Guangdong lies adjacent to both Hong Kong Special Administrative Region
(SAR) and Macao SAR. Since ancient times, Guangdong has been an important
trading port and a window for cultural exchange. Its open, inclusive and
pragmatic culture as well as the thousand-year long Lingnan culture are the
reasons why Guangdong has always been at the forefront of China’s reform
and opening up. In 2019, the GDP of Guangdong reached 10.77 trillion RMB. It is
home to Guangzhou and Shenzhen, two first-tier cities, and is one of the most
commercially active regions in China.

The development of the Guangdong-Hong Kong-Macao Greater Bay Area (the


GBA) is a major national strategy orchestrated, deployed and promoted by
President Xi Jinping. It constitutes a significant platform for China to extend its
reform and opening up, accelerate high-quality development, and engage in
international competition and cooperation at a higher level. The GBA boasts
a solid economic foundation, a sound industrial system, a dynamic innovative
economy, and strong drive, which makes it one of the most economically
dynamic, open and internationalized regions in China.

Giving full play to the growth drivers of the GBA and the endeavor to build
Shenzhen into a pilot demonstration area of socialism with Chinese character-
istics as well as other policies, the province is making a concerted effort to
achieve progress in both Guangzhou and Shenzhen as its duel cores. Last year
Guangdong saw 7.14 trillion RMB in foreign trade. Many Fortune Global 500
companies have set up branches in the province. With the implementation
of the Foreign Investment Law of the People's Republic of China, Guangdong
will strive to create a first-class business environment that is stable, fair,
transparent and predictable in order to meet the expectations of a growing
number of foreign investors, who are looking for broad markets, great potential
and bright prospects.

Profile

Overview
Located in the southernmost part of Chinese mainland, Guangdong borders
Fujian, Jiangxi, and Hunan provinces, and Guangxi Zhuang Autonomous Region
from east to west. It faces Hainan across the Qiongzhou Strait to the southwest.
The area of Guangdong is 179,700 km2, making up 1.87% of the national total.
Stretching for 4,114 km the province’s coastline is the nation’s longest. There
are 1,963 islands in Guangdong with a total area of 1513 km2 and a coastline of
2,378 km.

Guangdong belongs to the East Asian monsoon region, which is well endowed
with light, heat and water resources. The annual average temperature is 21.8℃
while the climate is warm and comfortable.

By the end of 2019, the province had a permanent resident population of 115.21
million.

Guangdong is one of the most developed provinces in China. In 2019, its


economic aggregate exceeded 10 trillion RMB for the first time, and its regional
GDP reached 10.76 trillion RMB, an increase of 6.2% over 2018. Retail sales
of consumer goods totaled 4.26 trillion RMB, an 8% increase over 2018. In
particular, the GBA, located at the forefront of China's opening up along the
coast and with the Pan-Pearl River Delta (PRD) Region as its vast hinterland for
development, plays an important role in the Belt and Road Initiative.

Guangdong has a dynamic open economy. In 2019 the province’s actual foreign
investment totaled 152.2 billion RMB, a year-on-year rise of 4.9%. 14,350 foreign
direct investment projects were launched, and direct investment from areas along
the Belt and Road reached 8.19 billion RMB, an increase of 123.8%.

In 2019, the value of imports and exports surpassed 7.14 trillion RMB, with
imports of 2.8 trillion RMB and exports of 4.34 trillion RMB, maintaining the
steady growth of recent years. Trade with areas along the Belt and Road
totalled 1.71 trillion RMB, an increase of 6.3%, and cross-border e-commerce
grew by 45.8% to 110 billion RMB.

Major achievements

Coordination mechanism and implementation system

The Provincial Leading Group for the Promotion of GBA Development and
six specialized groups including the Infrastructure Connectivity Group have
been established to strengthen the overall coordination of development in
the GBA.
A series of provincial documents are issued to promote the GBA develop-
ment; provincial measures are introduced to support the GBA and
cooperate with the state in formulating special plans for infrastructure
connectivity, sci-tech innovation, cooperation, higher education, business,
finance and other fields.

