ORMOC CITY

IMPLEMENTING RULES AND REGULATIONS


OF ORDINANCE NO. 021, SERIES OF 2018
ENTITLED “REVISED GENDER AND DEVELOPMENT CODE”

Pursuant to Section 95 of City Ordinance No. 021, Series of 2018, An


Ordinance Revising Ordinance No. 181 Series of 2013 entitled “Gender and
Development Code of Ormoc City” or the “Revised GAD Code”, the following
Rules and Regulations are hereby promulgated:

RULE I. GENERAL PROVISIONS

SECTION 1. TITLE– These Rules and Regulations shall be known and cited
as the Implementing Rules and Regulations of Ordinance No. 021, Series of
2018 otherwise known as the “Revised Gender and Development Code of
Ormoc City.”

SECTION 2. PURPOSE– These Rules and Regulations are hereby


promulgated to prescribe the procedures and guidelines for the
implementation of the Revised GAD Code in order to facilitate the
compliance therewith and to achieve the objectives thereof.

SECTION 3. CONSTRUCTION– These Rules and Regulations shall be


liberally construed in favor of women in order to promote the principles and
rights of women and to achieve the objectives of the Revised GAD CODE.

SECTION 4. COVERAGE– Implementation of these Rules and


Regulations shall be effected by all concerned entities, both private and
public, within the territorial jurisdiction of the City of Ormoc.

SECTION 5. DECLARATION OF PRINCIPLES AND POLICIES. The


Code is a concrete manifestation of the City Government’s strong adherence
to the time-honoured democratic tenet that men and women in a civil
society are equal. This significant initiative is aimed at mainstreaming
women’s concerns, ensure the fundamental equality before the law of
women and men, and create a wider arena for women’s active participatory
role in the development process.

It shall be the policy of the City Government of Ormoc to uphold the


equality of rights of women and men, believe in their worth and protect their
dignity as human beings.

Towards this end, the City Government of Ormoc shall be guided by the
following principles:

a) Women shall be recognized as equal partners of men in the


development of the city, sharing equally in the responsibilities and
enjoying equally the fruits thereof.

b) The City Government of Ormoc shall promote the development of
women's potentials towards the improvement of the quality of their
lives, their families and that of their communities.
c) The City Government of Ormoc, fully cognizant of women's efforts
towards empowerment and self-determination, shall vigorously
pursue and implement gender-responsive policies and programs,
design integrated gender and development support systems, and
implement measures to protect and promote the rights of women.
d) In order to reinvigorate what is already a strong national policy
framework on women and gender equality that serves as a strong
impetus for the further development of this Code, the City of Ormoc
shall ensure that the relevant ordinances on women and gender
equality are translated and fulfilled.
e) The City Government of Ormoc shall be progressive in addressing the
divergent needs of women.

To facilitate the development of the full potential of women, the


following rights, as defined under the United Nations Convention on the
Elimination of All Forms of Discrimination Against Women (CEDAW) and the
Magna Carta of Women are hereby declared and adopted under this
ordinance:

a) Women have the right to the prevention of, and protection from all
forms of violence and coercion against their person, their freedom,
their sexuality and their individuality;
b) Women have the right to freely and duly participate, individually or
collectively, in the political processes in their communities and
nation;
c) Women have the right to the means for assuring their economic
welfare and security;
d) Women have the right to the necessary knowledge and means for
the full exercise of their reproductive choice with the constitution and
their beliefs and preferences;
e) Women have the right to choose a spouse in accordance with the
law, their values and preferences, maintain equality in marriage or its
dissolution, and receive adequate support for rearing and caring of
their children;
f) Women have the right to an adequate, relevant and gender-fair
education throughout their lives, from childhood to adulthood;
g) Women have the fright to nurture their personhood, collectively and
individually, to secure an image of themselves as a whole and
valuable beings, to build relationships based on respect, trust and
mutuality;
h) Women have the right to equality before the law, in principle and in
practice. In reality, women should not be viewed as second class to
men but as partners of men in development.

The City Government shall also endeavour to attain the foregoing


principles and be guided by the following aims:

a) As mandated in the Special Provisions of the Annual General
Appropriations Act (GAA), the City shall allocate at least 5% of the
total LGU annual budget for the implementation of its annual Gender
and Development Plan that shall be formulated to address gender
concerns and issues and to support programs and activities for
women in accordance with the Women in Development and Nation-
Building Act and the Magna Carta of Women;
b) The City Government of Ormoc shall formulate a GAD Plan that
shall contribute to poverty alleviation, the economic empowerment of
women, the protection, promotion, and fulfilment of women's human
rights, gender-responsive governance, and the achievement of the
Sustainable Development Goals (SDGs) ;
c) The City Government of Ormoc shall ensure that women benefit
equally with men, and given equal opportunities to participate in
government programs, projects and activities, and are involved in
the development planning processes;
d) All government project proposals shall ascertain the inclusion of
gender-responsive indicators and guidelines as proposed by the
Philippine Commission on Women based on the Philippine
Development Plan for Women;
e)The City Government of Ormoc shall review and revise all its internal
policies, rules and regulations, circulars, issuances and procedures as
to their gender-responsiveness and to remove any gender biases;
f) The City Council for Women shall be actively consulted on matters
dealing with gender issues and concerns so as to ensure non-
discrimination and negative implications on women.

RULE II. DEFINITION OF TERMS

SECTION 6. DEFINITION OF TERMS - The following terms or phrases


used in this Implementing Rules and Regulations of the Revised GAD Code
shall mean as follows:

6.1 Battering – This refers to a series or sequence of acts or


deprivations constituting psychological/emotional and/or physical
abuse such as, but not limited to, repeated or habitual cyclic
patterns intended to cause intimidation of the victim and/or the
imposition of the batterer's will and control over the victim's life.
Consistent with R. A. 9262 or the Anti-Violence Against Women
and Their Children Act of 2004, battering shall also refer to any
act of inflicting physical harm upon the woman or her child
resulting to physical and psychological or emotional distress.

6.2 Child – Consistent with R. A. 9208 or the Anti-Trafficking in


Persons Act of 2003, this refers to a person below eighteen (18)
years of age or one who is over eighteen (18) but is unable to
fully take care of or protect himself/herself from abuse, neglect,
cruelty, exploitation, or discrimination because of a physical or
mental disability or condition.

6.3 Commodification of Persons – This refers to an activity or
practice wherein the participants or subjects thereof, regardless
of age, are put in an exploitative and subordinated situation
involving physical or sexually suggestive displays or exposition of
their bodies, and results in their maltreatment, without their
informed and free consent, with no power or control to reject
such utilization or manipulation. This includes any activity or form
of beauty contests, whether in whole or in part, integrated in any
raffle draw, benefit or disclosure, premier showing of movies, or
any similar fund raising undertaking where persons are used as
incentives, prizes, substitute for cash prizes won, a companion
package for an award prize or recognition or any activity,
come- on display or exhibits which depicts such persons as
central, partial or special focus in order to raise funds.

6.4 Development – This refers to the improvement of the quality of


life of all regardless of age, sex, gender, tribe, race, creed and
religion. It is characterized by sustained and equitable growth in
a balanced ecology.

6.5 Economic Violence – This refers to acts which are intended to


enforce economic dependence upon women and their children or
deprive them of sufficient means and resources. This includes
deprivation of women of economic resources, their means of
income generation and mobilization so as to create dependency
and submissiveness to men and to any established structures of
domination. This term also encompassesEconomic Abuse, as
defined in R. A. 9262 or the Anti-Violence Against Women and
Their Children Act of 2004, which refers to acts that make or
attempt to make a woman financially dependent which includes,
but is not limited to the following:

a) withdrawal of financial support or preventing the victim from


engaging in any legitimate profession, occupation, business or
activity, except in cases wherein the other spouse/partner
objects on valid, serious and moral grounds as defined in Article
73 of the Family Code;
b) deprivation or threat of deprivation of financial resources and the
right to the use and enjoyment of the conjugal, community or
property owned in common;
c) destroying household property;
d) controlling the victims' own money or properties or solely
controlling the conjugal money or properties.

