HYDROGEN CYANIDE (FUMIGATION) ACT 1953

An Act to regulate the fumigation of premises and articles with hydrogen


cyanide; and for purpose connected with the matters aforesaid

[30th April 1953.]

Short title and 1. (1) This Act may be cited as the Hydrogen Cyanide (Fumigation)
application. Act 1953.

(2) This Act shall apply to West Malaysia only.


Interpretation 2. In this Act unless the context otherwise requires -

“West Malaysia” has the meaning assigned thereto in section 3 of the


Interpretation Act 1967, and includes the Federal Territory.

“Registrar” means any Registrar, Deputy Registrar Senior Assistant


Registrar or Assistant Registrar of the High Court;
Power to 3. (1) With a view to protecting persons from danger in connection
make with the fumigation of premises and articles (including any ship or vehicles)
regulations
with hydrogen cyanide, the Minister may make regulations with respect to
such fumigation and, without prejudice to the generality of the foregoing
provisions, the regulations may-

(a) regulate the manner in which the hydrogen cyanide is to


be generated and require the admixture therewith of any
substance;

(b) prohibit the carrying out of any such fumigation except


by or under the supervision of persons having such
training or experience as may be specified in the
regulations and by such number of persons as may be so
specified;

(c) prohibit the carrying out of an such fumigation except by


persons licensed to carry out the same;
(d) regulat ethe issue, suspension orcancellation of licenses
for the carrying out of any such fumigation and the terms
and conditions subject to which they may be issued and
the fees to be charged therefore;

(e) regulate the disposal of the residuesof any substances


used in fumigation;

(f) for the purpose of preventing injurious effects resulting


from such fumigation, impose temporary restrictions
upon the use of any premises or articles, and require such
test as may be specified in the regulations to be carried
out after such fumigation.

(2) Regulations made under this section shall not apply to any
such fumigation carried out in the open air

(3) If any person contravenes or fails to comply with any


regulation made under this section he shall, on conviction, be liable in
respect of each offence to a fine of five hundred ringgit.
Notice to be 4. (1) Whenever any accident which occasions loss of human life or
given of personal injury occurs as the result of the fumigation of any premises or
accidents
resulting from
article, the person by whom, or by whose agent, the fumigation was carried
fumigation. out shall forthwith send or cause to be sent to the Minister notice of the
accident and of the loss of human life or personal injury.

(2) Every such person as aforesaid who fails to comply with this
section shall, on conviction, be liable to a fine of two hundred ringgit.
Inquiry into 5. The minister may direct an inquiry to be made by such person as he
accidents may appoint into the cause of any accidents of which notice is required by
this Act to be given to the Minister, and where it appears to the Minister
either before or after the commencement of any such inquiry, that a more
formal investigation of the accidents and of the causes and circumstances
thereof, is expedient, he may by order direct a formal investigation to be
held, and with recpects to inquiries and investigations made or held under
this Act the following provisions shall have effects:

(a) the Minister may, by the same or any subsequent order,


appoint any person or persons possessing legal or special
knowledge toassist in holding a formal investigation, or
may direct such Magistrate or other person or persons as
may be named in the order to hold such an investigation
with the assistance of any assessor or assessors named in
the order;

(b) the persons holding any formal investigation (in this


section referred to as the court) shall hold it in open court
in such manner and under such conditions as they think
most effectual for ascertaining the causes and
circumstances of the accident, and for enabling them to
make the report in this section mentioned;

(c) the court shall have for the purpose of the investigation
all the powers of a Magistrate’s Court when acting as a
court in hearing information for offences against this Act,
and in addition the following powers, namely-

(i) they may enter and inspect any place or building


the entry or inspection whereof appears to them
requisite for the said purpose;

(ii) they may by summons under their hands require the


attendance of all such persons as they think fit to
call before them and examine for the said purpose,
and may for the said purpose require to be
furnished to them answers or returns to such
inquires as they think fit to make;

(iii) they may require the production of all books,


papers and documents which they consider
important for the said purpose;

(iv) they may administer an oath, and require any


person examined to make and sign a declaration of
the truth of the statements made by him in his
examination;