Greater convenience in flow of factors in the GBA

Overseas (including Hong Kong, Macao and Taiwan) high-end professionals


and urgently-needed professionals working in the GBA can enjoy a pre-
ferential individual income tax policy.
Mutual recognition of professional qualifications is introduced between
Guangdong and the two SARs in six fields, including architecture.
Pilot projects are launched to facilitate trade and investment by speeding
up cross-border foreign exchange payment to less than 5 minutes.
The Guangdong-Macao Cooperation and Development Fund runs smoothly,
and 14.2 billion RMB has been invested to support 12 infrastructure and
projects for public well-being.
Direct release has been adopted for food originating in Hong Kong and
Macao.
The Single E-lock Scheme (SELS) for facilitating cross-border clearance
with Hong Kong has been fully implemented in the nine mainland cities.

Progress in building international sci-tech innovation hub

Comprehensive national science centers are established in the GBA, and


several large scientific devices have been put into operation or under
construction.
The GBA starts building new laboratories.
Guangdong issues regulations to help universities and research institutes
from Hong Kong and Macao participate in Guangdong's financial science
and technology plans.

Improvement of infrastructure to support transport network

Guangzhou-Shenzhen-Hong Kong High-speed Railway, Hong Kong-Zhuhai-


Macao Bridge (HZM Bridge), Nansha Bridge and Guangzhou-Shenzhen
Intercity Railway have opened to traffic; Shenzhen-Zhongshan Bridge,
Guangzhou-Zhanjiang High-speed Railway, Ganzhou-Shenzhen High-
speed Railway and Guangzhou-Shanwei-Shantou High-speed Railway are
under construction.

Macao vehicles with single license plates are allowed to enter Hengqin, and
application requirements for cross-border car quotas have been further
lowered.
The Huanggang Port renovation project has commenced; the Hengqin Port
Joint Inspection and Customs Clearance Building has been completed; the
Standing Committee of the NPC has authorized the jurisdiction of Macao's
port zone at Hengqin port and extended areas in Guangdong to the Macao SAR.

Measures to facilitate Hong Kong and Macao residents living on


Chinese mainland

The residence permit policy for Hong Kong and Macao residents has been
implemented, covering entry and exit endorsement, registered permanent
residence for talent, travel, and more.
The province has implemented the Administrative Measures for Public
Institutions in the GBA to Recruit Hong Kong and Macao Residents and the
Construction Plan for the Innovation and Entrepreneurship Base for Hong
Kong and Macao Youth.
The construction of Hong Kong University of Science and Technology
(Guangzhou) has commenced.
Hong Kong and Macao residents are allowed to select a number of
designated medical institutions and pay their medical expenses with Hong
Kong and Macao medical insurance.

Support Shenzhen pilot demonstration zone and Guangzhou to


inject new vitality into the ancient city

Guangdong issues a package of policies and measures to develop Shenzhen


Pilot Demonstration Zone, and establishes a special working mechanism.
202 administrative functions and powers have been delegated to Shenzhen
in areas such as urban construction and project approval.
Equal importance has been attached to Guangzhou's effort to inject new
vitality into the ancient city by promoting four features: comprehensive
urban functions, comprehensive strength of urban culture, knowledge-
based modern service industries, and a modern international business
environment. Guangzhou's plan for the initiative has been issued and
implemented, and key cooperation platforms, such as the Sino-Singapore
Guangzhou Knowledge City and Nansha Guangdong-Hong Kong Deep
Cooperation Park will be accelerated.

02 China (Guangdong) Pilot Free Trade Zone


(Guangdong FTZ)
Guangdong FTZ was formally approved by the State Council and established
on 31 December, 2014. After five years of development, it has become a regional
economic powerhouse with a high-standard legal environment and efficient
regulations that promote and facilitate trade and investment.

Guangzhou
Nansha New Area

Guangzhou Nansha New Area is committed to developing a more internation-


ally competitive business environment, promoting high quality development,
and advancing opening-up to a higher level. Making the most of its superb
location in the heart of the GBA and its rich port resources to connect with
Hong Kong and Macao and serve the mainland, it prioritizes strategic emerging
industries including shipping and logistics, advanced manufacturing, financial
service, tourism and healthcare. A series of landmark reforms have been
put in place here, including the Business Registration Confirmation System,
the global traceability system, and the Global Declaration Service System.
The approval of enterprise investment projects can be completed within 15
workdays from land acquisition to construction permit acquisition. Prior to any
land sale, the government will publish clear guidelines on how the land can be
used, along with any restrictions. All land use must be in accordance with these
guidelines. Construction can begin immediately on land transfer, and 70% of
relevant government business can be conducted online.