6.7 Gender – This refers to the differentiated social roles, behaviour,


capacities and intellect, emotional and social characteristics
attributed by a given culture to women and men.

6.8 Gender and Development - Consistent with R. A. 9710 or The


Magna Carta of Women, this refers to a development perspective

and process that are participatory and empowering, equitable,
sustainable, free from violence, respectful of human rights,
supportive of self-determination and actualization of human
potentials. It seeks to achieve gender equality as a fundamental
value that should be reflected in development choices; seeks to
transform society’s social, economic, and political structures and
questions the validity of the gender roles they ascribed to women
and men; contends that women are active agents of development
and not just passive recipients of development assistance; and
stresses the need of women to organize themselves and
participate in political processes to strengthen their legal rights.

6.9 Gender Equality - Consistent with R. A. 9710 or The Magna


Carta of Women, this refers to the principle asserting the equality
of men and women and their right to enjoy equal conditions
realizing their full human potentials to contribute to and benefit
from the results of development, and with the State recognizing
that all human beings are free and equal in dignity and rights.

6.10 Gender Perspective- This refers to a way of viewing issues and


problems that take into consideration the different realities of
women's and men's lives and recognizing that there is an unequal
relationship between the two. This way of viewing issues
recognizes the impact of gender on one’s opportunities and social
interactions.

6.10 Gender Sensitive/Responsive – This refers to having an


understanding of the marginalized position of women and
consciously challenging the attitudes and behaviour that reinforce
women's subordinate status.

6.11 Gender Sensitivity Training – This means providing people


with formal learning experience in order to increase their
awareness and provide the knowledge and skills necessary to
recognize and address gender issues in the programming
process. At the center of the learning process is the
conscientization, or the ability to recognize the underlying issues
of gender equality which form a pervasive obstacle to program
progress.

6.12 Indigenous People – This refers to a group of people who have


continuously lived as an organized community in a communally
bounded and defined territory, and who have, under claims of
ownership, occupied, possessed, and utilized such territories
since time immemorial, sharing common bonds of language,
customs, traditions and other distinctive cultural traits. Consistent
with R. A. 8371 or The Indigenous Peoples’ Rights Act of 1997,
Indigenous People/Indigenous Cultural Communities refer to a
group of people or homogenous societies identified by self-
ascription and ascription by others, who have continuously lived
as organized community on communally bounded and defined

territory, and who have, under claims of ownership since time
immemorial, occupied, possessed and utilized such territories,
sharing common bonds of language, customs, traditions and
other distinctive cultural traits, or who have, through resistance
to political, social and cultural inroads of colonization, non-
indigenous religions and cultures, became historically
differentiated from the majority of Filipinos. The term shall
likewise include peoples who are regarded as indigenous on
account of their descent from the populations which inhabited the
country, at the time of conquest or colonization, or at the time of
inroads of non-indigenous religions and cultures, or the
establishment of present state boundaries, who retain some or all
of their own social, economic, cultural and political institutions,
but who may have been displaced from their traditional domains
or who may have resettled outside their ancestral domains.

6.13 Integrated Population, Gender and Development Office


(IPGDO) – This is an office which is under the administrative
supervision of the City Mayor's Office the functions and purposes
of which are defined under Section 24 hereof.

6. 14Magna Carta of Women– This refers to Republic Act No. 9710


which is a law passed in 2009 constituting the fundamental
guarantee of rights and privileges of women in the Philippines.

6.15 Maternal health – Consistent with R. A. 10354 or the


Responsible Parenthood and Reproductive Health Act of 2012,
this refers to the health of a woman of reproductive age
including, but not limited to, during pregnancy, childbirth and the
postpartum period.

6.16 Other Places of Amusement – This refers to all other places of


amusement not specifically enumerated or otherwise provided for
in this Code, includes but not limited to night/day clubs, cocktail
lounges, super or family clubs, disco houses, minus-one or sing-
along houses, bars or beer houses, fast food center’s showing
sports competitions, replay videocassette films/movies and other
places of amusement where one seeks admission to entertain
oneself by seeing or viewing or by direct participation.

6.17 Prostitution- Consistent with R. A. 9208, this refers to any act,


transaction, scheme or design involving the use of a person by
another, for sexual intercourse or lascivious conduct in exchange
for money, profit or any other consideration.

6.18 Psychological/Emotional Abuse- This refers to written or


spoken acts and declarations made to or against the victim or
his/her children for the purpose of accomplishing any of the
purposes specified and defined in Section xx hereof. This term
also encompasses Psychological Violence, as defined in R. A.
9262 or the Anti-Violence Against Women and Their Children Act

of 2004, which refers to acts or omissions causing or likely to
cause mental or emotional suffering of the victim such as but not
limited to intimidation, harassment, stalking, damage to
property, public ridicule or humiliation, repeated verbal abuse
and mental infidelity. It includes causing or allowing the victim to
witness the physical, sexual or psychological abuse of a member
of the family to which the victim belongs, or to witness
pornography in any form or to witness abusive injury to pets or
to unlawful or unwanted deprivation of the right to custody
and/or visitation of common children.

6.19 Reproductive Health – This is a state of complete physical,


mental and social wellbeing and not merely the absence of
disease and infirmity in all matters relating to the reproductive
system and to its function and process. It constitutes twelve (12)
elements, namely:
a) Maternal, infant and child health and nutrition, including
breastfeeding;
b) Family planning information and services;
c) Prevention and management of Reproductive Tract Infections,
Human Immuno Virus and Acquired Immune Deficiency
Syndrome and other Sexual Transmitted Infections;
d) Treatment of breast and reproductive tract cancers and other
gynecological conditions and disorders;
e) Proscription of abortion and management of abortion
complications;
f) Mental health aspect of reproductive health care;
g) Treatment of infertility and sexual dysfunction;
h) Counselling and education in sexuality and sexual health;
i) Adolescent and youth reproductive health;
j) Male involvement and participation;
k) Elimination of violence against women; and
l) Education and counselling on sexuality and reproductive
health.

6.20 Sexual Abuse- This refers to an act or acts involving physical


contact as defined and specified in Section xx hereof which is
sexual in nature committed against a woman regardless of age or
mental development of the woman.

6.21 Trafficking in Persons - Consistent with and in accordance with


Section3(a) of Republic Act No. 9208, this is defined as the
recruitment, transportation, transfer or harbouring, or receipt of
persons with or without the victim's consent or knowledge, within
or across national borders by means of threat or use of force, or
other forms of coercion, abduction, fraud, deception, abuse of
power or of position, taking advantage of the vulnerability of the
person, or, the giving or receiving of payments or benefits to
achieve the consent of a person having control over another
person for the purpose of exploitation which includes at a
minimum, the exploitation or the prostitution of others or other

forms of sexual exploitation, forced labor or services, slavery,
servitude or the removal or sale of organs.

The recruitment, transportation, transfer, harbouring or receipt of


a child for the purpose of exploitation shall also be considered as
"trafficking in persons" even if it does not involve any of the
means set forth in the preceding paragraph.

