2) Tecson vs SSS

FACTS

Lim Hoc, a member of SSS, designated Tecson as the beneficiary for his SSS claim. In the SSS Form
filed by him, he indicated his civil status as married but made no mention of other relatives. After the
death of Lim Hoc, Tecson claimed for the death benefits of Lim Hoc in his capacity as beneficiary, but
SSS denied payment of said benefits.

ISSUE

WON the designation of Tecson as the beneficiary of the deceased valid

RULING

The Court held the designation of Tecson as valid and SSS is ordered to pay the petitioner the monetary
claim. The provision of the law is plain and clear, that in case of death, the beneficiaries as recorded by
the employer shall be entitled to the benefits. Therefore, the court should not construe but only apply the
law. It is not the heirs of the employee whom should be given the benefits, but to the designated
beneficiary on the records. The Social Security System acts as a trustee for the contributions of the
employee and their employers and as such it is unjust for it to refuse payment to whom the employee
designated as his beneficiary.