Shenzhen
Qianhai-Shekou Area

With an advantageous location, Qianhai, the only Shenzhen-Hong Kong


modern service industry cooperation zone, is in close proximity to two major
international airports and seaports - Hong Kong and Shenzhen. Being a
cooperation zone, pilot free trade zone and bonded port area all rolled into one,
it follows policies shared by all pilot free trade zones across the country, but
also has its own unique policies, thereby enjoying considerable comparative

advantages. 22 pilot policies in finance, fiscal taxation, law, human resources,


education, medical care and telecommunications have been approved. In
2019, the economy of Qianhai Cooperation Zone continued to grow rapidly.
In particular, the added value of the four leading industries (finance, modern
logistics, information services, and sci-tech services) accounted for 84% of the
total, creating a modern industrial system with finance as its core that features
a mature industrial structure, gathers high-end factors, and has a high degree
of economic activity.

Zhuhai
Hengqin New Area

Hengqin is looked up to as a domestic benchmark, which is characterized


by free and convenient international investment, innovation in international
trade, a business environment up to international standards, and unique
administration and rule of law. The area puts priority on sci-tech innovation,
modern financing, health care, tourism and exhibition, cross-border trade
and professional services. In areas such as customs clearance, tax, personnel,
talent recruiting, finance, informatization and other aspects, the area enjoys
preferential policies. For example, enterprises conforming to the Directory of
Enterprise Income Tax Preferential Treatments of Hengqin New Area are eligible
for a 15% reduction in enterprise income tax.

Advantageous Industries

Guangdong boasts a solid industrial foundation with complete supporting


facilities and a sound business environment, and has formed an industrial
configuration with Hong Kong and Macao in which advanced manufacturing
and modern service industries complement, promote and develop in sync with
each other. As an important manufacturing base and center of international
finance, shipping, trade, tourism and leisure, Guangdong continues to extend
supply-side structural reform and vigorously implement the innovation-

02 Modern Service Industry


Modern service industries are a priority for Guangdong's development blue-
print. In 2019, the province's industrial added value grew by 9.7% to 3.8 trillion
RMB. Within this figure revenues from strategic emerging services increased
by 13.5% and high-tech services by 14%. A massive number of cutting-edge
innovation-based enterprises lead the new sectors of the province's new
economy development.

Guangzhou artificial intelligence and digital economy


pilot zone

In 2020, Guangdong rolled out a blueprint to develop Guangzhou artificial


intelligence and digital economy pilot zone. The link would be the Pearl River,
and the pivot would be Pazhou. They form a spatial layout with three areas on
each side of the river over a total area of 81 km2, which comprises the Pazhou
Core Area (including Guangzhou Higher Education Mega Center), Guangzhou
International Finance Town Area and Yuzhu Area. By 2030, the pilot zone will
become a development hub for digital industry clusters, providing strong
support for the Digital Silk Road, and a global center for the development of
artificial intelligence and the digital economy.

03 Sci-tech Innovation Industry


Guangdong has created a vibrant innovation economy. Over the years, the
province has built innovation into its sci-tech system and talent development
mechanism, and made independent innovation a key prop to high-quality
development. Currently it has gathered more than 50,000 state-level high-
tech enterprises and four of the world's Top 100 universities, ranking first in
R&D investment and the number of effective invention patents nationwide.
The GBA, in particular, is one of the most innovative areas in China, which
has incubated the UAV, intelligent robotics, new display and other emerging
industries.

To develop an international sci-tech innovation center in the GBA

Guangdong is building a more flexible and efficient mechanism for


sci-tech cooperation, launching the action plan for sci-tech innova-
tion, building a major innovation platform and achievement transfor-
mation base, carrying out basic research and making break-
throughs in key and core technologies.

To encourage Hong Kong and Macao universities and research


institutions to participate in Guangdong's sci-tech projects

Provincial sci-tech planning projects will be open to Hong Kong


and Macao, and Hong Kong and Macao universities and research
institutions will get support to spearhead or independently apply
for provincial sci-tech planning projects.

To develop an innovative talent hub

Guangdong will implement a more favorable permanent residence


policy for talented people, and pilot a skilled labor immigration
system in nine cities in PRD to shorten the approval period for for-
eign talent to apply for permanent residence.