6.22 Sexual Harassment - Other than the acts defined as sexual


harassment under R. A. 7877 or the Anti-Sexual Harassment Act
of 1995, the following shall constitute sexual harassment
punishable under this ordinance, without prejudice to prosecution
for acts covered by the Revised Penal Code under acts of
lasciviousness:
a) Persistent telling of offensive jokes or other analogous
statements despite having been previously requested to
refrain from doing so, granting that the prior silence of one to
the telling of offensive jokes or analogous statements shall
not be taken against the victim;
b) Taunting a person with constant talk about sex and sexual
innuendos;
c) Displaying offensive or lewd pictures and publications in the
workplace;
d) Interrogating someone about their sexual activities or private
life except on physical examination purposes;
e) Making offensive hand or body gestures at someone;
f) Repeatedly asking for dates despite verbal rejection;
g) Staring or leering maliciously, including the act of stalking;
h) Touching, pinching or brushing lip against someone's body
unnecessarily or deliberately;
i) Kissing or embracing someone against her will;
j) Requesting sexual favors in exchange for a good grade,
obtaining a good job or promotion;
k) Cursing, whistling, or calling a woman in public with words
having dirty connotations or implications which ridicules,
humiliates or embarrasses the woman, such as but not
limited to "puta", "peste", or "punyita", etc.;
l) Any other unnecessary acts during physical examinations;
m) Premeditated and intentional destruction of property and pets
usually the victim's favorite;
n) Requiring a woman to wear suggestive or provocative attire
during interviews, such as on job hiring, promotions.

6.23 Sexuality – This refers to one's total expression of personhood


on the basis of self- appreciation (body, mind and feeling) and
satisfaction of needs. Also considered as physical expression of
intimate relationship with others through various life stages.

6.24 Violence Against Women – This refers to any act of gender -


based violence that results in, or is likely to result in, physical,
sexual or psychological harm or suffering to women, including

threats of such act, coercion or arbitrary deprivation of liberty,
whether occurring in public or private life. This also includes acts
of violence against women as defined under Republic Acts No.
9208, 9262, and 9710.

6.25 Women’s Empowerment – This refers to the provision,


availability, and accessibility of opportunities, services, and
observance of human rights through life-cycle and rights-based
approach which enable women to actively participate and
contribute to the political, economic, social, and cultural
development of the nation as well as those which shall provide
them equal access to ownership, management, and control of
production, and of material and informational resources and
benefits in the family, community, and society.

RULE III. ROLES AND RESPONSIBILITIES OF CITY DEPARTMENTS


AND OFFICES

SECTION 7. ROLES AND RESPONSIBILITIES OF LGU OFFICES. All City


Government departments, offices, committees, and barangays shall
participate in the implementation of gender development and integrate the
same in their respective operations, policies, programs, and projects. They
shall undertake to:

7.1 Planning, Program, and Project Development:


a. Adopt gender mainstreaming as a strategy to promote women’s
human rights and eliminate gender discrimination in their systems,
structures, policies, programs, processes, and procedures
b. Formulate their annual GAD Plans, Programs and Budgets within the
context of their mandates, GAD Code, other GAD-related legislation,
policies, and commitments;
c. Review existing project proposal forms and guidelines, and revise as
necessary, to integrate GAD indicators and related concerns;
d. Ensure the participation of NGOs and POs including women’s groups in
policy formulation and development planning;
e. Develop appropriate measures to build and strengthen linkages and
referrals to complement their direct service program development, and
enrich policy directions and recommendations in executive and
legislative agenda, and in the City Development Council;
f. Project/program implementers, shall, develop a performance
monitoring and audit mechanism for assessing the quality of services,
which should take into account indicators for gender fair practices,
quality health, and support services provided;
g. Provide periodic reports on the implementation of their GAD-related
project, programs and activities (PPAs).

7.2 Operations:
a. Designate a GAD Focal Point Person who shall lead in GAD advocacy
and mainstreaming with their respective
departments/offices/barangays;
b. Follow gender-responsive indicators within the prescribed period.
Project/program implementers shall define and submit to the GAD
Council thru the GAD Technical Working Group said indicators one (1)
month upon approval and promulgation of this Implementing Rules
and Regulations.

7.3 Monitoring and Evaluation:


a. Establish and/or strengthen a gender responsive monitoring and
evaluation system;
b. Make an assessment on the progress of the implementation of the
GAD Code on a bi-annual basis;
c. Prepare respective GAD Accomplishment Report using the reporting
format prescribed under JMC No. 2013-01 and submit to the IPGDO;
d. Employ participative and consultative processes in the monitoring and
evaluation activity;
e. Adopt and employ the GAD monitoring indicators and evaluation
checklists stated in the Harmonized Gender and Development
Guidelines (HGDG) of the National Economic and Development
Authority (NEDA), Philippine Commission on Women (PCW) and Official
Development Assistance Gender and Development Network (ODA-
GAD).

SECTION 8. SPECIFIC OFFICES AND ROLES. To ensure the exercise,


protection, and promotion of the objectives of the GAD Code, specific City
departments/offices shall spearhead/undertake the following activities:

8.1 City Planning and Development Office


a. Ensure that those responsible in the drafting and finalizing of the local
development plans undergo training on gender – responsive
governance;
b. Ensure that all city development planners and those responsible in the
formulation of local development plans shall integrate in its existing
database GAD information to include gender statistics and sex-
disaggregated data as input or bases for planning, budgeting,
programming and policy formulation;
c. Spearhead the setting up and maintenance of the GAD database to
serve as basis for gender – responsive planning, programming and
policy formulation and ensure that all city development planners and
those responsible in the formulation of local development plans shall
integrate in its existing database GAD information to include gender
statistics and sex-disaggregated data as input;
d. Ensure that GAD Programs / Projects/ Activities (PPAs) are integrated
in local planning process;
e. Undertake gender-related documentation and research which shall
form part of the City's data-based programs.

8.2 City Health Department
a. Develop and implement a comprehensive national strategy consisting
of health programs, services and information for promoting women’s
right to health throughout their lifespan. The strategy shall have as a
major goal the reduction of women’s health risks, particularly those
resulting from complications of pregnancy and childbirth as well as
gender-based violence;
b. Provide interventions aimed at the prevention and treatment of
diseases affecting women, as well as policies to provide and enable
access to a full range of high quality and affordable health care
services;
c. Monitor and ensure that provisions for responsive and accessible
health services for women and men, including children and adolescents
are available both at the hospitals within the city and health centers;
d. Develop modules for responsible parenthood and family planning
program with the CSWDO, IPGDO to be integrated in the pre –
marriage counselling, solo parent seminars and other orientations and
educational activities;
e. Encourage the establishment of Women and Children’s protection unit
in every private and public hospitals within the city in every district to
provide comprehensive, responsive and accessible health services;
f. Build the capacities of Barangay Health Workers, schools and
community based health personnel in delivering gender responsive
health services to the community in coordination with the barangays,
non – government organizations and other developmental partners;
g. Ensure implementation of reproductive health programs over all Ormoc
based establishments, in coordination with the City GAD Council,
BPLO, PESO and NGOs with similar projects;
h. Ensure that all periodic medical examinations are provided for by
establishments and companies as part of employees benefits with
specific attention to women’s needs in relation to their reproductive
health;
i. Allocate an adequate amount of health budget of the City Government
of Ormoc for women’s health and services;
j. Ensure that health care services are not discriminatory on account of
gender, age or religion;
k. Adopt the reproductive health care approach at all levels of health care
delivery;
l. Establish a gender–responsive crisis intervention unit in all levels of
health care, and provide technical assistance to all health and other
allied personnel who shall assigned in the unit.

