Authority to discipline
One aspect of discipline in education is the authority to discipline, which refers to
the power and responsibility of educators and school administrators to address
and manage student behavior. This authority is typically outlined in school
policies, codes of conduct, and state or district regulations, and it is meant to
provide a framework for educators to effectively manage student behavior while
upholding the rights and well-being of all students.

the authority to discipline in education is an important aspect of maintaining order


and structure within educational environments. It allows educators and
administrators to address behavioral issues and misconduct in a fair and
consistent manner, while also providing support and guidance to students who
may be struggling with behavioral challenges.

The authority to discipline in education is typically delegated to school


administrators, teachers, and other school staff who are responsible for
managing student behavior. These individuals are expected to adhere to
established school policies and procedures, while also using their professional
judgment to make decisions that are in the best interest of the students and the
school community as a whole.

It's important to note that the authority to discipline in education must be

being of individual students. This requires a thoughtful and careful approach to

When exercising the authority to discipline, educators and school administrators

Research has shown that overly punitive disciplinary measures can have
negative consequences for students, including contributing to disengagement
from school, increased risk of academic failure, and higher rates of dropout. As
such, it's important for educators to consider alternative approaches to discipline,

learning initiatives, that prioritize prevention and support for students.

Ultimately, the authority to discipline in education is an important aspect of


maintaining a safe and supportive learning environment for all students. When
exercised responsibly and with consideration for the well-being of students, it can
help to foster a positive school climate where students can learn and grow to their
full potential.

SOURCE OF AUTHORITY

It's important to note that while educators and school administrators have the
authority to discipline students, this authority is not absolute. The exercise of
disciplinary measures must be conducted within the boundaries of the law and
with respect for the rights of students. This includes ensuring that disciplinary
actions are proportionate to the misconduct, considering any mitigating factors,
and providing due process for students who are facing disciplinary
consequences.

Procedure in Learner Discipline

The School Head shall issue a Notice in writing to the learner through the
Parent/Guardian by personal service or any other means of service within 5 three
(3) working days from date of incident/report.

The Answer in writing of the learner with the assistance of the parents/guardian
must be submitted within three (3) working days from receipt on Notice.

A Notice of Conference with parents/guardian shall be issued within three (3)


working days from receipt of Answer.

The conference shall be before the School Head if it is a first minor offense;
otherwise, before the Child Protection Committee

The parties shall be given a chance to be heard.


The conference must be recorded through a minutes of conference duly signed
by all die parties and members present.

The Decision in writing shall be issued within 3 working days by the School
Head/Administrator.Reprimand shall be final and executory.

The Decision imposing a penalty of suspension is appealable to the SDS for


public schools. For private schools, exhaust administrative remedies available
within the school/institution, and the final decision of the private school is
appealable to the SDS. The appeal must be made within fifteen (15) days from
receipt of the Decision. The Decision of the SDS is executory.

In General Positive discipline begins with setting the longterm goals or impacts
that teachers want to have on their learner’s adult lives, and using everyday
situations and challenges as opportunities to teach life-long skills and values to
learners.
B. Therefore, it is emphasized that the Department has a zero tolerance policy for
any act of child abuse, exploitation, violence, discrimination, bullying and other
forms of abuse. the Teachers shall be deemed persons in authority when in the
discharge of lawful duties and responsibilities, and shall, therefore, be accorded
due respect and protection. Therefore, the school shall impose appropriate and
reasonable disciplinary measures in case of offenses or infractions of good
discipline.