To speed up construction of provincial labs and new R&D institutes

Around 10 provincial labs will be built in key areas with national


labs as the benchmark. R&D institutes will be allowed to set up
mixed-ownership companies with diversified investment.

To accelerate development in high-tech zones

The coverage of state-level high-tech zones will be extended to all


cities, and more than 40 new provincial-level high-tech zones will
be built within three years.

To boost inclusive support for innovation in enterprises

There is a substantial package containing a whole range of diverse


support for R&D, including direct subsidies for R&D costs, indirect
support via subsidized R&D-related purchases, incentives for
award-winning R&D, direct government procurement of R&D
products, and tax breaks. For more details of the package, please

To increase support for transformation of sci-tech achievements

Guangdong will set up a support mechanism to attract national


projects to engage in extended research and industrial application
in Guangdong, and enable the implementation of more completed
national projects.

To promote in-depth integration between science and finance

Banks will be encouraged to provide tailored sci-tech credit services,


including set up investment subsidiaries to provide credit and loans to
sci-tech SMEs. The provincial finance department will compensate the
banks according to the actual value of loans provided.

To make land available for scientific research

Priority will be given to making land available for major sci-tech


projects. The province will coordinate the land use for new non-
profit sci-tech projects.

To better balance regional innovation and development

Guangdong will build a regional pattern with Guangzhou and


Shenzhen as the main engines and the PRD as the core, in which
the coastal economic belt and the northern ecological zone will
develop in a coordinated manner.

To boost integrity and ethics in scientific research

A sound scientific research integrity management system with


specific responsibilities and effective collaboration will be
established.

To intensify reform in the sci-tech field

Guangdong will adopt a new organization model that features


exclusive organizations, pairing-up support, incentives and more,
and take the lead in accepting applications from all over the
country to attract large institutions and teams.

Guangzhou-Shenzhen-Hong Kong-Macao Sci-tech


Innovation Corridor

The Corridor aims to build an economic belt that traverses Guangzhou,


Shenzhen, Dongguan, Huizhou, and cities on the west bank of the Pearl River
including Foshan, Zhongshan, Zhuhai and Jiangmen, and extends to Hong

the fast-track communication channel between the provincial leadership and

Foreign Investment Law


of the People's Republic of China

The promulgation of the Law is another move to further expand opening-


up and promote foreign investment. Under the Law the legitimate rights and
interests of foreign investors will be better protected, and the management of
foreign invested projects will be better regulated. The Law, which came into
force on 1 January, 2020, also serves as the basic law on foreign investment in
China, replacing three previous laws on foreign investment.

Ten Policies and Measures


for Foreign Investment in Guangdong

Preferential policies implemented in Guangdong have been effective in boosting investor


confidence. The revised version of Policies and Measures of Guangdong Province on Further
Expanding Opening-up and Actively Attracting Foreign Direct Investment (Ten Policies and
Measures for Foreign Investment) is one example, offering incentives for the use of foreign capital
as well as stronger support in land access and financing for foreign-invested projects.

Ten Policies and Measures for Foreign Investment (revised edition)

1. Expand areas of foreign investment market access

Wholly foreign-owned enterprises The province supports the establishment of wholly foreign-owned enterprises

mechanism, through which foreign-invested enterprises can apply for intellectual rights protection.

8. Improve investment and trade facilitation

The time required for setting up a foreign-invested company has been reduced to less than 5 working days.

The time required for import and export goods clearance has been reduced by a third.

9. Optimize the environment for foreign investment in key parks

Approval Qualified national development zones are authorized to implement one-seal management
examination and approval—a set of simplified procedures for administrative approval that enable
applications to be approved in one department.

Incentives With reference to the preferential income tax catalogue of enterprises in Qianhai in Shenzhen
and Hengqin in Zhuhai, the zones and the local authorities are encouraged to offer incentives for newly-
established foreign-invested projects within the state-level development zones assessed on the basis of
their direct economic contribution.

10. Improve the mechanism for foreign direct investment

Improvements have been made to the mechanism by which the provincial governor can make direct
contact with a multinational company in case of need.

A provincial joint conference on utilization of foreign capital has been established.

All policy commitments made to investors in accordance with the law are strictly fulfilled, and all
contracts and agreements signed as a result of promotions to attract foreign business to Guangdong
are fully respected and strictly implemented.