8.3 City Social Welfare Development Office


a. Develop social welfare programs that reduce the vulnerabilities of the
marginalized sectors, especially the senior citizens, elderly, high risk
and disadvantaged women, person with disability, children and youth,
and indigenous communities.
b. In coordination with the different departments and offices, ensure the
provision of livelihood opportunities, basic services and other auxiliary
services for those in resettlement communities;
c. Ensure integration of ensure gender-sensitive conduct of pre-marriage
counseling program to promote family planning, responsible
parenthood, equal relations and shared responsibility between spouses
in parenting and household management;

d. Develop modules on gender and development to be integrated in the
community education sessions, group therapy, legal assistance, solo
parent and pre – marriage counselling seminars and orientations;
e. Make available and improve existing child minding and nursing centers
for working parents, regardless of employment status;
f. Establish a temporary shelter with appropriate support services for
children, men and women in crisis;
g. In coordination with City Council for Women, the PNP, Barangays
based courts and social Services Department personnel, conduct
information campaigns, orientations and consultations with various
establishments on pertinent provisions of the Code such as trafficking
in women and children, sexual harassment and non- discrimination of
lesbian, Gay, bi sexual and transgender (LGBT);
h. Coordinate with the City Health Department for health services needed
by the client.
i. Implement special programs for women and children in extremely
difficult circumstances;
j. Provide women opportunities to acquire training in and basic skills in
non-traditional occupations such as, but not limited to those related to
science technology, and engineering.

8.4 City Budget Office


a. Ensure necessary funding requirements for GAD programs and
projects are provided subject to existing accounting and auditing rules
and regulations
8.5 Department of Education
a. Review the school curricula, textbooks and other literature for both
elementary and secondary schools to ensure that these are gender
fair;
b. Conduct training of trainers to address gender issues/concerns arising
from their work, through regular orientation prior to school opening
and assessment every after school year;
c. Promote gender sensitive awareness among students and teachers
through gender–sensitive curricula, processes, procedures and
regulations with regard to gender issues among youth/children and
their family;
d. Ensure equal access to opportunities for women, men and youth in
various training and scholarships;
e. Develop and make available resource materials on gender education
and governance including laws, ordinance and the city’s GAD Code
pertinent to youth, education and children’s/women’s right in all
schools, public libraries and other learning institutions;
f. Develop and promote gender equality through the creation of informal
education institutions catering to citizens of all gender identities;
g. Conduct an essay writing contest for teachers and students in all public
secondary schools based on the selected most gender–sensitive film
entry by the GAD Council as topic for essay.

a. Provide more news and information materials to the print and
broadcast media about the City Government’s actions, measures,
programs, and activities pursuantto the GAD Code;
b. Encourage media practitioners to support the City Government’s GAD
work through regular and or special information activities, including
news coverage and press conference;
c. Ensure policies, programs, projects, and activities are gender sensitive
and would promote the full respect and acknowledgment of women as
partners in development among media practitioners, filmmakers and
those in the same line of work/industry;
d. Promote and support individual and local initiatives that raise
consciousness of constituents about gender issues and concerns;
e. Assist the Council in information dissemination and awareness building
and in the production of information–education–communication (IEC)
tools;
f. Active promotion and publication of gender fair materials in popular
forms in the City Government of Ormoc.

8.7 HRMO
a. Assist City GAD Council in the conduct of gender – sensitization
sessions of all department/offices and attached units;
b. Develop a unified capability–building curriculum to ensure a gender
and socially responsive government service for the city government
personnel;
c. Provide support in training programs of the GAD Council;
d. Advocate for equal access to training and promotions based on merit
and capabilities, regardless of sex, gender orientation, age and socio–
cultural status in the government and other organizations within the
City;
e. Integrate orientations on the anti–sexual harassment law in staff
development programs;
f. Take proactive steps to capacitate women employees to strengthen
their qualifications and performance to compete for third-level
positions.

8.8 PESO
a. Ensure proper implementation of labor code;
b. Promote/advocate equal employment opportunities to the City’s
women and men by advocating this in the generation of local
employment from establishments and industries within the City;
c. Ensure that Labor Code provisions on minimum wage and benefits are
implemented in establishments and industries in the City and develop
a monitoring and reporting system for the same;
d. In cooperation with DOLE, endeavor to assist poor students, the
unemployed and the underemployed (especially women) in securing
gainful employment;
e. Assist women in their productivity skills, capability building, and
livelihood assistance as a way to help them earn a living;
f. Come up with an annual survey of domestic helper to monitor cases of
harassments, abuses and maltreatment. Households shall be required
to enlist their house helpers for identification and for other purposes.
Employers shall provide their household helpers recreation/day off.
The council for women shall come up with implementing rules and
regulations to enforce this provision;

g. Provide women opportunities to acquire training in and basic skills in
non-traditional occupations such as, but not limited to those related to
science technology, and engineering.

8.9 PNP – Ormoc


a. Ensure that there are separate detention cells for men and women;
b. Establish a twenty–four (24) hour Police Women And Children
Protection Desk in all police stations;
c. Undertake capacity building activities to strengthen Police Women And
Children Protection Desk officers;
d. Maintain regular reporting system on sex disaggregated data on
crimes against persons/human rights, such as Anti–trafficking of
persons act, anti–VAWC , anti-rape law and the like, and undertake
measures to diminish such occurrences and include the same in official
executive meeting reports
e. Undertake skills enhancement training for women and children desk
officers in handling cases of women and children victims of abuse and
violence
f. Undertake gender sensitivity training, seminars and orientation on
human rights of women and children, role of families , domestic
violence prevention, juvenile delinquency prevention , including
protection laws
g. Equip PNP Ormoc Personnel with knowledge and skills in handling
cases of children in conflict with the law
h. Logistical support and capability–building for the family juvenile court
and GAD and Women and Children Protection Desk (WCPD) officers in
community – based programs , projects and activities.

8.10 LIGA ng mga Barangay


a. Encourage members to legislate and enact a barangay ordinance
adapting the provisions of the Revise GAD Code and designation of
appropriate funds therein in accordance with the PCW-DILG-DBM –
NEDA joint Circular for GAD Budget;
b. Set up mechanism to address and eliminate VAWC, trafficking and
other discriminatory practices against women and men on the basis of
gender or gender orientation and at the same time empower women in
the community;
c. Encourage its member to prepare, formulate, and implement Gender
and Development Plan through the assistance of the barangay GAD
Focal Point/committee;
d. All barangays shall establish a Violence Against Women (VAW) Desk.
The punong barangay shall designate a VAW desk person trained in
gender-sensitive handling of cases, preferably a woman barangay
kagawad or woman barangay tanod. Continuity of VAW programs and
services shall be ensured at all times.

8.11 BPLO
a. Promote gender sensitivity and sexual harassment awareness among
business owners and bookkeepers through integration of the subject
matter in the annual conduct of Business Forum and Bookkeepers
Forum;
b. Encourage business ownsers to conduct Gender Sensitivity Trainings
and Orientation on Sexual Harassment.

8.12 ORWASA
a. Endeavour to install appropriate water systems in all barangays to
ease women’s workload brought about by the lack of this facility.

8.13 CITY LEGAL OFFICE


a. Assist in providing special paralegal trainings for affected personnel in
line with gender related issues and concerns.

8.14 IPGDO
a. Ensure the integration of Gender and Development (GAD) in the local
planning and budgeting system through the formulation of GAD plans
as stipulated in the GAD provision in the General Appropriations Act,
Local Budget Memorandum on Internal Revenue Allotment of LGUs and
Updated Budget Operations Manual for LGUs, series of 2008 and PCW-
DILG-DBM-NEDA Joint Memorandum Circular No. 2013-01 "Guidelines
on the Localization of the Magna Carta of Women as amended by
PCW-DILG-DBM-NEDA Joint Circular 2016-01;
b. Integrate gender concerns in the formulation of its Comprehensive
Development Plan (CDP), Comprehensive Land Use Plan (CLUP),
Executive & Legislative Agenda (ELA) and Annual Investment Plan
(AlP);
c. The formulation of GAD Plan shall follow the regular planning and
budget calendar and shall, as far as practicable, be incorporated in the
existing CDP, CLUP, and AIP;
d. Ensure that GAD Programs / Projects/ Activities (PPAs) are integrated
in local planning process;
e. Monitor a program that shall facilitate empowerment of women. Active
support for the preservation of women's knowledge of the environment
shall be incorporated in the program;
f. Coordinate closely with the DepEd Division Office, colleges and other
network of schools, in monitoring and reporting of stereotyped
portrayal of roles of women and men as projected in education
materials;
g. Undertake gender-related documentation and research which shall
form part of the City's data-based programs;
h. Ensure that there shall be a production of pamphlets, tackling
important gender-related national and city-wide policies and shall be
distributed for free at public spaces like transportation terminals,
markets, malls, and allocated to civic organizations, and other
establishments such as banks, clinics, government offices, among
others. At least Two Thousand (2,000) copies of these pamphlets shall
be distributed all throughout the vicinity of the City of Ormoc.
Moreover, the contents of such pamphlets shall also be published on
social media sites like Facebook, Instagram, or Twitter, among others,
by the official accounts of the City Government of Ormoc.

