e The statement of the witness Sanjay Kumar Mishra, is recorded through
Video Conferencing from the VC cabin remote point, Bhubaneswar, in
presence of Swatik Srichandan, the VC coordinator, Bhubaneswar after his
identity card i.e, off+icial Admission Card, bearing No.3229(S)/2021/Home
Dept. Govt. of Odisha was verified by designated coordinator named above
of the renmotepoint VC cabin Bhubaneswar and the identity card was also
shownshowntothis court through VC:

1. I was working as BDO of Seragada Block from 2006 to 2007. On 29.05.07

came to the block to conduct joint surprise check to detect misappropriation of
Govt. money caused by accused Panchanan Bisoyi, J.E and accused Ajay Kumar

Panda, A.E in connivance with accused contractor Santosh Kumar Sahu of

Seragada in execution of renovation work at Hatabandha "Ramagiri" of Seragada
block under the Mahabandha Scheme which was constructed under SGRY

(Special component) 2004-05.

2. At first the vigilance team verified case record no.227/2004-05, MB
No.391 and other connected documents. We visited the spot at Hatabandha
"Ramagiri" of Seragada block. Sri Maheswar Pradhan, J.E took measurement of
the work level wise. The depth of the pond could not be taken since it was tilled

with water. J.E Sri Pradhan prepared the detailed calculation sheet as per physical
verification, it was ascertained that there was discrepancy of about 3047.68 cum

of earth costing to Rs.94,500/- in excess as recorded in the concerned MB. All

officers and myself gave our signatures on the calculation sheet prepared by J.E

Sri Pradhan. In this connection Inspector Vigilance prepared a memorandum

consisting of 4 sheets in presence of us which is already marked as Ext.3 and

Ext.3/2 to Ext.3/4 are my signatures on each page of the memorandum and

Ext.3/5 is my signature (with objection) on the measurement sheet. The

memorandum was completed on 29.05.07 and before putting signatures, the

contents were read over to all present who admitted the same to be true and

correct.

preparation of memorandum and measurement sheet of the renovation work

of Hatabandha. It is also a fact that I had not received any complainant from
any quarter about non-payment of wages or about non-engagement.

4. The technical expert team measured the work regarding length and

breadth and took the depth by standing on the embankment. I don't

the exact measurement as it was taken since long. Normally payment has been

made on quantity of earth work excavated at the spot. The measurement was

taken of the embankment which was visible. It is a fact that technical

measurement was done nearly after 1 2 to 2 years of construction. It is also a

fact that in between the construction work executed and measurement done,
there were two rainy seasons passed. I had seen the estimate at the time of
preparation but I don't recollect the same now. The earth on the embankment

was already settled due to passage of time. It is not a fact that the technical
team had not measured the work
properly as it took nearly three hours. It is
not fact that
a
putting influence on me, the vigilance official had managed to
prepare the memorandum and the measurement sheet for the purpose of this

case.