Complaint Mechanism

In order to respond to the complaints of foreign-invested enterprises and


investors quickly and effectively, and further improve the investment
environment of the province, in 2019 Guangdong revised the Measures
for Handling and Resolving Complaints Lodged by Foreign-invested
Enterprises.

The Measures apply to:

Lawfully established Sino-foreign joint ventures, Sino-foreign cooperative


enterprises and exclusively foreign-owned enterprises, and all relevant
Chinese and foreign investors: who believe that any government department
or any other unit or any staff member; has damaged the interests of their
enterprise; during the establishment, production, operation or termination
of the enterprise; and who has reported the issue pertinent to the authorities
responsible for handling such complaints; and who has requested that the
authority coordinates with them in addressing the issue.

A complaint will be accepted if it meets the following conditions:

The complainant can provide available ID, with clearly specified targets against
which the complaint is lodged, clear claims and supporting facts; and the
complaint falls under the remit of the authority with which the complaint is
lodged. Where any of materials are written in a foreign language, a Chinese
version shall be provided. Where a complainant entrusts another person, this
person will provide a power of attorney issued by the complainant.

The complaint will be handled in the following ways:

(1) Where a complaint is directly handled by the relevant authority, the


authority will issue an opinion on the complaint and reply to the complainant
within 15 working days of accepting the complaint;

(2) Where a complaint is referred by the relevant authority to another body for
handling, the other body will, within 15 working days of receipt of the complaint,
provide a written reply to the relevant authority. The relevant authority will reply
to the complainant within three working days of receiving this reply;

(3) Where more than one complainant lodges a complaint against the
same body in connection with the same matter, the complaints may be
consolidated. Where a complaint is lodged in connection with a matter that
involves a great number of departments and complex circumstances, the time
limit for handling the complaint may be extended by 30 working days.

01 Intellectual Property Protection


In 2019, Guangdong promulgated the Measures and Policies on IP Protection
and Exploitation for SMEs. It outlines a list of eight specific measures to
promote the protection and effective use of intellectual property among SMEs
in Guangdong province.

Measures for promoting the IP rights protection and utilization of SMEs


in Guangdong

1. Improving efficiency in IP dispute resolution


A faster trial process for civil IP cases and a better "one-stop" mechanism
tailored for SMEs have been established with quick response, confir-
mation and processing for handling IP disputes.

2. Increasing penalties for IP breaches


Tougher penalties and higher compensation will be imposed on those
who conducted repeated and malicious infringements. The "social
credit" system has been introduced, which archives violations of IP
rights in the credit records of enterprises and individuals involved.

3. Supporting IP protection abroad


IP protection will be strengthened abroad through such actions as
building information centers for IP protection services, and databases
of IP laws, cases and specialists, and facilitating the formation of IP
protection alliances and IP mutual aid funds abroad.

4. Promoting IP pledge financing


Mechanisms will be introduced, including a mechanism for risk sharing
and compensation, a mechanism for collateral allocation management,
a docking mechanism for enterprises and financial institutions, a
database of IP pledge financing cases and an evaluation system of IP
market value.

5. Facilitating IP trading
IP trading operations are encouraged to focus on providing custody,
development and storage services for SMEs, to develop new IP-related
services and products, and to improve the methods and the systems
for evaluating the expected future earnings of intellectual property.

6. Reducing the costs of IP creation and use


High-tech SMEs will be encouraged to focus their R&D efforts on strat-
egic emerging industries. They will be guided to team up with research
institutions, universities and colleges, and IP service agencies.

7. Enhancing IP-related services


Patent applicants and trademark registrants are encouraged to use
the online system. A special channel will be established to help SMEs
communicate with patent/trademark examiners more easily.

8. Training more IP professionals


Training programs will be tailor-made to cultivate high-level and versatile
professionals in IP related services, with substantial resources directed to
IP training bases, centers and colleges to support their development.

02 Incentives for Talent

"Guangdong Superior Talent Card"


The Ten Policies and Measures for Foreign Investment gives greater support in
servicing top talent for foreign-invested enterprises.