8.15 ENRO
a. Encourage participation of both men and women in pollution control,
zero waste technology development and management, preservation of
the forest, with due respect to indigenous people's rights to self-
determination;
b. Ensure that natural resources-based management programs take into
account the differentiated needs of women and men, girls and boys
and that these differentiated needs are addressed equitably;
c. Promote and ensure the active role of women in environmental impact
assessment projects.

8.16 City Council for Women
a. Serve as policy recommending, program planning, project monitoring
and coordinating body for all programs and activities on women within
the jurisdiction of Ormoc City;
b. Advocate for the implementation of the programs and projects of
NationalCommissions on the role of Filipino Women and other Women
Organizations.Formulate/ create a framework plan for women among
their networks, themainstreaming of gender and development in the
local government unit and thepassage of the local legislation in
addressing gender issues and women’sconcerns;
c. Strengthen linkages between and among government and women non-
government organizations and encourage active participation of
women and theirwelfare, promotion and development and assist
government agencies towardmainstreaming women’s concern;
d. Recommend appropriate necessary measure for legislative, legal
andadministrative actions relative to women’s concern such as health,
education,arts and culture, livelihood development, disability, human
rights and violenceagainst women and other;
e. Undertake research, especially for women, to provide data in support
oflegislative action, public policy formulation or program direction,
among others;
f. Encourage and promote the formulation of federation of women’s
organizationsat the barangay level;
g. Undertake continuing education and advocacy to promote women’s
economic,social and political empowerment and any other
projects/activities and functionspertinent to the promotion of women’s
concern; and
h. Perform such other functions as may be provided by law or competent
authority.
i. Engage more women to get involved in the social, civic and political
activities of the local government to promote gender equality;
j. Review and endorse the gad plan, ensuring that at least 5% of the city
government’s budget is for gad, and that the city government and the
barangays come up with additional indicators and guidelines, when
necessary, in identifying program, projects and activities that can be
funded therefrom;
k. Catalyze, coordinate, provide direction, monitor and serve as technical
adviser on programs/projects on women/gender and development
concerns within the city;
l. Establish linkage with the Philippine Commission on Women, the
Regional GAD Council, and other government bodies and institutions
for synergy, complementation and alignment of programs and
projects;
m. Formulate action plans for women and create committees to include
social development, health, nutrition and environment, human rights,
gender and policy advocacy and other local concerns; and
n. Review the City’s annual accomplishments on gender and development
especially on empowering the women and make raise concerns/issues
and give recommendations thereon.

8.17 Technical Working Group (TWG) On The City Government’s


Gender And Development Program

a. Conduct a Gender-Responsive Planning Workshop and take the lead in


preparing the LGU's Annual GAD Plan and Budget as well as other
plans on women empowerment and gender and development;

b. Prepare regular Accomplishment Reports and present to the Council for
Women for approval, and submit to appropriate agencies/offices
requiring the reports;
c. Lead in the establishment of a sex-disaggregated database system and
local situationer;
d. Facilitate a Trainers' Training on GAD;
e. Ensure that GAD programs, projects and activities are replicated at the
barangay level;
f. Coordinate the conduct of Gender-Sensitivity Training/Orientation for
Local officials and employees;
g. Serve as the technical committee of the City Council for Women and
review technical matters that will be included in the agenda for the
Council meetings.

SECTION 9. COMPLIANCE REPORT. During the first session of the


Sanggunian in March of each year, the Chairperson of the City Council for
Women shall address the members of the Sanggunian to report on the
accomplishments of the gender and development program and compliance
with this Code. Said report shall consolidate reports from various
departments and offices in the City Government and integrate the major
accomplishments of the barangays of Ormoc City.

RULE IV. CORE ASPECTS OF REVISED GAD CODE

SUBTITLE 1 – HEALTH

SECTION 10. STATEMENT OF POLICY – No woman shall be denied basic


health services, including, but not limited to, those declared by the World
Health Organization as necessary means to respond to basic health needs
especially those relating to maternal health care on purely financial grounds
or lack of access thereto.

SECTION 11. BUDGET FOR WOMEN’S HEALTH – An adequate amount of


the health budget of the City Government of Ormoc shall be allocated for
women’s health and services. Before the annual health budget for the City
Government of Ormoc is passed, the the City Council for Women shall
submit to the SangguniangPanlungsod its proposed budget allocation and/or
proposed expenses for that year geared to address gender and development
specific projects, services, and/or facilities which the City Council for Women
aims to focus on in that year. This proposed budget shall be supported by
data and research including but not limited to consultations conducted by
the GAD Office of the IPGDO with relevant stakeholders.

SECTION 12. WOMEN’S RIGHT TO MATERNAL HEALTH –The City


Council for Women shall include in its annual proposed budget a specific
allocation for the family planning supplies and commodities to be purchased.
The City Council for Women, upon proper consultation with relevant
stakeholders, such as but not limited to medical practitioners especially OB-
GYNEs, shall be tasked to initially choose and determine the family planning

and women’s health concern supplies and commodities that the city
government shall purchase. The distribution of such supplies and
commodities shall be with the City Health Office.

The City Government, through the GAD Office of the IPGDO, shall exert
efforts to educate women, most especially the urban poor and those who live
in far-flung areas, to secure membership with PhilHealth at the earliest
opportune time. Furthermore, the City Government, through the GAD Office
of the IPGDO, shall exert efforts to sensitize, educate and mobilize men to
take an active role in family planning and household management, as well as
to support women in empowering themselves in decision-making especially
on matters concerning their health.

SECTION 13. ACCESS TO SAFE WATER – Within one (1) year from the
publication of these Rules, the City Council for Women, the GAD Office of the
IPGDO, and the TWG created under the Revised GAD Code shall call convene
with ORWASA in order to discuss and shed light on the specific
problems/issues that women face due to the lack of access to safe water.
Such convention shall result into an action plan which shall be implemented
by the ORWASA and such implementation shall be supervised by the GAD
Office of the IPGDO.

SECTION 14. REPRODUCTIVE HEALTH CARE DELIVERY– The City


Health Department of Ormoc shall adopt the reproductive health (RH) care
approach in all levels of health care delivery. Such approach, which shall not
be limited to family planning and child bearing concerns, shall integrate
issues not previously considered central to population management such as
sexuality, reproductive tract infections, gender power relations, and
domestic violence. The City Health Department shall enter into partnerships
with hospitals to put up a Young Parents Program ensuring that pregnant
young women are afforded special care provided education and counselling
on the different options available to them after giving birth. The City Health
Department and the IPGDO shall also endeavour to establish Teen Centers
to educate teenagers on reproductive health, especially tackling risk
behaviours and their consequences.

SECTION 15. GENDER-RESPONSIVE CRISIS INTERVENTION UNIT –


The City Health Department (CHD) of Ormoc shall establish a Gender-
Responsive Crisis Intervention Unit (GRCIU) at all levels of health care:
primary, secondary and tertiary; and shall provide service trainings to all
health and other allied personnel who shall be assigned in this unit.

