you are comfortable, should we begin? Also, sir, before you start, I just have one small request,
please be as detailed as possible. Thank you!
Client- Thank you, ma’am. I am a widower. My only son aged 20 years has been missing for
the past 2 months. I have contacted the Police Station at Model Town but to no avail. They
are not taking any action against the accused. I am going through a very tough time.
Tauseef (Attorney): I am sorry, sir. To assist you I would need to ask you a few tough questions:

1. When did your son go missing and was he involved in any illegal activities?
Client- On 30th August, I came back home around 9 pm after work and Ashish was nowhere
to be found. Ma’am, he had gotten involved in a drug racket. He told me about the
involvement of two individuals from our colony. They had threatened to kill him if he told
anyone about their business. The next day, he disappeared. I fear that they have abducted
my son. Or worse killed him.
2. Tauseef – I am sorry, sir. I cannot fathom the pain that you are suffering, let us not assume the
worst yet. What action did the police take when you contacted them?
Client- Ma’am, I believe that they are in cahoots with the abductor. I filed a complaint at the
P.S. but no FIR has been registered and the police have not taken any action.
3. Tauseef- Sir, do you have a copy of this complaint? And was it forwarded to the ACP/DCP?
Client: Yes ma’am, I do and it was forwarded.
Tauseef – Alright. This copy will come to our use. I would first require you to submit a copy of
this complaint. Further, the law has various mechanisms in place to ensure justice. In case of a
refusal to register an FIR by the police even after a complaint and continued inaction, the
aggrieved can file an application to the Magistrate u/s 156(3)Crpc r/w a complaint under
Section 200 CrPC. The Magistrate then directs the Police to file a status report, giving updates
about the progress of the case.
On a perusal of this report, if the Magistrate is of the opinion that the complaint discloses the
commission of a cognizable offence, he shall direct for the FIR to be registered. In this case, FIR
shall be registered u/s 364 (abduction), 367 (abducting to cause grievous hurt) & 506 (
criminal intimidation to cause death) of the IPC.
Please do not worry, Sir justice will be done. We will work together to find your son.
Client: Ma’am, what if the Magistrate refuses to take the required steps?
Tauseef: I am afraid in that case, we will have to file a writ of habeas corpus under Article 226 at
the Delhi HC to find your son. Don’t worry, sir. If you give me the go-ahead, I will draft the
required application in a few days and we can then proceed. Please let me know by tonight if you
wish to engage me and we can accordingly discuss the charges involved.
