JUDICIARY

THE CHIEF JUSTICE OF UNITED OF REPUBLIC OF TANZANIA

1. INTRODUCTION

Ladies and gentlemen first of all I would like to thank God for bringing us all alive and
healthy today. I am happy to give me this opportunity to talk about the Advantage and Dis
advantages of computerization of the judiciary. I will try to explain as much as I can about this
topic and I am going to group it in different group it in different group accordingly:

2. STRUCTURE OF JUDICIARY OF TANZANIA

When we say about the structure of judiciary of Tanzania we mean that the judiciary is
formed by the various courts of judicature and is independent of the government. Tanzania
respects the constitutional principles of separation of powers and respect the role of law. The
judiciary in Tanzania is divided as follows the judiciary of Tanzania has four parts which the
court of Appeal of the united Republic of Tanzania, the High court of Mainland Tanzania and
Tanzania Zanzibar, Magistrates court, which are at two levels which are Resident Magistrate
courts and District courts and the primary court which are the lowest in the judicial structure.

3. THE NEED OF COMPUTERIZATION OF THE JUDICIARY.

Computerization is the key word in every department of life today. Enhance transparency
and accountability, reduces red tape and corruption in administration. Technological
development in the field of information and communication technology have made a turning
point in the history of human development it brought many changes in all fields of human
activity ICT has been advocated in the western countries for the last two or three decades this
scenario gained alarming thoughts to have technology combined in administration of justice.
The following are objective of computerization of the judiciary.

a) To improve public access to electronic services

b) To improve sharing of ICT sharing resources within public services
c) To improve electronic government advisory, technological support and consultancy
service.

4. COMPUTERIZATION OF MAGISTRATE COURTS AND PRIMARY COURTS.

We see that at high percentage computerization is mostly used in High court and court of
Appeal compared to the Magistrate court and primary court so the step should be taken to
implements computerization at the level of the trial court. So there should be a law that enforces
the application of the ICT in judicial system.

5. PROVISION OF INDIVIDUALIZE LAPTOP.

As we know that many judicial officers lack computers and they are not aware about using
them so the procurement of the hardware and software should start and as such as not only
software has been developed but also standardize software should be procured judiciary should
also provide to each of the judicial officers with laptops, printers individually and training
should be given to make them more experts on computers. This open window to the world at
large to have a broader vision in deciding a case in an effective manner.

6. LEGAL EDUCATION ON ICT

Here we see the need of legal education on ICT is needed in order to make judicial officers
to be aware about the use of computer. Imparting legal education is one of the noblest
professions the legal education involves something more that is to have economic social and
political aspects. The legal education is not only mean to generate good lawyers but it is
intended to have proper citizens for the future Nation, ICT helps in acquiring knowledge and
interact with the needy people by the students. The intervention of ICT has really made the
globe a village, what could not have even imagined could now be seen without much
difficulties.

7. ADVANTAGES AND DIS ADVANTAGES OF COMPUTERIZATION TO THE

JUDICIARY

a) Advantages

Computerization of the judiciary has got a lot of advantages in our daily life as I am going to
explain one after another.

7.1 It enables to link up all courts electronically; This may have led to the exchange of
information about cases in different courts, this enable a national chief justice to examine any
case record, whether or not the case file was physically at hand, it would enable statistics to be
quickly compiled about system wider case management trends

 7.2 It help to overcome the problem of errors being made in the court; This is when
the court should conduct all process by using the system of e-filling this is the system of
government agency electronically, so this will help to overcome the problems error that being
made in the courts.

7.3 Provide court with a tool that judge may use to research law and improve the
quality for their decision; A network of computers that judges may use will enable them to
access information produced by the court and also information that is available with Internet
and the advantage of implementing ICT can be used as the research tool.

7.4 increased efficiency; This means that the use of computer reduces paper work and
enabled faster processing of case

b) Dis advantages of computerization to the judiciary

7.5 News reports can be misleading and pre judicial; Journalist are only human and
are subject to error they may confuse facts or legal concept so this can be one among the dis
advantage of computerization.

7.6 Data privacy and security concerns; Here we talk about hacking systems due to the
expansion of technology people are aware with hacking of some systems so this brings some
difficulties to the courts may cause the risk of data breaches and un authorized access to
increase

7.7 Accessibility challenges; It is not every person can access digital platforms so this
become a challenge to those individuals who lack digital literacy skills also it is costly to
acquire it

8. CONLUSION

The information technology has paved its way and has made a firm inroad to the judicial field
of the country to the judicial field of the country so the government should focus on the
development of science and technology so as all could get legal education on how to use
computer because of its many advantages in our daily life