SECTION 16. PROTECTION AGAINST DRUG ABUSE – A Task Force,


headed by the PNP and CHO shall be created for the protection against drug
abuse and proliferation of illicit drugs in the City, including the protection of
women from the ill-effects, whether directly and indirectly, of the use and
proliferation of illicit drugs in the City.

SUBTITLE II – EDUCATION AND TRAINING

SECTION 17. STATEMENT OF POLICY – The City Government of Ormoc
shall endeavour to improve access of women to technology-based education
and training programs.

SECTION 18. WOMEN LITERACY AND ADULT EDUCATION – In


coordination with the Department of Education (DepEd) and the Technology
Education and Skills Development Authority (TESDA), non-formal education
classes shall be held in identified schools in the city to facilitate working
women’s access to education. Any adult desiring to engage in functional and
practical education shall be given priority in the adult education programs of
the City Government.

SECTION 19. GENDER-RESPONSIVE CURRICULAR PROGRAM–


educational institutions in Ormoc City shall promote gender equality in all
schools and at all levels in the city. It shall prevent all forms of gender-
based discrimination in schools and promote the use of gender-fair language
especially in educational materials and school curricula.

SECTION 20. SPECIAL EDUCATION FOR WOMEN WITH DISABILITY –


The City Government of Ormoc shall provide specialized educational
programs to interested women through the CSWDO.

SECTION 21. SCHOLARSHIP PROGRAM – The City Government of Ormoc


shall include poor and indigent women, whether married, single, solo
parents, mothers with infants/children, and those without child whether
married or single in its education scholarship programs. The city government
shall institutionalize its scholarship program and hereby institute the Study
Now-Pay Later (SNPL) Plan. The City Scholarship Board shall promulgate
rules therefor.

SECTION 22. MONITORINGAND REPORTING OF STEREOTYPED


PORTRAYAL OF ROLES OF WOMEN AND MEN IN EDUCATIONAL
MATERIALS – The IPGDO shall coordinate closely with the DepEd Division
Office, colleges and other network of schools in the monitoring and reporting
of stereotypical portrayal of roles of women and men as projected in
education materials.

SECTION 23. LIVELIHOOD AND SKILLS TRAINING FOR WOMEN– The


City Government, through PESO, shall provide preferential treatment,
whenever necessary, to women in the livelihood programs and shall ensure
that women are provided opportunities to acquire special technical or
vocational skills through the courses in, but not limited to, the Ormoc City
Manpower Training Center. Said Center shall ensure equal opportunities for
women and men in the courses offered, and where practicable, shall hold
exclusive classes for women students on those tagged and identified by the
City Government as traditionally-male courses in order to create a friendly
environment for learning among women. The City Government shall look
into the welfare of women solo parents and ensure that they are provided
appropriate opportunities such as, but not limited to, scholarship support for
skills acquisition and financial assistance for livelihood sustenance.

SUBTITLE III – LABOR, EMPLOYMENT AND ECONOMIC
OPPORTUNITIES

SECTION 24. STATEMENT OF POLICY – The City Government of Ormoc


shall ensure that all its departments and offices shall engage in and expand
their socio-economic programs to include women as beneficiaries, and
implement programs and projects designed to empower and provide them
with access to medium and large-scale economic opportunities.

SECTION 25. FACILITIES AND SUPPORT SYSTEM TO EMPLOYEES –


The City Government of Ormoc shall ensure the safety and health of women
in appropriate cases, by requiring the implementation of Ordinance No.
Series 2016 (The Child Welfare Code of Ormoc City):

a. Establishment of separate toilet rooms and lavatories for men and


women and provide at least a dressing room for women; and
b. Provide breastfeeding areas, child-rearing and early childhood care
for working parents while on their respective jobs.

SECTION 26. EMPLOYMENT OPPORTUNITIES FOR WOMEN WITH


DISABILITIES – The City Government of Ormoc, in partnership with
appropriate national government agencies, private organizations and other
entities, shall provide employment opportunities to women with disabilities,
recognizing their differentiated conditions and potentials as human beings.

SECTION 27. HEALTHY WORK ENVIRONMENT – Employers are required


to provide seats for women and permit them to use such seats during
working hours, provided they can perform their duties in this position
without detriment to efficiency and provide workers with the necessary gear
to guard against detrimental effects of the nature of their functions, such as
but not limited to respirator masks, sanitary gloves, among others required
to perform their respective functions. City Health Department will do the
monitoring.

SECTION 28. ORIENTATION ON SEXUAL HARASSMENT – All local


offices, agencies, schools, agencies, establishments or companies in Ormoc
City, whether government or private, shall conduct or sponsor an orientation
on sexual harassment for their respective personnel.

SECTION 29. GENDER AND DEVELOPMENT (GAD) ORIENTATION


TRAINING – All schools, offices, establishments or companies, department
and agencies, including city and barangay officials, shall initiate gender
sensitivity or GAD orientation/training to provide all concerned with
theoretical and practical knowledge on gender issues and concerns.

SECTION 30. MONITORING SYSTEM FOR LABOR STANDARDS – The


Council for Women shall install a mechanism to monitor all offices, agencies

and establishments or companies violating the relevant provisions in the
Labor Code, the provisions of the Revised GAD Code, and other relevant
laws and regulations.

SECTION 31. EMPLOYMENT ASSISTANCE PROGRAM – The Public


Employment Service Office (PESO) of Ormoc, in cooperation with the
Department of Labor and Employment, shall assist poor students, the
unemployed, and the underemployed, taking into consideration the
differentiated conditions of women, in securing gainful employment.

SECTION 32. LIVELIHOOD ASSISTANCE PROGRAM – The City Social


Welfare and Development Office of Ormoc shall assist women in their
productivity skills and capability building, and to provide livelihood
assistance as a way to help them earn a living.

SECTION 33. CITY-WIDE REGISTRATION OF HOUSE HELPERS – The


Public Employment Service Office (PESO) shall conduct an annual survey of
domestic helpers to monitor cases of harassments, abuses and
maltreatment. Households shall be required to enlist their house helpers for
identification and for other purposes. Employers shall provide their
household helpers recreation/day off consistent with the provisions of
Republic Act No. 10361 or the “Domestic Workers Act” or “Batas
Kasambahay”, the Council for Women shall come up with its program to
enforce this provision.

SUBTITLE IV – SOCIO-ECONOMIC BENEFITS FOR WOMEN

SECTION 34. PATRONIZING AND PROMOTION OF LOCALLY MADE OR


PRODUCED PRODUCTS – Whenever the City Government of Ormoc or any
other government agency or office located in the city shall host, sponsor, or
initiate a meeting, seminar, or symposium within the territorial limits of
Ormoc City, the organizers shall coordinate with the IPGDO and CSWDO in
order to ensure the display of locally made or produced delicacies/foods of
any of the accredited women’s group for business purposes. The City Council
for Women shall issue supplemental guidelines within 90 days from approval
of this IRR to implement this provision.

SUBTITLE V – RURAL WOMEN’S RIGHTS

SECTION 35. PROMOTION OF LAND-BASED PROJECTS – The City


Government, through the City Agriculture Office and other partner agencies
and institutions, shall support women engaged in crop and livestock
production projects encouraging the use of appropriate technology in order
to ensure food security using appropriate technology.

SECTION 36. CONTINUOUS PRODUCTION AND SUPPLY OF


INDIGENOUS RAW MATERIALS – The City Agriculture Office, in
partnership with duly registered and accredited People’s Organizations (POs)
and Non-Government Organizations (NGOs), shall institute programs

tosupport the continuous production and supply of vital raw materials to
sustain the resource-based economic projects of the City.

