28) Tracing of Title:-

1) The security property is land measuring 1.25 Acres in S.No.171/6


at Palaiyampatti Village Aruppukottai Taluk more fully described above.

2) The land measuring 1.25 Acres in S.No.171/6 originally and


ancestrally belonged to Soundrapandiyan and Goplakrishnan even before
2003. The said Soundrapandiyan and Goplakrishnan had jointly executed a
registered sale deed dated 15.09.2003 in Doc.No.3692/2003 with respect to
the security property and some other property in favour of Manimaran for
valuable consideration (Doc.No.1). There after the said Manimaran had
executed a registered general power deed dated 11.10.2010 in
Doc.No.7227/2010 with respect to the security property in favour of his wife
namely Govindhammal (Doc.No.2). The said Govindhammal had
executed a registered sale deed dated 18.10.2010 in Doc.No.7227/2010 with
respect to the security property in favour of Mariyammal for valuable
consideration (Doc.No.3). After purchase the patta was also transferred to
the name Mariyammal. The 10(1) adangal, Cultivation adangal and Kist
receipt are all in the name of Mariyammal are produced as Doc.No.4 to 6.
The FMB Sketch for the security property is produced as Doc.No.7. which
help to identify/locate the security property. The title holder further states that
there is no lispendences or encumbrance over the security property. Hence the
said S.Mariyammal W/o. Sakkaraipandi are lawfully entitled to the security
property as absolute owners.

28A) Tracing of Possession:-


The applicant has produced the 10 (1) adangal, Cultivation Adangal
and Kist Receipt are produced as doc.No.4 to 6 to prove possession.
28B) Tracing of Encumbrance:-
The online Encumbrance dated 04.02.2024 for the security is for the
period from 01.01.1987 to 03.02.2024 issued by the SRO Sub Registrar,
Aruppukottta regarding the security property. The said certificate discloses
only the above document No.1 and 3 are discussed with above. Hence there
is no subsisting encumbrance over the security property upto 03.02.2024

CERTIFICATE
In view of the foregoing, I certify that the title deeds intended to be
deposited, relating to the property and offered as security by way of equitable
mortgage and the documents of title referred to above are perfect evidence of the
title and that if the said equitable mortgage is created in the manner required by
Law, it would satisfy the requirements of creation of equitable mortgage.
