Choosing your lawyer

You need to find a lawyer who is willing to accept your legal aid case.
You must hire a lawyer within 90 days or your certificate will be deemed to have expired and you
may need to reapply for legal aid.
If you do not have a lawyer, LAO can provide you with a list of lawyers who may take your case.
Please contact LAO at 1-800-668-8258 for a list of lawyers or if you are having difficulty finding a
lawyer to represent you.
When you find a lawyer, give the lawyer the legal aid certificate that you were provided. The legal aid
certificate enables you to receive legal aid services.
Before you choose your lawyer you should read LAO's change of lawyer policy. The policy is located
on LAO's website, with LAO's Rules and Policies. You should choose your lawyer carefully, as LAO
only approves a change of lawyer based on the policy. If you think you need to change lawyers,
please call LAO at 1-800-668-8258 to discuss your options.
Your relationship with your lawyer

Your lawyer works for you and LAO pays your lawyer.
You should not pay your lawyer directly.
Your lawyer must send you a copy of every account that is sent to LAO. It is for your information only
and you do not have to pay this account.
Use your lawyer's time carefully. There are limits to the amount of time your lawyer can spend on
your case. Time spent on telephone calls, emails and text messages is included in the amount of
time allowed on your case.
Your lawyer must tell LAO if they know that your financial circumstances change or if it appears you
have not provided all the details of your financial situation.
If asked by LAO, your lawyer must provide a letter of opinion about your case. LAO may use that
opinion to decide whether to continue to fund your case.
Information your lawyer gives to LAO about your case is confidential.

Sharing Lawyer-Client Privileged Information with LAO

You have agreed that, as a condition of you receiving legal aid services, LAO and your lawyer may share
information with each other, even if that information is lawyer-client privileged.

You have understood and agreed that:

a. all communications between yourself and LAO, an officer or employee of LAO or legal aid Service
Provider (including the Service Provider's directors, officers, and employees), are considered to be
privileged in the same way as if the communications had been between you and a lawyer under a
lawyer-client relationship;
b. the relationship between yourself and a lawyer who provides legal aid services is the customary
lawyer-client relationship, regardless of the manner in which the legal aid services are being
provided; and
c. the sharing of privileged information or documents with LAO does not negate or constitute a waiver
of lawyer-client privilege.

You have agreed that your confidential or privileged information and documents may be used by LAO for
the following purposes:

to determine your eligibility and ongoing eligibility for legal aid services;
to make funding or case management decisions about your case;
to ensure compliance with the Legal Aid Services Act and the Legal Aid Services Rules, including in
relation to service standards that apply to your lawyer, if LAO has questions or concerns about your
lawyer's work on your case;
to carry out audits and investigations; and
to resolve complaints.
Your relationship with LAO

Stay in touch with LAO, for example if you change address. LAO may need to contact you to get
more information or check your financial situation.
Respond to all requests for information.
Please contact LAO at 1-800-668-8258 if your financial situation changes. For example, if you:
plan to sell or transfer ownership of your house;
have any change affecting your income, assets, family size or living expenses.

Contributions
You have confirmed to LAO your understanding that, if your circumstances improve, you may no longer be
eligible for legal aid services or you may be required to contribute or, if you already have a contribution
agreement, to contribute more towards the cost of your legal fees, back to the beginning of your case.

Cost Recovery
You have confirmed to LAO your understanding that, if the court makes the other party pay some or all of
your legal costs, the money will be paid to LAO, not to you.

Also, you have confirmed your understanding that LAO is entitled to recover the cost of providing your
legal aid services from any money or property you recover as a result of receiving legal aid services.
