Philippine Blood Coordinating Council
(PBCC) purposes:
1. to disseminate correct information
to the public regarding the benefits
and advantages of voluntary blood
donation;
2. to motivate different sectors of the
society to donate blood voluntarily;
3. to educate medical and
paramedical personnel regarding
the proper utilization of blood;
4. to promote the use of blood
component therapy to utilize blood
to the fullest;
5. to improve blood banking
procedures and policies;
6. to promote the interchange of
concepts and experiences in blood
donation and transfusion; and
7. to foster participation in
international activities in blood
banking and transfusion.

Section 3, R.A. 1517

emergencies overseen by an

responsible for enforcing this Act
and will establish rules and
regulations for its implementation.
● These regulations may include
maximum ceilings for handling
charges of blood, covering aspects
like collection, processing, storage,
transportation, and sale.
● A reasonable allowance for
spoilage is to be considered as
part of the overall cost of blood.

regulations may result in penalties,

● Amends section 5 of AO. NO. 184,

A&B and O is set at PHP 55.00 per
500 cc and an additional PHP 5.00
is charged for the use of the plastic

Administrative Order No. 291, s. 1976
● Amends section 7 and 13
subsection of AO No. 156, s. 1971
a. Section 7, the additional provision
is that a physician may be allowed
to operate and manage a blood
bank provided he/she is registered
with the Board of Medical
Examiner to practice the medical
profession in the Philippines.
b. Section 13, states that the
requirements of a blood bank and
blood processing laboratory,
including supervision and
management must be carried out
by a registered and qualified
physician who is only allowed to

manage not more than 2 blood
banks.
Administrative Order No. 293, s. 1976
● Contains only supplementary
provisions on the collection,
processing and sale of human
blood and the establishment of a
blood bank and a blood processing
laboratory.
Penalties from the Revised Penal Code
● Imprisonment of not less than 12
years and one day nor more than
20 years or a fine of not less than
P50,000 nor more than P500,00 or
both at the discretion of the
competent court.
LEGAL ISSUES AND CONCERNS
Compulsory Blood Donation Policy:
● Some blood banks require donors
for patients needing transfusions.
● Aims to maintain a continuous
blood bag supply, raising ethical
concerns.
Nurses Performing Phlebotomy:
R.A. 7719
● Nurses authorized to conduct
phlebotomy due to a shortage of
medical technologists.
● Raises questions about the legal
scope of practice and competency
for nurses.
Legality of Selling Blood Bags:
● Questioning the legality of selling
blood bags under R.A. 7719.
● Private individuals not authorized
can face penalties for such sales.
PROVISIONS OF R.A NO. 7719
PRELIMINARY PROVISIONS
● Policy of the State:
a. to promote and encourage
voluntary blood donation by the
citizenry and to instill public
consciousness of the principle that
blood donation is a humanitarian
act;
b. to lay down the legal principle that
the provision of blood for
transfusion is a professional
medical service and not a sale of a
commodity;

c. to provide for adequate, safe,
affordable and equitable
distribution of supply of blood and
blood products;
d. to inform the public of the need for
voluntary blood donation to curb
the hazards caused by the
commercial sale of blood;
e. to teach the benefits and rationale
of voluntary blood donation in the
existing health subjects of the
formal education system in all
public and private schools, in the
elementary, high school and
college levels as well as the
non-formal education systems;
f. to mobilize all sectors of the
community to participate in
mechanisms for voluntary and
non-profit collection of blood;
g. to mandate the Department of
Health to establish and organize a
National Blood Transfusion Service
Network in order to rationalize and
improve the provision of adequate
and safe supply of blood;

h. to provide for adequate assistance
to institutions promoting voluntary
blood donation and providing
non-profit blood services, either
through a system of
reimbursement for costs from
patients who can afford to pay or
donations from governmental and
nongovernmental entities;
i. to require all blood collection units
and blood banks/centers to operate
on a non-profit basis;
j. to establish scientific and
professional standards for the
operation of blood collection units
and blood banks/centers in the
Philippines;
k. to regulate and ensure the safety
of all activities related to the
collection, storage and banking of
blood; and
l. to require the upgrading of blood
bank centers to include preventive
services and education to control
spread of blood transfusion
transmissible diseases

FOLLOWING TERMS
a. Blood/blood product
● refers to human blood, processed
or unprocessed and includes blood
components, its products and
derivatives;
b. Blood bank/center
● a laboratory or institution with the
capability to recruit and screen
blood donors, collect, process,
store, transport and issue blood for
transfusion and provide information
and/or education on blood
transfusion transmissible diseases;
c. Commercial blood bank
● a blood bank that exists for profit;
d. Hospital-based blood bank
● a blood bank which is located
within the premises of a hospital
and which can perform
compatibility testing of blood;

e. Blood collection unit
● an institution or facility duly
authorized by the Department of
Health to recruit and screen donors
and collect blood;
f. Voluntary blood donor
● one who donates blood on one's
own volition or initiative and without
monetary compensation;
g. Department
● the Department of Health;
h. Blood transfusion transmissible
disease
● disease which may be transmitted
as a result of blood transfusion,
including AIDS, hepatitis-b, malaria
and syphilis;
i. Secretary of Health
● the Secretary of Health or any
other person to whom the
Secretary delegates the
responsibility of carrying out the
provisions of this Act;
j. Walking blood donor
● an individual included in the list of
qualified voluntary blood donors,

(e), who is ready to donate blood
when needed in his/her community.

