AFFIDAVIT – CUM – DECLARATION

WE, Smt. Mansi Bothra nee Dhupia, PAN No. AQNPD4766B,

wife of Shreyans Bothra, daughter of Sri Manoj Dhupia, aged about

25 years, by Faith Hindu, by Nationality Indian, by Profession

Housewife presently residing at:- Merlin warden, Block 1, Flat 8d,

Ultadanga Main Road, AB Block, Sector-1, Ultadanga, PIN-700067

AND Sri Shreyans Bothra, PAN No. AQPPB0877P, son of Sri Anil

Kumar Bothra, aged about 25 years, by Faith Hindu, by Nationality

Indian, by Profession Business presently residing at:-

Space Town, Block 8, Flat No. 4D, VIP Road, Near Haldirams, PIN-

700052, do hereby solemnly affirm on oath and declare as follows:-

1. That we are bonafide citizens of India and have been residing at the

above mentioned Addresses respectively.

2. That we are married to each other according to Hindu Rites, Customs

and Rituals on 22/04/2015 and which is subsequently duly registered

according to the Hindu Marriage Act vide Marriage Registration

Certificate Serial No.83/15, in C. Book Page No. 1509, dated

11/07/2015.

3. That since the differences in taste, temperament, habit, education,

culture etc. has been increasing between us, in consequences

incompatibilities, conflicts gradually cropped-up and eventually

deteriorated our Normal Conjugal Life in spite of several attempts to

mitigate the same.

4. That the guardians, relatives and well-wishers of us have tried their

best to patch-up differences, but failed to do so. Now it is not possible

for us to resume our conjugal Life, peacefully and happily and there is

no chance to reunion between us as the Wife and the Husband, further.

5. That due to aforesaid inaptness of opinion we are living separately

since 02/08/2015, at our aforesaid respective place of residences and

no cohabitation has been done by us nor we lived together as husband

and wife

6. That we ultimately have comprehended that the marriage subsisting

between us has irretrievably broken down and regardless of which

every way there is no chance of leading our conjugal life. We both

further realized that we are totally ill-assorted to each other and there

 are irreconcilable differences between us in our respective ways of

living in the matter of our ethnicity, observation, and viewpoint and

the marriage between us is virtually and emotionally dead.

7. That we also agreed and came to a conclusion that we have no

objection to get married to any person of our choice after dissolution

of marriage by the Decree of Divorce.

8. That the Wife also submits that she undertakes that she will not claim

any maintenance, alimony or other legal rights against the Husband

and/or his family members in respect of movable or immovable

properties, in future after passing of the decree.

9. That before sign this Affidavit on oath, both the Husband and the Wife

has exchanged all of their articles, furniture, ornaments and

belongings and neither one have demand on the same upon each other

and we also submit that we have no claims and counter claims against

each other, against person or property either movable or immovable,

as we are self-sustainable.

10. That we both have agreed that neither of us shall be able to file any

petition / application suit for alimony/ maintenance, permanent

alimony against each other and all such future efforts if any is filed by

either of us will be treated as null and annulled

11. That we are executing this Affidavit-cum-Declaration without any

compulsion, fraud and / or undue influence and on volition of both of

us.

12. That we are swearing this for submitting the same, further before any

competent authority, if so required.
