Payweek Bonanza Lowest Price Guarantee Terms and Conditions.

The following campaign is organized by PGMALL Sdn. Bhd. ("PGMALL Malaysia", "we" or "our") and
is open to all registered and verified users of PGMALL Malaysia platform ("participant(s)", "user(s)"
"your" or "you"). This terms and conditions in relation to the Campaign ("Terms and Conditions")
shall be binding on you. Entry and participation in the Campaign shall be deemed an unconditional
acceptance by you of this Terms and Conditions, PGMALL Policies and Privacy Policies available at
PGMALL Malaysia platform.

2. Campaign : What is Payweek Bonanza Lowest Price Guaranteed?
Mechanism
If you have purchased an item with the “Lowest Price Guaranteed” label on
PGMALL and found a cheaper deal for the said item on the next largest online
shopping platform established and operating in Malaysia (“Shopee and
Lazada”) and targeting primarily customers based in Malaysia (“Compared
Platform”), PGMALL will refund the price differences to shoppers in form of C-
wallet. This campaign applies to items with the “Lowest Price Guaranteed”
label on PGMALL Malaysia platform during Payweek Bonanza only.
3. Campaign : Monthly Basis from 25th to 7th of every month.

4. Eligibility : Only users with registered and verified PGMALL account may enter the
campaign.
5. Entry : - You can claim for a refund of the price difference through a price
Procedure report to PGMALL Malaysia via QR code at the bottom page or at
https://forms.gle/wcj1fL7Ev9Vw69UQ9 (“Price Report”). Price Report
must be submitted to PGMALL Malaysia within the day of the date
payment made on item purchased.

- You can only submit 1 Price Report for every unique item per order ID.

- Price Report must be accompanied with a screenshot of the compared


platform deal with clear details of (i) type, (ii) description/specification
that include model, year and/or size; (iii) brand, (iv) colour and (v)
warranty scope of the item being reported.

- Item being reported for refund must be same (i) type, (ii)
description/specification that include model, year and/or size; (iii)
brand, (iv) colour and (v) warranty scope as that of the compared
platform’s deal. This include product bundles, where all the items in
the bundle being compared must be an exact match in same store.

- Item being reported must be in the exact same store and not fulfilled
by the platform.
- Used, preloved or/and counterfeit item are not qualified for this
campaign.

- Refund is only valid for fully paid item, any item purchased by the way
of instalment is not qualified.

- Refund of the price difference, given in C-wallet, will be made for the
valid claims on completed orders.

- Item reported on the compared platform must still be in stock (i.e.,


Not Sold Out) and remain available for purchase online at the lower
price at the time PGMALL Malaysia conduct a Price Check.

- Price Difference calculation will be as follows:

PGMALL price x Number of units

Compared Platform’s Price x number of units on compared platform

Note: Price Difference calculation is excluding shipping fee.

- Price difference excludes special promotions such as


Vouchers/Coupons, Cashback or Credit Card promos from the
compared platform.
- Price difference excludes stores or products are that fulfilled by the
platform.
- PGMALL Malaysia will review the Price Report and get back to shopper
within 7 working days of submission of the Price Report.
6. Decision : The decision of PGMALL Malaysia on all matters relating to the Campaign
(including without limitation, the selection process, the result of the campaign
and/or any resolutions made) is final and absolutely binding. Any letters,
enquiries, appeal, or protest will not be entertained. Shopper hereby agree
that no action will be taken against PGMALL Malaysia, or its affiliates and you
shall not make any oral or written complaints to the public in any form
whatsoever.
7. Refund : - C-wallet credit will be credited directly to your account within 14
working days upon successful Price Report. Maximum refund for a
successful Price Report will be RM100 per month.
- C-wallet credit awarded are non-transferable, non-refundable, and
non-exchangeable for cash or any other items.
- In the event a purchased is cancelled, or a refund issued, where such
purchased was through C-wallet awarded under this campaign, C-
wallet awarded will be deemed claimed by you.
- All refund is accepted entirely at you own risk and awarded by
PGMALL Malaysia and/or our sponsors without any warranty of any
kind express or implied. You shall execute a deed of release and
indemnity in a form prescribed by PGMALL Malaysia. If so required, to
receive the refund.
8. General : 1. You represent and warrant to PGMALL Malaysia that you have (i) met
Terms all the eligibility criteria; (ii) have the right, authority and power to
enter into the Campaign in accordance with this Terms and
Conditions; (iii) shall provide such proof as PGMALL Malaysia requires
and (iv) that all the statements (if any and if so required) made by you
to PGMALL Malaysia are true, correct, accurate and complete; and (v)
where applicable. at all times and whether in the course of his/her
performance in the Campaign or otherwise, the user is not allowed to
give any expression, demonstrate any support or associate
himself/herself in any way, whether verbally or otherwise, with any
cause. issue, movement or material which may be sensitive, anti-
establishment, critical or anti-government or which may be offensive,
cause disharmony or upset to any sector of the public or which may
jeopardize or prejudice PGMALL Malaysia in any way.

2. PGMALL Malaysia reserve the right to disqualify you and/or revoke the
refund (at any stage of the Campaign) if: (i) you are ineligible or do not
meet any of the eligibility criteria; (ii) you breach the Terms and
Conditions or other rules and regulations of the Campaign: and (iii) in
our sole determination, believe that you have attempted to
undermine the operation of the Campaign by fraud, cheating,
deception or conduct deemed unacceptable to PGMALL Malaysia. In
the event of a disqualification after the refund has been awarded,
PGMALL Malaysia reserve the right to demand for the return of the
refund or payment of its value from the ineligible or disqualified
participants. Whilst PGMALL Malaysia will endeavour to conduct
necessary verifications on the eligibility of participants, failure to
disqualify any ineligible participants shall not be deemed a breach by
PGMALL Malaysia.

3. PGMALL Malaysia reserves the right to vary, delete or add to any of


the terms and conditions of this Campaign at any time at its absolute
discretion without prior notice.

4. Liability and indemnity


I) PGMALL Malaysia will not be responsible for any loss, liability or
damages arising out of the Campaign participation and any technical
issues, including but not limited to server issues and/or poor internet
connection, leading to not being able to participate in the Campaign.
You hereby forever waive, release and discharge PGMALL Malaysia,
our agencies, sponsors and representatives from and against, any and
all liabilities, costs, loss, damages or expenses which you or any party
claiming through you hereafter may have arising out of participation
in the Campaign whether direct or indirectly. consequential or
foreseeable.
II) PGMALL Malaysia shall not be liable to perform any of our obligations
in respect of the Campaign and this Terms and Conditions in respect
of the Campaign where we are unable to do so as a result of
circumstances beyond our control and shall not be liable to
compensate you in any manner whatsoever in such circumstances.
III) You shall indemnify PGMALL Malaysia, our affiliates, agent and
sponsors from and against all liability. cost, loss or expenses suffered
thereby as a result of your breach of the warranties and undertakings
and any breach of this Terms and Conditions and/or the rules and
regulations of the Campaign.

6. For avoidance of doubt, nothing in this Campaign intends to prohibit
or prevent the participants from buying products on any other e-
commerce marketplace platforms in Malaysia. The entry of this
Campaign is on voluntary basis by the participants.
7. This Terms and Conditions shall be construed, governed and
interpreted in accordance with the laws of Malaysia.
9. Category Gold, Silver & Jewellery and E-ticket/Vouchers categories items are excluded
excluded from Payweek Bonanza Lowest Price Guarantee Campaign.
