FIXATION OF SENIORITY

Name of the Guidelines: Guidelines for fixation of seniority and matters connected
thereto. Vide No. A-23020/1/2019-P&AR (GSW) Dt. 13.12.2019

1. PROCEDURE FOR FIXATION : Prescribed format be used containing-


Name, DoB, Date of Superannuation, Date of first entry, Date of joining the
present grade, Educational Qualification (if necessary as per RR) Remarks
Column (if required)
• Provisional list be circulated to all concerned official first
• 7 – 45 days to be given to GS for making representation
• If complaints are considered valid, final list may deviate from provisional list
• Final seniority shall be issued and duly authenticated by officer not below the
rank of Under Secretary in Secretariat / Dy. Director in Directorate
• To be fixed in grade-wise in any circumstance
• To be updated regularly by deleting those who had left the service for any
reason. In such case, no need to circulate provisional list.
2. SENIORITY OF DIRECT RECRUITS
Relative seniority of all direct recruits is determined by the order of merit in which
they are selected by the selecting authority viz. MPSC, MSSSB, DPC issued by the
Govt. from time to time

3. SENIORITY OF PROMOTEES
# In Selection & Non-selection method, seniority of officer assessed as ‘fit’ in the
promoted grade shall be the same as in the feeder grade.
# A person considered as ‘unfit’ for promotion and is superseded by a junior, but
promoted later, shall not supersede the persons promoted before him.
i.e Persons appointed as a result of an earlier selection shall be senior to those
appointed as a result of subsequent selection.

5. Where promotions are to be made from more than one grades and
separate quota is made as per RR-
Separate seniority list shall be prepared in the order of their seniority in the grade.
Promotion shall be made from each grade in the order of their seniority in the
respective grade as per quota prescribed.
6. Where promotions are to be made from more than one grades and no
separate quota is made in the R/R

Combined seniority list shall be drawn as far as possible. If separate


seniority list is drawn, the following parameters shall be applied:-
Date of completion of the qualifying service prescribed in the relevant RRs,
in the feeder grade for promotion.
b) If the aforesaid date is same, then the date of completion of the
qualifying service in the feeder-to-feeder grade

7. RELATIVE SENIORITY OF DIRECT RECRUITS AND PROMOTEES:
The relative seniority of direct recruits and of promotees shall be
determined according to the rotation of vacancies between available direct
recruits and promotees. The rotation of vacancies in turn shall be based on
the quotas reserved for direct recruitment and promotion respectively in the
Recruitment Rules.

8. MAINTENANCE OF ROSTER WHEN R/R PRESCRIBED NEW QUOTA


A new roster will have to be started in the following cases:
1) From the date the recruitment rules are notified in the official Gazette
2) When there is an amendment to the recruitment rules which changes
the percentage allotted for the various methods of recruitment.

9. HOW TO DETERMINE SENIORITY OF ABSORBEES


1) Seniority of absorbees shall be determined in accordance with the order of
their selection for such absorption.
2) Where absorptions are affected against specific quotas prescribed in the
Recruitment Rules, their seniority vis-a-vis direct recruits or promotees
shall be fixed according to rotation of vacancies based on quotas.

10. ABSORPTION AFTER BEING ON DEPUTATION


1. When the Recruitment Rules later provide for “deputation/ absorption”, his
seniority shall be counted from the date of absorption.

11. HOW TO DETERMINE SENIORITY OF AN OFFICER UNDER SUSPENSION AND OF


OFFICERS AGAINST WHOM INQUIRIES ARE PENDING
1) If the incumbent is completely exonerated, he should be promoted in the
first vacancy that could be made available and his seniority in the higher
grade shall be fixed as if he had been promoted in accordance with his
position in the select list.
2) In such a case, the period during which any officer junior to the suspended
officer concerned was promoted to the higher grade should be reckoned
towards the minimum period of service prescribed for purpose of eligibility
for promotion to the higher grade.
12. HOW TO DETERMINE SENIORITY OF OFFICERS WHO HAVE BEEN RECOMMENDED
FOR PROMOTION BY A DPC DURING THE CURRENCY OF A PENALTY
1) He will be promoted only after the expiry of the penalty
2) Seniority would be fixed according to his position in the select list prepared
by the DPC

13. SENIORITY OF MERITORIOUS SPORTSPERSONS APPOINTED IN RELAXATION OF


RECRUITMENT RULES
1) If considered along with other candidates, seniority shall be determined in
the order in which they are placed in the panel for selection.
2) Sportspersons recruited by departments themselves shall be placed en bloc
junior to those who have been selected by MPSC / MSSSB
3) Sportsperson appointed to a higher post / grade by grant of out of turn
promotion in relaxation of statutory RR shall be placed at the bottom.

14. SENIORITY OF PERSONS APPOINTED ON COMPASSIONATE GROUND
Date of joining by a person appointed on compassionate grounds shall be
treated as the date of his/her regular appointment
They shall be placed at bottom of all the candidates appointed in that year
irrespective of the date of joining of the candidate on compassionate ground

15. SENIORITY OF WORK-CHARGED/ CONTRACT/ P.E UPON REGULAR APPOINTMENT


Seniority shall count from the date of appointment
Seniority shall be determined as per the order of merit recommended by the
DPC
Shall be treated as direct recruits
If the RR provide for different quotas, they will be placed against direct
recruitment quota.