(d) persons attending as witnesses before the court shall be


allowed such expenses as would be allowed towitnesses
attending before the High Court, and id case of dispute as
to the amount to be allowed, the dispute shall be referred
by the court to the Registrar who, on request under the
hands of the members of the court, shall ascertain and
certify the proper amount of the expenses;

(e) if any person without reasonable excuse (proof whereof


shall lie on him) fails, after having had the expenses, if
any, to which he entitled tendered to him, to comply with
any summons or requisition of the court holding an
investigation under this Act, or prevents or impedes the
court in the execution of their duty, he shall, on
conviction, be liable to a fine of one hundred ringgit, or,
in the case of a failure to comply with a requisition for
furnishing any return or producing any document, to a
fine of one hundred ringgit, for every day on which the
failure occurs or continues;

(f) the person appointed to make an inquiry into any


accident and the court holding an investigation of any
accident under this section shall make a report to the
Minister stating the causes of the accident and all the
circumstances attending it, and containing any
observation thereon or on the evidence or on any matters
arising out of the inquiry or investigation which he or
they think right to include in the report, and the Minister
shall cause every report so made to him to be made
public in such manner as he think expedient.
Inquiry or 6. (1) Where a Magistrate holds an inquiry or inquest upon the body

Provided that, if the accident has not occasioned the death of
more than one person, and the Magistrate has sent to the Minister notice of
the time and place of holding the inquiry or inquest not less than forty-eight
hours before the time of the holding thereof, it shall not be imperative on
him to adjourn the inquiry or inquest in pursuance of this section if the
Magistrate think it unnecessary that he should do so.

(2) The Magistrate before adjournment may take evidence to


identify the body and may order the internment thereof.

(3) The Magistrate, at least four days before holding the adjourned
inquiry or inquest, shall send to the Minister notice in writing of the time and
place of holding the adjourned inquiry or inquest.

(4) A person appearing on behalf of the Minister shall be at liberty


at any such inquiry or inquest as aforesaid to examine any witness, subject
nevertheless to the order of the Magistrate on points of law.

(5) Where at any inquiry or inquest there is given evidence of any


neglect having caused or contributed to an accidents, the Magistrate shall, if
no person retained on behalfof the Minister is present at the inquiry or
inquest, send to the Minister notice in writing of the neglect.

Suatu Akta untuk mengawal pengasapan premis dan artikel dengan hidrogen
sianid; dan bagi maksud-maksud yang berkaitan dengan perkara-perkara
yang tersebut dahulu.

Tajuk ringkas 1. (1) Akta ini bolehlah dinamakan Akta Hidrogen Sianid
dan (Pengasapan) 1953.

(2) Akta ini terpakai di Malaysia Barat sahaja.


Tafsiran. 2. Dalam Akta ini melainkan jika konteksnya menghendaki makna yang
lain-

“Malaysia Barat” mempunyai erti yang diberi kepadanya dalam seksyen


3 Akta Tafsiran 1967, dan meliputi Wilayah Persekutuan;

“Pendaftar” ertinya mana-mana Pendaftar, Timbalan pendaftar,


Penolong Kanan Pendaftar atau Penolong Pendaftar Mahkamah Tinggi.
Kuasa 3. (1) Dengan maksud melindungi orang-orang daripada bahaya yang
membuat berkaitan dengan pengasapan premis dan artikel (meliputi mana-mana kapal
peraturan-
peraturan
atau kenderaan) dengan hydrogen sianid, Menteri boleh membuat peraturan-
peraturan berkenaan dengan pengasapan itu dan, tanpa menyentuh keluasan
makna peruntukan-peruntukan yang terdahulu, peraturan-peraturan itu boleh-

(a) mengawal cara bagaimana hidrogen sianid akan dijanakan


dan menghendaki percampuran apa-apa bahan dengannya;

(b) melarang menjalankan apa-apa pengasapan itu kecuali


dengan atau di bawah penyeliaan orang-orang yang
mempunyai latihan atau pengalaman seumpamanya
sebagaimana dinyatakan dalam peraturan-peraturan dan oleh
seberapa orang itu sebagaimana dinyatakan sedemikian;

(c) melarang menjalankan apa-apa pengasapan itu kecuali oleh


orang-orang yang dilesen untuk menjalankannya;

(d) mengawal pengeluaran, penggantungan atau pembatalan


lessen bagi menjalankan apa-apa pengasapan itu dan terma
dan syarat yang tertakluk kepadanya lessen itu boleh
dikeluarkan dan fee yang akan dikenakan bagi maksud itu;

(e) mengawal pelupusan residu apa-apa bahan yang digunakan


dalam pengasapan;

(f) bagi maksud mengegah kesan yang memudaratkan akibat


daripada pengasapan itu, mengenakan sekatan sementara ke
atas penggunaan mana-mana premis atau artikel, dan
menghendaki apa-apa ujian sebagaimana dinyatakan dalam
peraturan-peraturan yang akan dijalankan selepas
pengasapan itu.

