TRUST DEED

This deed of Trust is made and execute at Jammu on this ____day of February 2024 by and between :

On behalf of the other members / office bearers of Trust.

Hereinafter called the Settlers/ Trustees which expression shall unless repugnant to the context of
meaning thereof, be deemed to include the trustees or trustee for the time being of these present and
the heirs, executors and administrator of any of the last surviving trustees and assignees.

Whereas, it is though for and unanimously decided by the trustees that a rust be created which shall be
known as "JAMIA MASJID SHARIEF DRABSHALLA" TEHSIL DRABSHALLA, DISTT. KISHTWAR, Jammu and
Kashmir U.T.

NOW THE TRUST DEED WITNESSES AS UNDER:

1. AIMS AND OBJECTIVES

I. To disseminate Islamic shariat and preaching of Prophet Mohammad (S.A.W.)
II. To run Religious and Social Mission.
III. To administer and manage the property both movable and immovable attached with the Jamia
Masjid Sharief Drabshalla
 IV. To maintain the record relating to income and expenditure of Masjid Sharief for the Trust and
religious purposes and for improvement, repairs and maintenance of the Jamia Masjid Sharief
Drabshalla aforementioned.
V. To work for peace, prosperity and brotherhood. community & religious
VI. To work for eradication of Social Evils.
2. HEADQUARTER:

The office of the Trust shall be in the premises of Jamia Masjid Sharief Drabshalla.

3. MEMBERSHIP OFGENERAL BODY OF THE TURST:

Any member of the age of 18 years or above who believes in Islam and agrees to abide by the
Bye-Laws of the Trust can seek membership of the General Body. However, the President of the
Trust shall reserve right to accept / reject the membership without assigning any reasons
thereof and in his absence this right will be exercised by the Managing Body through a
resolution to be passed by more than 50% of the members present at a meeting. The quorum of
the meeting shall not be less than 50% of the Managing Body.
I. Any Member who remains absent from meetings of the General body of the Trust
without sufficient cause shall loose membership.
II. Members cannot make any useful contribution to the Jamia Masjid Sharief
Drabshalla owning to ill health or advanced age or for any unavoidable reasons may
withdraw his name from the General Body by intimating his consent to the
Managing Committee addressed to the Secretary. Of the Trust shall be removed on
III. Any member/ office bearer the motion of no-confidence passed by 2/3 rd majority of
the enrolled members present at a meeting. However, in case of a member of the
Managing Committee, the removal shall be made by the President or in his absence
by the Secretary of the Trust. The quorum for the meeting shall not be less than 50%
of the Managing Committee.
IV. Any office bearer may tender his resignation from his post to to resign, he shall the
Secretary and if the Secretary intends address his resignation to the President. The
decision shall be by a majority of the votes of the Managing Body present at a
meeting. Members

The following will be the office bearers of the Managing Body:

I) President
II) Vice President
III) Secretary
IV) Secretary
V) Cashier
VI) Member
VII) Member

4. ELECTION PROCEDURE:
The election of the office bearers, shall be held once in three years. For the purpose of the electing the
office bearers, meeting of the General Body shall be held after a notice of, at least, fifteen days and a
decision shall be made by a majority of the Votes of the However, the number of the members present
at the meeting. Members to be present in such a meeting shall not be less than 50% of the enrolled
members. Besides, the President shall be fully authorized and competent to dissolve the body and direct
for holding of fresh election as per the procedure aforesaid at any time when the circumstances require
him to do so. In absence of President, this right shall be exercised by a majority of the office bearers of
the Trust.

i.The quorum for holding general election of office bearers of the Trust shall be, at least, 50% of the
enrolled members.

ii. The Casual Vacancy/ies occurring owing to resignation / removal / death etc. will be filled up by
passing a resolution by the general body with 2/3rd majority of the members present at the meeting
which shall not be less than 50% of the enrolled members.

Iii. The outgoing Trustees shall submit the Balance Sheet, all and Loss Accounts and other record
pertaining to Jamia Masjid Sharief Drabshalla Kishtwar for which the Trust has been created.

V. The President of the Trust shall nominate a Returning Officer for holding of fresh elections. However,
in absence of any such nomination, the Secretary himself may act as Returning Officer.

vi. Paid or honourary workers shall be engaged by the Trustees against the posts to be approved for
looking after the official Prayers in the Masjid or for looking after the Masjid Sharief and its properties.

