CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and entered into this ___ day of July 2023, in Baguio City,
Philippines, by and between:

LIGAYA D. NGIPOL, of legal age, Filipino, and with residence at 151-A Munoz Drive, KM 4
Asin Rd. Baguio City hereinafter referred to as the LESSOR.
-AND-
KYLE GAVIN G. DIZON, of legal age, Filipino, with address at #02 Banahaw St. Sierra Vista
Castillejos, Zambales, Philippines hereinafter referred to as the LESSEE.

WITNESSETH; That

WHEREAS, the LESSOR is the owner of leased premises, a four-bedroom apartment


located at Purok 3, Munoz Drive, KM 4 Asin Rd, Baguio City;

WHEREAS, the LESSOR agrees to lease-out the property to the LESSEE and the LESSEE is
willing to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR leases
unto the LESSEE and the LESSEE hereby accepts from the LESSOR the LEASED premises, subject to
the following TERMS AND CONDITIONS:

1. PURPOSES: That premises hereby leased shall be used exclusively by the LESSEE for residential
purposes only and shall not be diverted to other uses.

2. LEASE PERIOD: This lease shall be for a period of ONE (1) YEAR commencing on July 4, 2023
and ending on July 4, 2024. This lease may be further extended upon mutual agreement by the
Parties; provided, that the LESSEE notifies the LESSOR of its intention to renew in writing thirty
(30) days prior to the expiration of the lease. Otherwise, this lease shall automatically terminate
on July 4, 2023.

3. RENTAL: The monthly rental rate shall be FIFTEEN THOUSAND PESOS ONLY (PHP 15,000.00),
net of any taxes, exclusive of payment of utilities such as water, electric and internet connection
of the above stated Lessee. All rental payments shall be payable to the LESSOR on or before the
4thth day of every month.

4. SECURITY DEPOSIT: That the LESSEE shall deposit to the LESSOR upon signing of this contract
and prior to move-in an amount equivalent to TWO (2) MONTHS rent or the sum of THIRTY
THOUSAND PESOS (PHP 30,000.00). The deposit shall be maintained to answer for any unpaid
charges for gas, water, electricity, Internet, and telephone incurred by the LESSEE, and damages to
the premises, with the exception of natural wear and tear. The amount, after due deduction
therefrom, should there any, shall be refunded to the LESSEE within 60 days from the complete
return of the premises. IT IS FURTHER UNDERSTOOD AND AGREED THAT ONLY ONE MONTH OF
THIS SECURITY DEPOSIT MAY BE USED AS PAYMENT FOR RENT BY THE LESSEE.
5. DEFAULT PAYMENT: In case of default by the LESSEE in the payment of the rent, the LESSOR at
its option may terminate this contract and eject the LESSEE. The LESSOR has the right to padlock
the premises when the LESSEE is in default of payment for one (1) month and may forfeit
whatever rental deposit or advances have been given by the LESSEE.

6. USE OF PREMISES:

a) GENERAL LIMITATION - No portion or area of the Leased Premises shall be used


for manufacturing or industrial purposes or such other similar establishments.
No illegal activities shall be allowed. Any illegal use or business by the LESSEE in
violation of this strict prohibition by the LESSOR shall make the LESSEE solely
responsible and likewise shall be held liable alone civilly and/or criminally;

b) DESIGNATED PURPOSE - The LESSEE shall use the leased premises specially for
residential purpose only, and shall not be devoted to any other kind of activities
without the consent in writing of the LESSOR; it being understood that should
the LESSEE make use of the Leased Premises for purposes other than herein
agreed upon, this contract be automatically terminated, at the option of the
LESSOR upon notice to the LESSEE;

c) USE OF SIGNAGE AND THE LIKE - The LESSEE shall not post, install, inscribe, paint,
display or show in any part of the Leased Premises any sign, name, mark, notice,
logo without the written consent of the LESSOR;

d) HAZARDOUS MATERIALS - The LESSEE shall not bring or store in the property any
inflammable or explosive goods, articles or materials which may expose the
property to, among others, fire or increase the fire hazard;

e) GARBAGE RECEPTACLES - The LESSEE shall provide himself/itself, at his/its own


cost and expense, with receptacles which city ordinances require to hold and
contain waste matter, garbage, and refuse, and shall deposit them within his/her
premises in accordance with the rules laid down by the LESSOR. It shall be the
LESSEE's responsibility to oversee the proper disposal of his/its waste matter,
garbage, and refuse in consonance with Presidential Decree No. 825. In case of
violation the reof, the LESSEE shall be solely liable civilly and/or criminally;

