirm the date to go to
Enforcement Unit, Level 4
Immigration Department in Putrajaya after receive the Memo letter
5. Expatriate and UM representative shall present at the Enforcement Unit, Level 4,
Immigration
Department in Putrajaya for submitting the overstay application. After complete

Another
option called ‘3+1 pardon programme’ with payment of RM400.00
for each
applicants and blacklist 3-5 years from re-entering Malaysia.
+ Expatriate choose to apply for extension/new EP, the overstay
document shall be
submitted on the same day

6. Visa Unit will be notified through a phone call from the Immigration officer stated
the Malaysia
court decision to leave the country with blacklisted and the amount of compound
payment.
Expatriate have to buy the flight ticket (duration of 7 days from the day coming to
