do here by solemnly affirm and state on oath as follows:-

That we Sri Gutti @Tekulapally Srinu & Sri Suniganthi @ Srikanth are the Deponents
herein and as such are well aware and well acquainted with facts, we along with 17 others
(list annexed) entered into agreement with Sri Kandhada Venkataiah and his family members
to buy Ac 16-21 gts in Survey no 135 and also Ac 03-27 gts in Survey no 138 Situated at
Pamana Village, Chevella Mandal, R.R. District., Sri Kandhada Venkataiah and his family
members have executed Agreement of sale-cum-General Power of Attorney vide document
bearing no. 4678/2018 dated 27/03/2018 in favor of Sri Gutti @Tekulapally Srinu S/o
Narsimulu Sri Suniganthi @ Srikanth S/o Narsimulu, only two names were included in
AGPA for ease and convenience, but infact all 19 members have equal share and claim in the
said lands

We submit that, originally Late Sri Kandhada Ramaiah was pattadar and peaceful
possessor of the land admeasuring Ac 16-21 gts in Survey no 135 and also Ac 03-27 gts in
Survey no 138 Situated at Pamana Village, Chevella Mandal, R.R. District.

We submit that, subsequently Late Sri P. Yellaiah and others illegally occupied the above
said lands and got entered their names in the revenue records. Being aggrieved by the same
Late Sri Kandhada Venkataiah approached the Joint Collector under ROR Act vide file in
Lr/D5/390/2004 and the collector, R.R. District had disposed of with the direction by way of
memo dated 06-05-2006 to approach competent civil court under Section – 8(2) of the A.P.
R.O.R Act.

We submit that, Sri Kandhada Venkataiah had filed a suit for the declaration of title and
also to declare the entries as null & void u/s 8(2) of A.P.P. ROR. Act and injunction as the
consequential relief vide O.S. No. 211 of 2006 on the file of Hon’ble Additional Senior Civil
Judge Court, at Chevella and same is pending adjudication.

We submit that, during the pendency of the above suit, Late Sri Kandhada Venkataiah
approached the us (deponents and 17 persons described below) to pursue the case and
requested them to pay some amounts to them. Then the We along with 17 persons described
below herein have requested Late Sri Kandhada Venkataiah and his family to sell the
property to them. In view of the pendency of the civil litigation, Late Sri Kandhada
Venkataiah and his family members have executed Agreement of sale-cum-General Power of
Attorney vide document bearing no. 4678/2018 dated 27/03/2018 in favor of Sri Gutti
@Tekulapally Srinu & Sri Suniganthi @ Srikanth. Then the amount pooled from us and 17
persons described below was used to make the part payment to the Late K. Venkataiah and
his family members and assured to give remaining payments according to the progress in the
cases.

We submit that, thereafter Smt Mamidi Manjula and others have filed a suit for
declaration and other reliefs against Late Sri Kandhada Venkataiah and others (Parties of the
First Part were also added as parties to the suit) vide O.S. No. 166 of 2018 before Hon’ble
Senior Civil Judge, at Vikarabad and the same transferred to Hon’ble Senior Civil Judge, at
Chevella and got renumbered as O.S. No. 73 of 2022 and the same is pending adjudication.
That Smt Mamidi Manjula have also filed a criminal case against the Sri Gutti @Tekulapally
Srinu & Sri Suniganthi @ Srikanth, thus the Sri Gutti @Tekulapally Srinu & Sri Suniganthi
@ Srikanth had incurred expenditure to clear get clearance from the said criminal case.

We submit that in view of the litigation the we and 17 persons described below have
engaged their counsel to pursue O.S. No. 211 of 2006 and O.S. No. 166 of 2018 (Now O.S.
No. 73 of 2022) and they have accepted to give 20% to him out of the amount or property
acquired or earned from the O.S. No. 211 of 2006 & 73 of 2022 after the litigation is
concluded.

We submit that, the we and 17 persons described below have jointly invested into the
said spending towards the litigation and other expenditures. In view of contribution from the
19 persons i.e we and 17 persons described below, there shall be 19 equal shares. As such,
they shall all the amount or the property acquired from the above litigation shall be
distributed equally into 19 equal shares after deducting all the expenses and expenditures
towards litigation, police cases and payments done to Late Kandhada Venkataiah family
members.
 We submit that, We acknowledge the contribution of the17 persons described below
towards the litigation and other payments are executing this UNDERTAKING Cum
DECLARATION OF ASSURANCE to honor the commitment of distributing 19 equal shares
to the 17 persons described below and ourselves and assure as below

We shall distribute the amounts or land acquired into19 equal shares amongst the 17
persons described below and ourselves after deducting all the expenses and payments towards
advocate fees, original owners and police cases or any unforeseen expenditure.

We assure that We have not entered any agreement, sale deeds or contracts or executed
any sought of documents whatsoever with any third parties in connection to the said lands

We hereby further assure that We(jointly or severally) shall not enter any sought of
contract or agreement or execute sale deeds to the third parties without the written consent of
17 persons described below

We further state under oath if We fail to act in the interest of the 17 persons described
below, and as per the discussions, directions and instructions 17 persons described below
with respect to schedule of properties covered under O.S. No. 211 of 2006 and O.S. No. 73 of
2022, any and all of 17 persons described below are at liberty to take legal action against us
(jointly or severally), and resort to other remedies as per law.

WE SHALL not act against the interest of the 17 persons described below and WE
SHALL not directly settle the matters with third parties without consent of 17 persons
described below

We Assure that they shall keep only two equal shares (i.e. one share each) with them out
of 19 equal shares and distribute all the shares as agreed and complete the above obligation
honestly and peacefully without any complications directly or indirectly. We shall give one
1/19 share to the each of the 17 persons described below.

allurement from any quarter whatsoever while in possession of sound health, sound state of