(2) Peraturan-peraturan yang dibuat di bawah seksyen ini tidak


terpakai bagi apa-apa pengasapan sedemikian yang dijalankan di kawasan
terbuka.

(3) Jika mana0mana orang melanggar atau gagal mematuhi mana-


mana peraturan yang dibuat di bawah seksyen ini dia apabila disabitkan, boleh
dikenakan denda sebanyak lima ratus ringgit bagi tiap-tiap satu kesalahan.
Notis 4. (1) Apabila apa-apa kemalangan yang menyebabkan kehilangan
hendaklah nyawa manusia atau kecederaan diri berlaku akibat daripada pengasapan mana-
diberi
mengenai
mana premis atau artikel, orang atau ejennya, yang menjalankan pengasapan itu
kemalangan hendaklah dengan serta-merta menghantar atau mempastikan supaya dihantar
akibat kepada Menteri notis tentang kemalangan dan kehilangan nyawa manusia atau
daripada kecederaan diri itu.

(2) Tiap-tiap orang yang tersebut dulu yang gagal mematuhi seksyen
ini, apabila disabitkan, boleh dikenakan denda sebanyak dua ratus ringgit.
Menyiasat 5. Menteri boleh mengarahkan supata siasatan dubuat oelh orang yang
kemalangan dilantiknya mengenai sebab sesuatu kemalangan yang mana notis dikehendaki
oleh Akta ini supaya diberi kepada Menteri, dan jika didapati oleh Menteri
sama ada sebelum atau selepas bermulanya apa-apa siasatan sedemikian,
bahawa suatu penyiasatan lebih rasmi tentang kemalangan dan sebab-sebab dan
hal-keadaan kemalangan itu, adalah bermanafaat, dia boleh dengan perintah,
mengarahkan supaya suatu penyiasatan rasmi diadakan, dan berkenaan dengan
siasatan-siasatan dan penyiasatan-penyiasatan yang dibuat atau diadakan di
bawah Akta ini peruntukan-peruntukan berikut hendaklah berkuatkuasa:

(a) Menteri boleh, dengan perintah yang sama atau mana-mana


perintah selanjutnya, melantik seorang atau beberapa orang
yang mempunyai pengetahuan undang0undang atau khas
untuk membantu dalam menjalankan sesuatu penyiasatan
rasmi, atau boleh mengarahkan Majistret atau orang atau
orang-orang lain yang dinamakan dalam perintah itu supaya
menjalankan sesuatu penyiasatan sedemikian dengan
bantuan mana-mana pengapit atau pengapit-pengapit yang
dinamakan dalam perintah itu;

(b) orang-orang yang menjalankan apa-apa penyiasatan (dalam


seksyen ini disebut sebagai mahkamah) hendaklah
menjalankannya dalam mahkamah terbuka mengikut apa-
apa keadaan yang mereka fikirkan paling berkesan bagi
menentukan sebab-sebab dan hal-hal keadaan kemalangan
itu, dan bagi membolehkan mereka membuat laporan yang
disebut dalam seksyen ini;

(c) mahkamah itu hendaklah bagi maksud penyiasatan


mempunyai semua kuasa Mahkamah Mejistret apabila
bertindak sebagai mahkamah semasa mendengar maklumat
tentang kesalahan-kesalahan terhadap Akta ini, dan sebagai
tambahan mempunyai kuasa-kuasa berikut, iaitu-

(i) mereka boleh memasuki dan memeriksa mana-mana


tempat atau bangunan di mana kemasukan atau
pemeriksaannya didapati perlu oleh mereka bagi
maksud tersebut;

