Subject – Indemnity for movement of containerised cargo to own nominated Container

Freight Station (“CFS”) for delivery from 01/01/2020 to 31/12/2020

We, ………………………, the consignee under the Bill of Lading (various) involving containers
(various) hereby request Maersk Line India Pvt. Ltd. to indicate DIRECT PORT DELIVERY
OR CFS’S AS PER ANNEXURE 1 as the case maybe in the IGM against production of all the
original bill of lading. In consideration of your complying with our above request, we
hereby agree as follows:

1) The contractual responsibility of Maersk Line India Pvt. Ltd. ends on delivery of the
Container to the customer’s representative from the Container Terminal and any
onward carriage from the Container Terminal to our own designated Container
Freight Station will be at our sole risk, expense and account.
2) All costs towards movement of the Container from the Container Terminal to the
above requested Container Freight Station including transportation, storage and
handling costs shall be borne by us without any liability/costs on Maersk Line India
Pvt. Ltd.

 3) Maersk Line India Pvt. Ltd. or its agents, contractors, sub-contractors hereafter are
neither liable nor responsible for the content of the Container/cargo once the
Container has been taken out from the Container Terminal.
4) In case of any damage or loss to the cargo after the movement of the container
from the Container Terminal, Maersk Line India Pvt. Ltd. shall not be held
responsible and we shall indemnify Maersk Line India Pvt. Ltd. in case of any
container damages/ third part liabilities arising due to incidents post movement of
the container from the Container Terminal till return of the empty container at the
company specified yard.
5) We shall indemnify Maersk Line India Pvt. Ltd. or its vessel or its agents against all
claims, liabilities, loss, damages, costs, delay, expenses which it may sustain as a
result or by reason of allowing our above request for movement of container/s to
the nominated Container Freight Station.
6) We shall indemnify Maersk Line India Private Limited against any and all claims,
liabilities, loss, damages, costs, delay, expenses which may arise in relation to
return of sound empty container/s within free days and we shall be solely
responsible for payment of all detention charges as per terms agreed with Maersk
Line A/s or its agents after expiry of free days.