5. FREQUENCY OF MEETINGS OF GENERAL BODY:

i) A meeting of the General Body must be held, at least, once in six months. The President is
empowered to time meeting at any call General Body so necessitated by emergency. The
quorum of General for a meeting shall be at least, 50% of its strength. However, the opinion
of the majority of the members present at a meeting shall always prevail.

ii) The General Body may also meet at the instance of, at least, 2/3rd members of General
Body.

iii) The members of the Trust shall be nominated by the President or in his absence, by the
Secretary of the Masjid Sharief. The Trust will consist not less than Besides, the five and
more than fifteen members. number of General Body shall comprise of not less than 25
members and no upper limit.

iv) The quorum for the meeting of the Managing Committee shall be at-least 2/3rd of its
strength.

v) The frequency of holding meetings of the Managing Committee will not be less than four in
a year. However, the President or in his absence, the Secretary of the Trust may hold
 meetings at an time to decide issues requiring urgent attention. decision of the members
present shall prevail. The

6. Duties and responsibilities of the Office Bearers of the Managing Committee:

1. President: He shall be responsible for the overall smooth functioning of the Trust and
shall preside over the meetings of both the General Body and the Managing Committee.
He shall also manage furnishing of a statement of funds and expenditure on each
activity by way of conducting Audit through Registered Auditor/s.

2. Vice President:

He shall be responsible for the overall smooth functioning of the Trust in absence of President of the
Trust and shall preside over the meetings of both the General Body and the Managing Committee. He
shall also manage furnishing of a statement of funds and expenditure on each activity by way of
conducting Audit through Registered Auditor/s.

3. Secretary:

Both the Secretaries shall be responsible for the upkeep of all correspondence received, correspondence
emanating and all other records of the Jamia Masjid Sharief Drabshalla Kishtwar. They will also record
the Meetings of both the General Body and the during Managing Committee and implement decisions
arrived these meetings.

4. Cashier/ Treasurer:

He will be responsible for the healthy management of funds, proper documentation relating thereto,
preparation of annual statement of accounts for presentation to the general body and annual audit of
accounts.

Further, the members shall assist the Executive Body / Office Bears in all matter of the Trust.

5. The Trust shall be purely a non-political be utilized nature and this platform shall not be
allowed to for activities other than the aims and objectives mentioned above. It shall be
the non-profitable Trust.

6. The area of application of the Trust shall be restricted to the limits of the Distt.
Kishtwar.
 7. The source of income of the Trust shall be the offerings from the general public and the
devotees and other donations made, if any, by the devotees.
8. The income of the Trust shall be deposited in the recognized Bank in the name of the
Trust and the Managing Committee as and when the shall draw the amount from the
bank same is required for bonafide utilization for the purpose for which the Trust has
been constituted. The account shall be operated by two Cashiers of the Trust.
9. Budged Estimates of Income and Expenditure shall be framed by the Management
Committee and presented to the General Body for necessary approval. The accounts
shall be get audited, at-lease, once in a year.

10. The Chairman or the Secretary may spend independently For all other Rs. 5000/=
( Rupees Five Thousands Only). of expenditures, exceeding the aforesaid limit, approval
Managing Committee shall be a must.

11. Each and every decision of the Executive Body/ General Masjid Sharief shall be Body/
Managing committee of the subject to approval of the Chairman as long as he is in
office.

12. The President, the Secretary shall be competent to sue or to be sued in the name of the
Trust with regard to the properties belonging to the Trust.

7. Amendments to Bye-Laws:

The General Body shall be competent to adopt new rules, add or amend or delete any of rules which will
be passed by 2/3rd majority of the members present at a meeting. The quorum for such meeting must
be at-least 50% of the Total Strength of the General Body.

8. Interpretation:

If any question arises relating to interpretation of these rules, it shall be referred to the President,
whose decision in the matter shall be final and binding.

9. Source of Funds:

The main source of funds of the Jamia Masjid Sharief Drabshalla shall be the Offerings, Donations from
the society, the record of which shall be properly maintained by the Management Committee of the
Masjid Sharief.

10. Savings;

The Savings of the Trust shall be property mainTWAR ed and financial made known to all the members
of the Trust annually transparency and accountability.
Notwithstanding anything contained in these rules, any step taken prior to the final adoption of these
rules shall be deemed to be valid and duly approved by the Committee.

IN WITNESSES WHEREOF, THE SETTLERS/ TRUSTEES HAVE PUT THEIR RESPECTIVE HANDS INTO THE
DEED IN PRESENCE OF THE BELOW OF 2022 AT NAMED WITNESSES ON THE ___ DAY OF