(ii) mereka boleh dengan saman yang ditandatangani oleh


mereka menghendaki kehadiran semua orang yang
mereka fikirkan patut untuk dipanggil supaya hadir di
hadapan mereka dan diperiksa bagi maksud tersebut,
dan boleh bagi maksud tersebut menghendaki supaya
diberi kepada mereka jawapan atau penyata kepada
siasatan itu sebagaimana mereka fikirkan patut dibuat;

(iii) mereka boleh menghendaki supaya dikemukakan


segala buku, kertas dan dokumen yang mereka anggap
mustahak bagi maksud tersebut;

(iv) mereka boleh mengendalikan sumpah, dan


menghendaki mana-mana orang yang diperiksa untuk
membuat dan menandatangani suatu akuan tentang
kebenaran penyataan yang dibuat olehnya dalam
pemeriksaan;

(d) orang-orang yang hadir sebagai saksi di hadapan mahkamah


hendaklah dibenarkan apa-apa perbelanjaan yang sepatutnya
dibenarkan kepada saksi-saksi yang hadir di hadapan
Mahkamah Tinggi, dan sekiranya ada pertikaian tentang
amaun yang akan dibenarkan, pertikaian itu hendaklah
dirujuk oleh mahkamah kepada Pendaftar yang, atas
permintaan dengan ditandatangani oleh anggota-anggota
mahkamah itu, hendaklah menentukan dan memperakui
amaun yang sesuai bagi perbelanjaan itu;

(e) jika mana-manan orang tanpa alasan yang munasabah (di


mana buktinya adalah terletak di atasnya) selepas dibayar
perbelanjaan kepadanya, jika ada, yang dia berhak, gagal
mematuhi apa-apa saman atau rekuisisi mahkamah yang
menjalankan sesuatu penyiasatan di bawah Akta ini, atau
mencegah atau menghalang mahkamah daripada
melaksanakan tugasnya, dia hendaklah, apabila disabitkan,
dikenakan denda sebanyak satu ratus ringgit, atau dalam hal
kegagalan untuk mematuhi sesuaru rekuisisi bagi memberi
apa-apa penyata atau mengemukakan apa-apa dokumen,
denda sebanyak satu ratus ringgit, bagi tiap-tiap hari di
mana kegagalan itu berlaku atau berterusan;

(f) orang yang dilantik untuk menyiasat suatu kemalangan dan


mahkamah yang menjalankan sesuatu penyiasatan mengenai
apa-apa kemalangan di bawah seksyen ini hendaklah
membuat laporan kepada Menteri dangan menyatakan
sebab-sebab kemalangan itu dan semua hal-keadaan
besertanya, dan mengandungi apa-apa pandangan ke atasnya
keterangan atau ke atas apa-apa perkara yang berbangkit
daripada siasatan atau penyiasatan yang dia atau mereka
fikirkan patut dimasukkan ke dalam laporan itu, dan Menteri
hendaklah menyebabkan tiap-tiap laporan yang dibuat
kepadanya itu supaya diberitahu umum mengikut apa-apa
cara yang difikirkan patut.
Siasatan atau 6. (1) Jika seseorang Majistret menjalankan sesuatu siasatan atau inkues

kemalangan melainkan mana-mana orang bagi pihak Menteri hadir untuk menyaksikan
prosiding itu;
Dengan syarat bahawa, jika kemalangan itu tidak menyebabkan
kematian lebih daripada seorang, dan Majistret telah menghantar kepada
Menteri notis tentang masa dan tempat mengadakan siasatan atau inkues itu
tidak kurang daripada empat puluh lapan jam sebelum masa siasatan atau
inkues itu diadakan, adakah tidak perlu baginya menangguhkan siasatan atau
inkues itu menurut seksyen ini jika Majistret fikirkan tidak perlu baginya untuk
berbuat demikian.

(2) Majistret boleh sebelum penangguhan, mengambil keterangan


bagi mengenali mayat itu dan boleh memerintahkan pengkebumiannya.

(3) Majistret hendaklah menghantar kepada Menteri notis bertulis


tentang masa dan tempat mengadakan siasatan atau inkues yang ditangguhkan
itu, sekurang-kurangnya empat hari sebelum siasatan atau inkues yang
ditangguhkan itu diadakan.

