The migration services covered by this agreement will be provided by the principal and/or may be

delegated to other Agents that Migration AUS-NZ engages from time to time, including (but not
limited to) the agents listed above.
Administrative services may also be provided by other staff employed by Migration AUS-NZ. The
principal will properly supervise the work carried out by any staff working for Migration AUS-NZ.

DEFINITIONS
Throughout this agreement, ‘we’, ‘our’ and ‘us’ means Migration AUS-NZ and/or the Agent(s) listed above, whilst ‘you’
and ‘your’ refers to the Client(s) listed above.
‘The application’ means the application covered by this agreement.
‘The relevant authority’ means the authority to which the application is to be submitted for assessment. For
sponsorship, nomination and visa applications, this will be the DOHA (see below).
‘The DOHA’ means the Department of Home Affairs.

A. Service

You appoint us to represent you and to perform the services described below:

Scope of Service

Category: An exclusive contract for all Visa Applications and requirements needed

Scope of services start from Student visa, 485 Graduate Visa, Skills
Subclass:
Assessment, Any Worker visa, Possible Residency and Australian Citizenship

The services to be performed under this agreement include (but are not limited to):
• Visa eligibility assessment (this includes analysis of the applicable law and policy, and its
application to your particular circumstances and goals)
• Providing advice and assistance in relation to the information and documents required
to support your application
Nature of Service

• Preparing your application, including any necessary application forms and supporting
submissions
• Compiling your application in the required form for lodgement
• Lodging your application with the relevant authority for processing as soon as
practicable
• Monitoring the relevant authority’s processing of your application for up to 18 months
after the date of lodgement. This includes advising you of any requests and/or
communications received from the relevant authority and notifying you of that
authority’s final decision. This service is provided on a complimentary basis only.

The services to be performed under the agreement EXCLUDE:


• Services relating to reviews and appeals (unless elsewhere specified)
• Professional services required by changes in immigration law or policy after acceptance

• Any services required after the lodgement of your application, unless expressly included
above (i.e. any services other than monitoring your application’s progress and notifying
you of any requests or communications received). Should you require us to provide
further professional services after your application is lodged, another agreement must
be entered into and additional fees will apply.

We estimate that it may take several weeks to lodge your application, with the time taken largely
dependent on when you provide the necessary supporting information and documents.
The timeframe for a decision regarding your application is dependent upon the relevant
authority’s processing time service standards for this matter. Please note that the actual time

that it takes to process your application may also vary depending upon a number of other
factors, including the complexity of your case, perceived risk factors and processing priorities.
Should your matter exceed the stated processing standards, we will contact the relevant
authority in order to bring your matter to its attention, and facilitate processing.
Please note that we have no control over processing timeframes, and that we cannot guarantee
that your application will be approved or decided by a certain date.

B. Fees

1. Migration AUS-NZ Retainer Fee Estimate

Our services are designed around fixed prices, as opposed to hourly rates, and offer you access to the
accumulated wisdom of our firm’s experienced Agents. For the price set out in the Fee Estimate below we
will complete the work defined under the Scope of Service.

NOTES
Payment of DOHA Charges & Other Costs
The fees listed above do NOT include the DOHA’s charges and any other costs associated with your
application, which are described in clauses 2 and 3 on the following pages. These additional charges and
costs must be paid on request, as they fall due.
Secondary & Dependent Applicants
Our fixed price quote represents our standard fee for a sole applicant. Should you opt to include any
dependent family members (e.g. spouse, de facto partner, child) in your application, additional fees MAY
be charged at the rate of $1000 + GST for each dependent applicant. This fee reflects the additional work
required on our part where family members are included in an application.
Fee Estimate & Variation
Our professional fee is based on our estimate that it will take 5 hours to complete the work defined under
the Scope of Service. This fixed fee entitles you to unlimited consultation with us in relation to the matters
covered by the Scope of Service. If your question or issue requires further research and analysis beyond
these matters, or should an additional service be required (for example, responding to a request by the
DOHA for further supporting information and/or documents following lodgement of the application), that
work will be subject to an additional price negotiation before the service is performed. In such cases, a new
invoice will be issued before delivery of the additional service, with payment terms agreed to by both
parties in advance.
In addition, should you delay the application, not provide information as required, unnecessarily and
continually have further queries, or request urgent preparation of your application over and above our
standard timeframe, we reserve the right to charge an additional fee over and above the fixed price. In this
event, we will provide you with a change order setting out the reasons for the additional fee.
Notice
We will give you written notice of any material change to the estimated fees as soon as we become aware
of the likelihood of a change occurring.