Section 7, R.A 7719 (Phase-out of
Commercial Blood Banks)
● All commercial blood banks shall
be phased-out over a period of two
(2) years after the effectiveness of

this Act, extendable to a maximum
period of two (2) years by the
Secretary.
Section 8, R.A 7719 (Non-profit
Operation)
● Blood banks and centers are not
intended to make a profit. They can
charge service fees, but these fees
are regulated by the Department
and should only cover the essential
costs associated with collecting
and processing blood.
● Blood collection is restricted to
healthy voluntary donors.
Section 9, R.A 7719 (Regulation of
Blood Services)
● Unlawful to establish and operate a
blood bank/center without
Department registration and
license.
● Emergency blood collection and
transfusion allowed in hospitals
without a license under specific
conditions set by the Department.
● Department grants or renews
licenses based on compliance with
prescribed standards.

Section 10, R.A 7719 (Importation of
Blood Bank Equipment, Blood Bags

blood banks, and hospitals active

Services Program.

rules set by the Secretary within 60

Section 12, R.A 7719 (Penalties)
● Upon complaint of any person and
after due notice and hearing, any
blood bank/center which shall
collect charges and fees than the
maximum prescribed by the
Department shall have its license
suspended or revoked by the
Secretary.
CONCLUDING PROVISIONS
Section 13, R.A 7719 (Separability
Clause)
● If any provisions of this Act are
declared invalid, the other
provisions hereof not affected
thereby shall remain in force and
effect.
Section 14, R.A 7719 (Repealing
Clause)
● This Act shall supersede Republic
Act No. 1517 entitled "Blood Bank
MTLBE
Act." The provisions of any law,
executive order, presidential
decree or other issuances
inconsistent with this Act are
hereby repealed or modified
accordingly.
Administrative Order No. 09, s. 1995
● known as the "Rules and
Regulations Implementing R.A.
7719"
● (also known as National Blood
Services Act of 1994), took effect
on May 12, 1995. It consists of
nine chapters.
Chapter 1
● covers the designated name of the
Order, scope, and definitions of
terms.
Chapter 2
● "National Voluntary Blood Services
Program deals with the
composition and functions of the
Blood Program Committee
including the field representatives
of the national Committee and the
DOH program management.

● covers voluntary blood donation
and the composition, function,
training, and technical assistance
of the program.
● It also includes the program's
promotion in schools, communities,
and professional education, in
which the Professional Regulation
Commission (PRC), professional
organizations, and associations are
required to participate and play
their roles.
Chapter 4
● discusses the abolishment of blood
services and networking involving
blood donor recruitment.
Chapter 5
● lays down the provisions on
upgrading the services and
facilities through the monitoring
and evaluation of subcommittees
by defining first their compositions
and functions.

national, regional, provincial, and
district hospitals are also covered.
● It also presents the policies for
blood bank service centers,
including the licensing of private
and government hospitals with
special mention to the monitoring
of blood bank centers with special
functions.
● The Philippine National Red Cross
is also assisted by the Department
of Health in providing blood bank
services and upgrading its services
and establishing linkages with
private and government hospitals.
Chapter 6
● provides options to commercial
blood banks, although a policy of
phasing out commercial blood
banks had been made, to solely
clinical laboratories for the purpose
of security of tenure of the
personnel.
Chapter 7
● is concerned with the provisions of
a nonprofit operation of blood bank
services, but service fees may be

charged in accordance with what
has been prescribed by the
department.
Chapter 8
● contains provisions on blood bank
services including the facilities,
creation of blood bank centers,
categories of blood bank service
capabilities, blood collection units,
and blood stations.
● Included in this chapter are the

personnel, and recording,
reporting, and documentation

● presents the provisions on the
importation of blood bank service

Administrative Order No. 17, s. 1998
R.A. 7719
● is an amendment of
Administrative Order No. 09, s.
1995.
● Such amendment pertains only to
the issuance of cellular phones and
pagers to qualified personnel such
as the DOH Central Office and
coordinators of the program.
● All monthly rental fees arising from
the use of cellular phones and
pagers are chargeable to the
program.
Administrative Order No. 2005-002
● contains rules and regulations
amending pertinent provisions of
Administrative Order No. 09, s.
1995. It consists of 24 sections.