f) OBSTRUCTIONS - Whenever applicable, the sidewalks, entrances, exits, passages,


corridors, stairways of the building shall not be obstructed or used by the LESSEE
for any purpose other than for ingress and egress to and from the office or the
building;

g) HEAVY OBJECTS - The LESSOR reserves the right to prescribe or limit the weight
of any heavy safe, equipment or other articles, which may be placed in the
Leased Premises. The LESSOR shall also have the right to designate the position
or location for such heavy objects within the leased premises for reasons of
security and safety
7. COMPLIANCE WITH RULES AND REGULATIONS. The LESSEE shall comply with all
reasonable rules and safety regulations promulgated by the LESSOR including rules,
regulations, ordinances, laws and codes made by the duly constituted authorities of the
City or National Government arising from or regarding the use, occupancy, sanitation, and
safety of the Leased Premises. Failure to comply with any of the rules, regulations,
ordinances and laws as above-mentioned shall make the LESSEE solely responsible and
liable civilly and/or criminally.
6. MAINTENANCE AND REPAIRS: The LESSEE shall keep the LEASED PREMISES in clean and
sanitary condition and keep them, at all times, in very good condition. The LESSEE shall repair,
replace, or restore major or minor damages in the leased PREMISES arising from his fault or
negligence. Before moving in to the property, the LESSEE has inspected the PREMISES and found
the same to be in good and tenantable condition.

7. IMPROVEMENTS AND ALTERATIONS: The LESSEE shall not make any structural alteration,
addition or improvement on the leased PREMISES without the written consent of the LESSOR. Any
major alterations or improvements made or introduced by the LESSEE in the Leased Premises with
the written consent of the LESSOR shall upon termination or expiration of this Contract,
automatically inure to the benefit of the Leased Premises and become property of the LESSOR
without any obligation on the latter’s part to pay for its value or cost to the LESSEE.

8. FIRE HAZARD AND HAZARDOUS SUBSTANCE: The LESSEE shall not keep, deposit, or store in the
Leased Premises any hazardous or inflammable material or substance that might constitute a fire
hazard.

9. INSPECTION OF PREMISES: The LESSEE shall maintain the leased PREMISES in good and
tenantable condition. The LESSOR reserves the right, at reasonable times and with notice, to enter
and inspect the leased PREMISES.

10. SUBLEASE AND ASSIGNMENT OF RIGHTS: The LESSEE shall not assign, sell, or transfer his
leasehold rights to the leased PREMISES or any part thereof without the prior written consent of
the LESSOR.

11. INTERNET. The LESSEE shall bear the provision/installation of any internet lines and the
use of the same shall be at LESSEE'S expense and accountability.

12. UTILITIES/FACILITIES. All charges for water, electricity, telephone, etc. used by the LESSEE
shall be defrayed by or for the account of the LESSEE. Should the LESSEE decides to permanently
vacate the leased premise, the remaining balance for utilities shall be automatically deducted
from the deposit of the lessee.

13. GUARANTEED LEASE: This Lease Contract may not be terminated during the lease period. In
the event that the LESSEE terminates the Contract within the lease period and decides to move
out of the unit without proper notice or 30 days’ notice, the security deposit shall be forfeited in
favor of the LESSOR.Pre-termination of this Lease Contract by the LESSOR shall not entitle him to
refund of the 2-month Security Deposit.

14. EXPIRATION OF LEASE: The LESSEE, upon the expiration of this Lease Contract, shall amicably
surrender the leased PREMISES to the LESSOR, in the same condition in which it was received,
save what has been lost or impaired by the lapse of time, by ordinary wear and tear, or of a
fortuitous event.

15. BREACH OR DEFAULT: Should either party violate any of the terms and conditions of this Lease
Contract, the aggrieved party shall have the right to terminate this contract without prejudice to
any claim arising therefrom. However, before this provision shall take effect, the party guilty of
the violation shall be given 30 days to correct or make good the violation.

16. JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek judicial relief
against the other, the losing party shall pay an amount of One Hundred (100) % of the amount
claimed in the complaint as attorney's fees which shall in no case be less than P50,000.00 pesos in
addition to other cost and damages which the said party may be entitled to under the law.

17. This CONTRACT OF LEASE shall be valid and binding between the parties, their successors-in-
interest and assigns.

IN WITNESS WHEREOF, parties herein affixed their signatures on the ____th day of July 2023,