SECTION 37. ACCESS TO SCIENCE AND WOMEN-FRIENDLY


ALTERNATE TECHNOLOGY EDUCATION – The City Government, in
cooperation with the Department of Agriculture (DA), Eastern Visayas State
University (EVSU), Department of Trade and Industry (DTI), TESDA and
other related line agencies, shall establish a science and women-friendly
alternative technology education for rural women in identified potential
barangays of the city.

SUBTITLE VI – POLITICAL AND PUBLIC SPHERE OF WOMEN AND


CHILDREN

SECTION 38. STATEMENT OF POLICY – The City Government of Ormoc


shall ensure the fundamental equality before the law of women and men and
women’s active participation in the development process and in nation-
building.

SECTION 39. MARCH AS WOMEN’S MONTH AND OBSERVATION OF


MARCH 8 AS WOMEN’S DAY– As mandated by law, the month of March is
hereby recognized as International Women’s Month with March 8 of each
year to be observed as National Women’s Day. The Council for Women shall
come up with a month’s schedule of activities, and shall mobilize the various
stakeholders to join in the observation of women’s day and women’s month,
and ensure that activities achieve an increased level of awareness and
consciousness among women and other sectors on the issues affecting
women.

The Council shall also plan and implement the observance of the following:
(a) 18-Day Campaign to End Violence against Women to be scheduled every
November 25 to December 12 of each year;
(b) the International Day of Rural Women on October 15;
(c) the World Day Against Trafficking in Persons on July 30;
(d) International Day of Action for Women’s Health every year where issues
and concerns relative to the protection and promotion of women’s health
shall be examined, deliberated, projected and government action sought,
which date shall be agreed upon by the City Council for Women;
(e). Human Rights Day on December 10 of the Year.
(f). October 15 of the year as International Child Labor.
(g). November as Children’s Month.
(h) Other events that are relevant to the advocacies of women which the
City Council for Women may propose to add from time to time.

SECTION 40. COMMUNITY BASED WOMEN’S ORGANIZATIONS– The


City Government of Ormoc, through the IPGDO, shall exert efforts to help
and facilitate the formation of community-based women’s organizations and
assist women NGOs and community-based women’s organizations in their
accreditation with the SangguniangPanlungsod as among the duly
recognized people’s organizations in Ormoc City.

Women organizations with mass membership at the community level shall
be represented at the Council for Women. Women groups in schools, offices
whether GO, PO, or NGO shall likewise be represented in the Council as a
cluster. Details of the Council’s operations shall be consistent with those set
out in the Revised GAD Code.

SECTION 41. PARTICIPATION OF WOMEN IN LOCAL GOVERNANCE –


The City Government of Ormoc shall ensure that women are duly
represented in the City Development Council and in all Local Special Bodies
in the city and in all sectoral planning committees. The endorsement of the
City Council for Women shall be necessary condition for the appointment of
women representatives to all special bodies and sectoral planning
committees.
SECTION 42. WOMEN’S CONGRESS –The City Government of Ormoc,
through the City Council for Women, shall hold and convene a City Women’s
Congress at least once a yearon to review women’s development in all
aspects of community life and make appropriate recommendations for
actions thereon.
SECTION 43. INTERNATIONAL DAY OF ACTION FOR WOMEN’S
HEALTH– The City Government of Ormoc shall ensure the celebration of the
International Day of Action for Women’s Health every year.
SECTION 44. CONSULTATION WITH RURAL WOMEN – The City
Government shall conduct consultations with rural women’s sector through
CSWDO districts annually.
SECTION 45. ACTS OF VIOLENCE AGAINST WOMEN(section 71)- As
stated in R.A. No. 9262, any act or a series of acts committed by any person
against a woman who is his wife, former wife, or against a woman with
whom the person has or had sexual dating relationship, or with whom he
has a common child, which result in economic abuse including threats of
such acts, battery, assault, coercion, harassment or arbitrary of liberty. The
crime of violence against women is committed through any of the following
acts:
(a) Causing physical harm to the woman or her child;
(b) Threatening to cause the woman physical harm;
(c) Attempting to cause the woman physical harm;
(d) Placing the woman in fear imminent physical harm;
(e) Attempting to compel or compelling the woman or her child to
engage in conduct which the woman or her child has the right to
desist from conduct of which the woman or her child has the
right to engage in, or attempting to restrict or restricting the
woman’s or her child freedom of movement or conduct by force
or threat of force, physical or other harm, or intimidation
directed against the woman or her child. This shall include, but
not limited to, the following acts committed with the purpose or
effect of controlling or restricting the woman’s or her child’s
movement of conduct:
(1). Threatening to deprive or actually depriving the woman or
her child of custody or access to her/his family;
(2). Depriving or threatening to deprive the woman or her
children of financial support legally due her or her family, or
deliberately providing the woman’s children insufficient support;

(3). Depriving or threatening to deprive the woman or her child
of legal right;
(4). Preventing the woman in engaging in any legitimate
profession, occupation, business or activity or controlling the
victim’s own money or properties, or solely controlling the
conjugal common money, or properties;
(f) Inflicting or threatening to inflict physical harm on oneself for the
purpose of controlling the her actions or decisions;
(g) Causing or attempting to cause the woman or her child to engage
in any sexual activity which does not constitute rape, by force or
threat of force, physical harm, or through intimidation directed against
the woman or her child or her/his immediate family;
(h) Engaging in the purposeful, knowing, or reckless conduct,
personally or through another, that alarms or causes substantial emotional
or psychological distress to the woman or her child. This shall include, but
not limited to the following acts:
(1). Stalking or following the woman or her child in private or
public places;
(2). Peering in the window or lingering outside the residence of
the woman or her child;
(3). Entering or remaining in the dwelling or on the property of
the woman against her will;
(4). Destroying the property and belongings or inflicting harm to
animals or pets of the woman or her child; and
(5) Engaging in any form of harassment or violence;
(i). Causing mental or emotional anguish, public ridicule or humiliation
to the woman or her child, including, but not limited to, repeated
verbal and emotional abuse, denial of financial support or custody of
minor children or denial of access to the woman’s child/children.

SECTION 46. SEXUAL ABUSE. Sexual Abuse shall include but is not limited
to the following:
RAPE
a.) When a man inserts or attempts to insert his penis into the mouth
or anus of a woman against her will or under any of the following
situations:
1) Through force, threat or intimidation:
2) When the offended party is deprived of reason OT otherwise
unconscious:
3) By means of fraudulent machinations or grave abuse of
authority: and
4) When the offended party is under twelve (12) years of age or
is demented, even though none of the circumstances
mentioned above be present.

b.) When a person inserts or attempt to insert part of his or her body
other than sexual organs or introduces any object or instrument
into the genital or anus of a woman against her will or under any of
the foregoing circumstances.
c.) When a person subjects another to have sexual intercourse with an
animal under any of the circumstances stated in the preceding

paragraphs or through any abnormal unusual or ignominious sexual
acts;
d.) Any intentional contact however slight of one’s penis to the genital,
mouth, breast, anus of woman, or to any part of her body other
than her sexual organ, or the use of any instrument or object which
touches the genital, breast or anus of a woman against her will
under her will or under any of the foregoing circumstances.
e.) Forced sexual act committed under intimate or marital relations
such as those between man and woman, woman and woman, man
and man relations, married or unmarried, legally separated or
separated in fact.

PROSTITUTION

f.) When a person, association, cult, religion or organization or similar


entities to commit the following acts:

- Establish or carry on a business for the purpose of exploiting


women for purposes of sex, sex slavery, sex trade, sex tours and
other immoral activities.

- Advertise, publish, print or distribute, or cause the advertisement


publication, printing or distribution of any brochure, flyer or
propaganda material calculated to promote the above mentioned
prohibited acts.

- Solicit, enlist, or attract/induce any woman to join any club


association or organization whose objective is to match women for
marriage to foreigners either on mail-order basis or through
personal introduction or cyberspace.

