I.

NATURE OF ENGAMENT
I.1 Munus Real Estate Services Co. is a sales and marketing enterprise dealing primarily with real estate
products, rentals, brokerage, appraisal, and consulting services. The Marketing Partners’ engagement
with Munus Real Estate Services Co. is Co-Agency / Affiliate/ Co-Marketer in nature and has been
given the privilege to use its name in relation to the properties sold in behalf and should always
protect its reputation.
I.2 The engagement with Munus Real Estate Services Co., is independent in nature and does not
constitute an employer-employee relationship neither shall engagement be understood as rights to
own shares of stocks nor a presumption of a joint venture.

II. DURATION AND EFFECTIVITY


II.1 This contract is valid from _____________________________ until December 31, 2023.
II.2 This contract shall be automatically renewed for successive period, unless terminated by either party
by notice given in writing and received by the other party at least 30 days prior to expiration.
II.3 This agreement will take effect upon being signed by and affixed with the seal of the authorized
representative of the parties until the term of contract expires.

III. REQUIREMENTS AS A MARKETING PARTNERS


III.1 The Marketing Partners undertakes that he or she possesses and will continue to process the
continuing requirements, herein set forth below;
a. Attendance to the Munus Real Estate Services Co. New Agents Orientation;
b. Submission of Membership Application form duly signed by the sponsor, team leader and Munus
Real Estate Services Co;
c. Submission of the Transcript of Records or Diploma;
d. Submission of the NBI Clearance
e. Signed copy of the Product Knowledge Seminar attended.
f. PRC Brokers / Sales Person Accreditation
g. DSHUD Registration

IV. PROHIBITION OF DOUBLE AGENCY


No person shall be admitted as marketing partner of Munus Real Estate Services Co if the applicant is
either an inhouse agent of a developer or a member of another realty unless the person already resigned
with a proper proof of resignation from previous company.

V. DUTIES AND RESPONSIBILITIES OF A MARKETING PARTNER


The Marketing Partner understands and undertakes to abide by the following duties and responsibilities
as marketing partner.
V.1 To comply with all the requirements pertaining to his/her practice in real estate prescribed by the law;
V.2 To actively participate in trainings, seminars, events, and other activities for professional and self-
improvement;
V.3 To attend PKS and to be able to present proper information given in the seminars;
V.4 To be resourceful and self-initiated at all times to obtain accurate and updated information when it
comes to inquiries of clients pertaining to a project;
V.5 To help build the network by inviting qualified marketing partners and to guide them in complying
with their affiliation with the company, provide basic information about the business and to assist,
when needed in servicing clients.
V.6 To be honest and transparent in dealings with clients, colleagues in Munus Real Estate Services Co.
and to the real estate industry in general;
V.7 To solely use the Munus Real Estate Services Co. name for the business with which it is designated for.
Further to this, the member understands that he/she is prohibited to use the network, including its
database of members and contacts and other resources to recruit or to invite to network member to
sell products and/or services outside of what has been endorsed by Munus Real Estate Services Co.
V.8 To appropriately conduct himself with decency and respect when it comes to his/her demeanor and
language;
V.9 To observe proper dress code in doing business in the office, participation iin events, and in dealing
with clients.
V.10 To avoid and/or refrain from using the brand without the consent from Munus Real Estate Services
Co.

VI. SUSPENSION OF MARKETING PARTNER


A marketing partner who is subject to suspension must submit a written report explanation to Munus Real
Estate Services within five (5) days upon receipt of the notice to explain.

VII. DISAFFILIATION AS A MARKETING PARTNER


Any marketing partner may disaffiliate with Munus Real Estate Services Co at any time provided, notice is
given to the Management of Munus Real Estate Services Co. at least 30 days prior to the effectivity of the
disaffiliation by submitting a disaffiliation letter.

Munus Real Estate Services Co. reserves the right and the marketing partner allows Munus Real Estate
Services Co. to withhold, deduct or forfeit the marketing partner’s commission or collectibles for whatever
accountabilities he/she with Munus Real Estate Services Co upon the marketing partner’s disaffiliation.

VIII. COMMISSION RATES


A marketing partner can increase his commission level upon reaching a certain level of accumulated sales;

For other developers, aside from 8990 HDC projects, an increment of .5% to the existing rate of the
marketing partner if the rate is standard given by other developer.

NO RATE PROMOTION SHALL BE MADE WITHOUT THE FOLLOWING REQUIREMENTS;


a. PRC Accreditation
b. DHSUD Registration

IX. ADHERENCE TO ETHICAL STANDARDS


All marketing partners are expected to abide by or adhere to the ethical standards and
Practices of the real estate industry.

X. APPLICABLE LAW
This agreement and the interpretation of its terms shall be governed by and construed in accordance with
the Philippine laws and subject to the exclusive jurisdiction of the courts in Cebu City

XI. SUBMISSION TO COMPANY POLICY AND CODE OF CONDUCT


The marketing partner signifies that he/she voluntarily entered this agreement free from any external
force, threats or intimidation that may vitiate his/her consent.

All existing and future company regulations and policies are deemed incorporated in this contract.

Any subsequent amendments to the provisions of this contract, provided the same is with conformity of
Munus Real Estate Services, shall be deemed incorporated herein and shall automatically amend this
contract.

BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND IT AND ALL OF ITS
PROVISIONS AND I AM SINING VOLUNTARY.