2. DOHA Charges2

The table below records the DOHA charges known to be associated with your application at this time. If
these charges increase (or any additional charges are added) AFTER this contract is signed, you must pay
the balance before the application is lodged. These charges are additional to the professional service fees
listed in clause 1 (see previous).

We may, at any time, withdraw money from your client account in order to pay these charges to the DOHA
on your behalf. We will give you reasonable written notice of the date by which any charges are required, as
well as written notice of each amount paid on your behalf.

The DOHA applies a surcharge to application charges paid by credit/debit card or PayPal. The surcharge is a
percentage of the total amount of application charges payable and is based on the payment method used.
The applicable surcharge for our payment method (Visa/Mastercard) is 1.40% of the relevant application charges. The
exact amount will be calculated at the time of lodging your application, and you will be asked to confirm the total
before paying the balance. Please note that the surcharge amount may be rounded to the nearest dollar, in
accordance with our payment policy.

The DOHA may require payment of this additional charge for any applicant who is in Australia when applying for this
visa and has previously applied for a temporary visa whilst in Australia. We will need to assess your visa application
history to determine whether or not you (or any family members included in your application) are required to pay this
charge.

3. Other Costs

The table below records the other costs that may be associated with your application, depending upon your
particular circumstances. If any further costs arise (or increase) after this contract is signed, you must pay
the balance before the application is lodged. These costs are additional to the professional service fees
and DOHA charges recorded in clauses 1 and 2 (see previous) and may attract GST.

We may, at any time, withdraw money from your client account in order to pay these costs to the relevant
external agency on your behalf. We will give you reasonable written notice of the date by which any costs
are required, as well as written notice of each amount paid on your behalf. In some cases, you may pay the
required cost directly to the provider at the time that the service is provided.

You will need to pay for overseas police clearances if these are required by the DOHA. These costs will vary depending
upon your particular circumstances.

You will need to pay for medical examinations, chest X-rays, blood tests and any other health checks required by the
DOHA as evidence of your ability to meet the relevant health requirements.

You must have adequate health insurance during the period of your stay in Australia, unless you are covered by
Medicare. The cost of your insurance will depend upon the provider and policy that you choose. We are able to provide
a DOHA with a template letter that contains details of the required level of coverage for your insurance policy, if
required.

English translations must be provided for all documents that are not in English. If any of your documents require
translation , this will incur an additional cost. Please note that all translations must be undertaken by a NAATI-
accredited translator, and that we can arrange this on your behalf.

If significant additional costs are incurred, such as international telephone calls, couriers and additional time spent
due to further client requirements, these will be billed at cost.

B. DOHA Charges & Other Costs


The DOHA charges and other costs listed in clauses 2 and 3 on the preceding pages are NOT included in
the above instalments, and must be paid on request, if and when they fall due.

NOTES
Clients’ Account
We will hold all fees paid in advance in our Clients’ Account. After we have completed each block of work
outlined above and issued an invoice that sets out the particulars of (and relevant fees for) each service
performed, we are entitled to withdraw the fees relating to that block from the Clients’ Account.
Interest & Other Benefits
Should any interest be earned on deposits and/or funds held on your behalf (including funds held in our
Clients’ Account), or should we accumulate ‘credit card points’ or similar benefits in paying fees, charges
and costs on your behalf, such interest and/or points will accrue to the benefit of Migration AUS-NZ. This
will offset the costs of holding your deposits and/or funds, making payments on your behalf and
administering, maintaining and operating the Clients’ Account (these costs include bank charges). You will
not be charged any additional accounting or service fees in recognition of this usage.

own time. I have also been offered the opportunity to have any matters contained therein explained or
clarified, as well as the opportunity to take independent advice prior to entering into this agreement.
I acknowledge that I am contractually bound by this agreement, and that I am personally liable for all
fees for services performed in accordance with this agreement.

The Client has been provided with pages 1 through to 8 of this agreement, as well as the ‘Migration AUS-
NZ Terms and Conditions of Service’ and has been given sufficient time to consider these documents.
The Client has been offered the opportunity to have any matters contained in these documents explained
or clarified, as well as the opportunity to take independent advice prior to entering into this agreement.
Migration AUS-NZ agrees to provide the services described in this agreement, in accordance with the
terms and conditions accepted by the Client.