(4) Seseorang yang hadir bagi pihak Menteri adalah bebas untuk
memeriksa mana-mana saksi di mana-mana siasatan atau inkues yang tersebut
dulu, tertakluk walau bagaimanapun kepada perintah Majistret atas perkara
undang-undang.

(5) Jika mana-mana siasatan atau inkues keterangan telah diberi


tentang apa-apa pengabaian yang menyebabkan atau turut menyebabkan
sesuatu kemalangan, Majistret hendaklah, jika tiada seorang pun yang
berkhidmat bagi pihak Menteri hadir ketika siasatan atau inkues itu,
menghantar notis bertulis tentang pengabaian itu kepada Menteri.
Kuasa 7. Menteri boleh dengan perintah memakai peruntukan-peruntukan Akta
memakai Akta ini atau apa-apa peruntukan sebagaimana dinyatakan dalam perintah bagi
bagi
pengasapan
pengasapan dengan apa-apa bahan selain daripada hidrogen sianid dengan cara
dengan gas- yang sama seperti yang dipakai terhadap pengasapan dengan hydrogen sianid
gas lain. tertakluk kepada apa-apa penyesuaian, jika ada, sebagaimana perlu dengan
memberi pertimbangan terhadap jenis bahan tersebut.

THE HYDROGEN CYANIDE (FUMIGATION )


REGULATIONS, 1953

IN exercise of the powers conferred upon him by section 2 of the Hydrogen


Cyanide (Fumigation) Ordinance, 1953, the High Commissioner in Council
hereby makes the following Regulations:
Citation. 1. These Regulations may be cited as the Hydrogen Cyanide
(Fumigation) Regulations, 1953.
Interpretation. 2. In these Regulations-

“Director General of Health Services” means the officer for the


time being, carrying out the duties of Director General of Health Services,
Federation of Malaysia;

“fumigant” means hydrogen cyanide;

“fumigation” means the fumigation with hydrogen cyanide of any


premises or of any part thereof;

“Fumigation area” means the premises or any part thereof


undergoing fumigation;

“operator” means any person designated in writing by the


undertaker to be in charge of any carrying out of a fumigation and duly
licensed under these Regulations;

“premises” includes any building, vehicle, ship, aircraft or enclosed


space;

“risk area” means any part od a building, vehicle, ship, aircraft or


any other enclosed space into which there is any reson to apprehend that
the fumigant may penetrate from the fumigation area, and in any case
includes those parts of any building, vehicle, ship, aircraft or other enclosed
space which are less than twenty feet from the nearest boundary of any
fumigation area unless separated therefrom by a yard, street, or other open
space not less than ten feet in width or by a solid wall, or two adjoining
walls of a total thickness of not less than eighteen inches;

“undertaker” means any person who, under contract or otherwise,


undertakes the carrying out of a fumigation.
Duties of 3. (1) It shall be the duty of the undertaker-
undertaker
and of (a) to observe the requirements of Regulations 14(1) and
operator.
(2), 16, 17 and 19;

(b) to take such steps as may be necessary to enable the


operator to carry out the requirement of Regulations 15,
18, 21, 22 and 23; and;

(c) generally to exercise such supervision and take such


steps as are within his power to secure the due
observance of the regulations by those engaged by him
to carry out a fumigation.;

(2) It shall be the duty of the operator to secure that the


requirements of Regulations 15, 18, 21, 22 and 23 are complied with and of
all the persons employed in connection with the fumigation to co-operate
with the operator for that purpose.
Operators to 4. No undertaker shall carry out fumigation except by means of an
be licensed. operator duly licensed in accordance with the provisions of these
Regulations.
Application 5. Every application for a licence shall be made to the Director
for licence. General of Health Services in writing in form “A” in the Schedule hereto,
and shall be accompanied by a fee of one hundred ringgits.
Provided that where an application for a licence is made after the
first day of July in any year the fee shall be fifty ringgits.
Renewal of 6. Every application for renewal of a licence shall be made to the
licence. Director General of Health Services in writing in the form “B” in the
Schedule hereto, at east two months before the expiry of the current
licence, and shall be accompanied by a fee of one hundred ringgits.
Form of 7. Every licence issued by the Director General of Health Services
licence. shall be made in the form “C” in the Schedule hereto and shall unless
sooner cancelled or suspended remain in force until the 31st December next
following date of issue.
Refusal of 8. Where an application is refused, the fee accompanying the
licence. application shall be returned to the applicant.
Suspension 9. The Director General of Health Servicesmay in his discretion
and suspend for such period as he may think fit or cancel any licence at any
cancellation
of licences.

