Harold Laski - “Rights are those conditions of social life
without which no man can seek, in general, to be himself
at his best”.

T. H. Green - “Right is a power claimed and recognized as


contributory to common good”.

Hobhouse - “Genuine rights are some conditions of social


welfare, and the various rights owe their validity to the
functions they perform in the harmonious development
of the society”.

In a more simple language - Rights are the claim of a


citizen which the society recognizes to be necessary for
his upliftment and the welfare of all, and is enforced by
the power of the state.
 instruments of happy life and development of
personality which must be morally acceptable.
 not merely a selfish claim of the individual but
also a claim of the society as a whole.
 they presuppose the existence of the society.
 need enforcement in case of infringement upon
it.
 changeable in nature.
 not a creation of the state; it only protects them.
 Every right has a corresponding duty.

 Rights which are based on the ethical sense of
morality and justice of the society are known as
moral rights. These rights are not enforced by
the state. That is why some people do not like to
call them right proper.

For e.g.
>to receive maintenance from the children is
recognized in Indian society as a moral right of
the parents. But if some ungrateful children
refused to maintain their parents, the state will
not compel them to do so.
 These rights are recognized and enforced by
the state.
 The state enforces these rights through law
and punishes those who infringe upon such
rights of others.

 Legal Rights are sub-divided into:


a) Civil Rights
b) Political Rights
Civil Rights
These rights are essential for a free and progressive life.
They concern the life and property of the individual.
Without these rights civilized life is impossible.

 iv) Right to contract

 v) Right to free movement

 vi) Right to free expression

 vii) Right to worship

 viii) Right to language and culture


Political Rights

 i) Right to vote

 ii) Right to be elected

 v) Right to criticize and discuss the government

 vi) Right to receive protection while staying abroad