"Guangdong Superior Talent Card" provides convenience for 7 categories


of talent, including senior management personnel in foreign-invested
enterprises.
Cardholders and their spouses and minor children enjoy the same policies
as local residents in terms of house purchasing, education, health-care,
and pensions. Chinese cardholders and their spouses and minor children
can apply for entry permits to Hong Kong and Macao SARs and for other
entry-exit documents in Guangdong.
Guangdong rewards those cardholders who have made worthwhile
contributions to regional economic and social development.
Foreign cardholders can apply for a five-year work permit and a five-year
residence permit through a fast-track procedure taking less than half the
normal time. In addition, cardholders are eligible for priority treatment in
applying for a permanent residence ID.
Holders of permanent residence ID cards who start up technology
businesses in Guangdong enjoy the same support policies as Chinese
citizens.
Identified high-end talent can enjoy preferential services in entry and exit,
short and long-term residency, hiring foreigners as domestic help, etc.
High-end overseas returned talent working in foreign-funded R&D
institutions are eligible for senior titles. Guangdong will gradually introduce
six favorable exit-entry rules for high-end and urgently needed talent.

Tax Incentives

As the province pursues its industrial upgrading strategy of "Created in


Guangdong", more high-level professionals across the country and the
globe have accelerated the transformation of Guangdong's economy from
labor-intensive into innovation-driven. The Ministry of Finance and the State
Administration of Taxation issued a notice, granting Individual Income Tax (IIT)
exemption treatment for the subsidies of overseas talent working in the GBA.

Key points:

Municipal governments in the GBA will grant subsidies to residents for the
IIT paid exceeding 15% of taxable income. The subsidies are exempt from
individual income tax.
The amount of subsidy = the IIT paid - the taxable income×15%

returnees and overseas Chinese with long-term residency abroad;
b. Working in one of the nine cities within the PRD and paying taxes legally;
c. Compliance with laws and regulations, ethics and integrity of scientific
research.

The applicants shall fulfill at least one of the following criteria:


a. Candidates from major national, provincial and municipal projects who
have obtained "Guangdong Superior Talent Cards", the work permit for
foreigners (Category A), or a confirmation letter of overseas high-end talent,
and other high-end overseas talent recognized by the state, province, or
municipality.
b. Research team members from major state, provincial and municipal-
level innovation platforms, technical research team members from
institutions such as higher education institutions and hospitals, technical
and managerial talent who work or start businesses in key industries in

01 144-hour Visa-free Transit Policy for Foreigners


As of 1 May, 2019, travelers from 53 countries bound for a third country (region),
when holding valid international travel documents and joint trip tickets with
specific dates and seats information, are eligible for the visa-free transit policy

creating a fast customs clearance channel which is free of charge and

"Internet+Easy Customs Clearance" System


This innovative system allows enterprises to handle customs business through
the Internet on an "anytime, anywhere" basis. It includes self-service customs
declaration, classification and price evaluation in advance, interactive
inspection, and self-service tax payment.

"Smart Inspection Port" Information Supervision and


Service Platform
The platform enables enterprises to complete their customs declarations
online, achieving "zero-paper, zero-distance, zero-barrier, zero-threshold,
zero-fee and zero-time delay". It is widely used in cross-border e-commerce,
procurement, exports, and parallel automobile imports.

"Smart Maritime" Platform


With information including ship, crew, ship inspection, security check, shipping
company, etc., it provides a pre-declaration facility for ships entering and
leaving ports, inspection after customs clearance, zero waiting time, and
achieves immediate release of container ships and cruise liners.

International Trade "Single Window"


Covering 18 business functions, such as declaration of goods, means of
transport, cross-border e-commerce, logistics, etc., it connects 21 business

Global Import and Export Quality Traceability System


The system aims to ensure the closed-loop supervision of imports and
exports so that the source can be traced and the whereabouts can be
tracked. Guangdong will optimize the traceability function, which has covered

included food, consumer goods and automobiles. Guangdong will also build
a traceability center providing multifunctional and comprehensive services,

Convenient Investment

01 Establishment and Alteration of Foreign-funded


Enterprises

Applicants seeking to establish and register a foreign-funded enterprise should


log onto the relevant website (http://qykb.gdzwfw.gov.cn/qcdzhdj/). Through
the "Start a Business" module, they can provide the relevant information,
including confirmation that they meet the requirements of the Special Manage-
ment Measures on Foreign Investment Access (Negative List), and the industry
category and code.

Foreign-funded enterprises in China require an official company seal and an


agreement covering payment of taxes. Officially-approved invoices issued
by the authorities must be used for customer invoicing. The system allows
applicants to register their company seal, complete the administrative
requirements, and apply for official invoices. Users can also download the
operation manual which provides all the relevant information on establishing
an enterprise and foreign investment.