Qualifications 12. Every applicant shall-

licence (a) produce a certificate of a registered medical practitioner
showing that he is not suffering from any infirmity to render
his use of hydrogen cyanide for the purpose of fumigation
dangerous either to himself or to the public;

(b) undergo a further medical examination before a renewal of a


licence is granted or when required to do so by the Director
General of Health Services;

(c) furnish such particulars and pass such theoretical or practical


test as the Director General of Health Services may require to
satisfy himself that he is fit and proper to be granted a
licence; and

(d) have had not less than six months regular experience of
fumigating together with, in addition, twelve months regular
experience of fumigating one or both of the following,
namely, ships or buildings and shall be otherwise competent
for the purpose.
Register of 13. The Director General of Health Services shall keep or cause to be
persons to kept a register in which shall be entered the name, address and such other

operator in charge of the fumigation.

(2) The fumigation staff shall in all cases include two persons
both of whom shall be adequately trained in first aid.
Conditions for 15. No person shall commence to fumigate any premises until-
fumigation.
(a) he has by personal inspection ascertained that all portions of
the fumigation area and the risk area have been vacated;

(b) all fires and naked lights in the fumigation area have been
extinguished;
(c) all liquids and foods which are liable to absorb the fumigant
have been removed froim the fumigation area;

(d) all partical steps have been taken to seal all opening, cracks
or crevices so as to prevent the escape of the fumigant from
the fumigation area.
Notice of 16. (1) Every person intended to fumigate any premises shall at least
intended twenty-four hours before commencing such fumigation delicer a notice in
fumigation to

(a) in the case of a building or other enclosed space within


Municipal Limits – to the Municipal Health Officer;

(b) in the case of a building or other enclosed space outside

(c) in the case of a ship – to the Director of Marine and


Port Medical Officer of Health; and

(d) in the case of an aircraft – to the Director of Civil


Aviation and the Airport Medical Officer of Health.

(2) If such fumigation is not commenced within a reasonable


period after the time specified in the notice, no person shall commence
such fumigation unless he has again given the notice required by this
Regulation.

(3) Where in the caseof a ship or aircraft it is for any reason


impracticable to give the twenty-four hours notice as required by this
Regulation the Director General of Helath Services, the Director of Marine
or the Director of Civil Aviation may authorize a shorter period of notice.
Notice of 17. In addition to complying with the provisions of Regulation 16
intended every person intending to fumigate any premises shall, at least twenty-four
fumigation to

hereto, and one copy of such notice shall be signed by the person receiving
the notice and shall be retained by the person issuing the same.
Access to 18. A person fumigating any premises shall -

objectively testing the atmosphere.

(c) all residues of the materials used for fumigation have been
removed;

(d) all water taps have been turned on for at least one minute and
the water allowed to run to waste;

(e) all water closet cisterns have been emptied and the pans
adequately flushed;

(f) all other receptacles containing water or other liquid which is


liable to absorb hydrogen cyanide or gas arising therefrom
have been emptied; and

(g) all bedding, blankets, pillows, clothing, cushions and other


articles which are liable to absorb the hydrogen cyanide or
gas arising thereform have been well shaken or beaten or
aired until they are free from any dangerous concentration of
hydrogen cyanide or gas arising therefrom.
Operator’s 24. The operator shall keep a notebook in the form “G” in the Schedule
note-book hereto in which shall be entered the particulars prescribed in that form.
Such notebook shall be preserved in good condition and shall be produced
if required by the Director General of Health Services at any time within
the licence period.
Fumigation 25. Nothing in these Regulations shall apply to -
except from
Regulations. (a) fumigation carried out exclusively for agricultural or
horticultural purposes;

(b) fumigation of any premises which have been specially


constructed or adapted for the purpose of effecting the
fumigation of any article.
Notice of 26. In the event of the occurrence of any accident which occasions loss
accident of human life or personal injury as the result of the fumigation of any
premises, the operator shall immediately give notice thereof to the Director
General of Health Services.