Reporting of foreign investment information

Foreign-funded enterprises established or altered after 1 January, 2020 need


only report their investment information in accordance with the Measures for the
Reporting of Foreign Investment Information and corresponding requirements.

Interconnection of Reports

The initial reports, alteration, cancellation and annual reports of


domestic enterprises invested by foreign-funded enterprises (including
multi-level investment) are shared by the State Administration for
Market Regulation and the Ministry of Commerce.

02 Foreign Exchange Administration


The Foreign Investment Law of the People's Republic of China has proposed
the following preferential policies for foreign investors:

A foreign investor may, in accordance with the law, freely transfer inward
and outward its contributions, profits, capital gains, income from asset
disposal, royalties of intellectual property rights, lawfully obtained
compensation or indemnity, income from liquidation and so on within the
territory of China in CNY or a foreign currency.
In company production and operations, foreign-funded enterprises must
conform to relevant provisions on labor protection and social insurance,
and handle tax, accounting, and foreign exchange in accordance with
relevant laws, administrative regulations and relevant provisions of the
PRC. They will be subject to the supervision and inspection conducted by
competent departments in accordance with the law.
For foreign investors investing in financial industries like banking,
securities and insurance, or manage any investment in such financial
markets as the securities and foreign exchange market within the territory
of China, where the State has other specific provisions, such provisions
shall prevail.
Foreign workers and workers from Hong Kong, Macao and Taiwan in
foreign-funded enterprises can freely transfer outward their wages and
other legitimate income in accordance with the law.

03 Preferential Tax Arrangements


China is the world's second largest destination of foreign direct investment.
China's Individual Income Tax Law (IIT Law) has been in effect since 1
January, 2019, and some preferential policies are also applicable to foreign
individuals working and living in China.

Residents

The standard of tax reduction is increased to 5,000RMB per month, and there
are specific deductible items. Accessing the specific additional tax deductions
and tax-exempt benefits at the same time for the same expenditure is not allowed.
Once taxpayer has opted for one alternative, that alternative will remain in force
until the end of the tax year, and cannot be changed until then.
Specific additional tax deductions include the cost of caring for the elderly,
children's education, continued education, medical expenses for serious
illness, housing loan interest/housing rent.
Tax-exempt benefits include: rental of accommodation, meals and laundry,
relocation, language training, children's education expenses, allowances for
business trips and family visits.

Non-residents

For non-residents, the new IIT tax rates will be applied to wages and salaries,
remuneration for freelancer services, authors' remuneration, and income from
royalties (the single new tax income category called "comprehensive income")
to compute individual income tax, and the basic standard deduction for the
wages and salaries income would be increased to 5,000
RMB per month for
all taxpayers. However, the current additional standard deduction is not
applicable to non-residents.

Note According to the IIT Law, a resident individual is an individual who is domiciled in
China or who is not domiciled in China but has stayed in the aggregate for 183
days or more of a tax year in China. A nonresident individual is an individual who is
neither domiciled in China nor stays in China, or who is not domiciled in China and
has stayed in the aggregate for less than 183 days of a tax year in China.

04 Labor and Social Security


More foreigners are working in China, many of whom have been working
and staying in China for a long time. They are concerned about social
security rights and interests during their employment in China. The
promulgation and implementation of Interim Measures for the Participation
of Foreigners Employed in China in Social Insurance provides a legal basis
for foreigners working in China to benefit from social insurance, and offers
more effective protection for their social insurance rights and interests.

Application Process
Foreigners working in Guangdong can apply through their employer to register for
social insurance coverage in the relevant hall of the local tax bureau. The following
documents are required:

1. Passport and Employment Permit (any one of the Foreign Employment


Permit, Foreign Expert Certificate, Press Card of Resident Foreign Journalist)
2. Passport and Foreign Residence Certificate
3. Foreigner's Permanent Residence Card
4. Declaration Form for Changes in Social Insurance Premiums (with
official seal of the company)

02 Education with International Standards

In the past 7 years, Guangdong's universities have educated over 7 million


talented specialists. Over 70% of new technical and skilled personnel come
from vocational institutes. The initial employment rate of college graduates
remains stable at about 95%, ranking among the best in China.