- Use the postal services, cyberspace or satellite TV to promote the


above-mentioned prohibited acts.

TRAFFICKING

g.) When a person buys or sells a woman, or any of her body parts.
h.) When a person threaten or use violence and force a woman to
become a mail-order bride
i.) When a person offers or contracts marriage, real or simulated, for
the purpose of acquiring, buying, offering, selling or trading them to
engage in prostitution, pornography, sexual exploitation, forced
labor or slavery, involuntary servitude or debt bondage:
j.) When a person undertakes or organizes tours and travel plans
consisting of tourism packages or activities for the purpose of
utilizing and offering persons for prostitution, pornography or
sexual exploitation:

SECTION 47. PSYCHOLOGICAL/EMOTIONAL ABUSE. Any intentional act
that causes or is likely to cause mental or emotional suffering or which
forces the victim to perform an act against his/her will such as but not
limited to the following:

a.) Threats or suicide if the victim will not give in to the demands of the
offender;
b.) Threats of grave physical harm against the victims of hi/her family;
c.) Punching, breaking or defacing or otherwise destroying the house
or any part thereof or the personal belongings of the victims;
d.) Threatening to kidnap the victim’s children or to take them to the
foreign country;
e.) Threatening deportation of the victim with foreign citizenship;
f.) Forcing the victim to do things he/she considers as dehumanizing
or degrading;
g.) Controlling the victims lawful or usual activities;
h.) Use of false and insulting words, language, or statements against
the victims;
i.) Threats of abandonment and expressing such as forcing the victims
to leave conjugal dwelling;
j.) Shouting invectives against the victim and other forms of verbal
abuse intended to or causing the public humiliation or ridicule of the
victim.
k.) Any intentional and malicious transmission, alteration, deletion,
manipulation, or deterioration of computer data such as but not
limited to electronic documents, electronic messages, electronic
images and videos, or combinations thereof, posted or shared in
cyberspace or transmitted to third parties thru electronic means,
intended to or causing the public humiliation or ridicule of the
victim.

SECTION 48. ECONOMIC VIOLENCE. This includes deprivation of women


of economic resources, their means of income generation and mobilization
so as to create dependency and submissiveness to men and to any
established structures of domination.

SECTION 49. DOMESTIC VIOLENCE AS AN AGGRAVATING


CIRCUMSTANCE. When any of the acts defined under this Chapter is
committed by a member of the family of the victim or offended party within
the 4th civil degree of consanguinity or affinity, the same shall be considered
as an act or acts constituting Domestic Violence and shall be punished with
the maximum penalty or fine imposable under the R.A. 7160, or both, at the
discretion of the court. In case the violence committed is between persons
living as a husband and wife, parents and child, or between persons with
common child/children whether living together or not, the violence
committed shall be deemed as domestic violence regardless of the
legitimacy of the relationship between them.

SECTION 50. SEXUAL SOLICITATION. It is unlawful for any person to


solicit another person’s services for acts which are sexual in nature
regardless of whether the solicitor profit or not from such acts, or whether

such solicitation is done on behalf of another, or such as a habitual activity
or whether or not the sexual act is fully consummated.

SECTION 51. COMMODIFICATION OF PERSONS. Any raffles draw,


benefit or disco dance or any similar undertaking wherein persons,
regardless of age, are used as incentive, raffle prize, substitute for cash
prizes won, or as a companion package for an award, prize or recognition, or
any other activity which depicts such persons as central, partial or special
focus in order to raise funds shall be prohibited.

Any activity or form of beauty contest which tends to commodify or


exhibit women and men in a sexually suggestive manner shall be strictly
prohibited within the territorial jurisdiction of Ormoc City. For this purpose,
the City Council for Women and the City Council for the Welfare of Children
are hereby mandated to jointly draft and promulgate the guidelines that
shall be adhered to in the conduct or staging of beauty contests.

Organizers of shows or events cited in this section found to be wilfully


violating this provision shall be liable to pay a fine of not exceeding FIVE
THOUSAND (P5,000.00) PESOS per show and events organized or
imprisonment of not exceeding one (1) year or both subject to the sound
discretion of the court.

ARTICLE II
SUPPORT SERVICES FOR VICTIMS OF VIOLENCE AGAINTS WOMEN

SECTION 52. SUPPORT FROM THE LAW ENFORCER. The law enforcer,
preferably of the same sex or his/her authorized alternate as the offended
party, upon receipt of a complaint for the acts committed in Chapter II,
shall:

a. Immediately conduct an investigation within 24 hours;


b. Arrange for counselling and medical services for the offended party;
c. Gather evidence for the arrest and prosecution of the offender; and
d. Make a report of his/her investigation and, on the basis of the
offended party’s testimony and additional evidence, if any, endorse the
same to the proper to proper prosecution office within 36 hours from
time of filing, regardless of his/her evaluation of the case.

SECTION 53. WOMEN AND CHILDREN PROTECTION DESKS (WCPD).


The City Government Of Ormoc, through the City Police Office, shall
establish and maintain the WCPDs preferably handled by Women Police
Officers duly trained by GAD personnel. All police stations in Ormoc City shall
have WCPDs to specifically handle concerns of women and children. All
police stations in the City of Ormoc shall have separate WCPDs room within
the police station.

SECTION 54. SUPPORT PROGRAMS TO WOMEN AND CHILDREN WHO


ARE VICTIMS OF VIOLENCE. The City Government of Ormoc shall provide
immediate support services to women and children who are victims of
violence, to include but not limited to legal, medical, psychological, shelter,

livelihood, and other forms of support services. These services shall be
provided by the CSWDO in coordination with other involved agencies.

SECTION 55. ROLE OF FEMALE POLICE OFFICER. Complaints of


battering and other forms of abuse against women and children shall be
handled by female officers in the local police who shall undergo special
courses on handling such cases.

SECTION 56. COURT HEARING OF RAPE CASES, INCEST AND OTHER


FORMS OF VIOLENCE AGAINTS WOMEN AND CHILDREN. All
investigations /hearings involving rape cases and other forms of violence
against women and children conducted in the police stations, prosecutor’s
office and trial courts shall recognize and allow the victim’s support group to
be present in the court room as observers and to provide moral support to
the survivors subject of litigation.

SECTION 57. THE FAMILY DISPUTES AND VIOLENCE COMMITTEE. All


Barangays Governments in the City shall create the Family Disputes and
Violence Committee inside the Lupong Tagapamayapa to handle cases on
the family disputes.

SECTIOM 58. WOMEN AND CHILDREN’S WELFARE. The Women and


Children’s Welfare is hereby established under the Ormoc City Social Welfare
and Development Office to caters problems and concerns of depressed
families especially those affected by natural and human-induced calamities.

SECTION 59. SHELTER FOR ABUSED WOMEN AND CHILDREN. The City
Government of Ormoc shall established a shelter for abused women and
their children to ensure that those who are victims of violence attain justice
and healing. This shelter may serve as crisis intervention center to provide a
temporary shelter with appropriate support services for women in crisis and
their children. The City Council for Women shall define or identify conditions
or situations for women to be considered in crisis.

SECTION 60. INVOLVEMENT OF MEN IN THE ADVOCACY ON ANTI-


VIOLENCE AGAINTS WOMEN. Violence against women is perpetrated
largely by men. Ideas and behaviours linked to masculinity or manhood are
highly influential in some men’s use of violence against women. Further,
men have a positive and vital role to play in helping to stop violence against
women. For this reason, the City of Ormoc, through the IPGDO in
cooperation with CSWDO, Council for Women and other agencies concerned,
shall involve boys and men in order to decrease the instances pf violence
against women. The said agencies shall develop programs that will enlighten
or inform boys and men alike about the repercussions of any violence done
against women.

ARTICLE III
OTHER SUPPORT SERVICES FOR WOMEN

SECTION 61. WOMEN AFFECTED BY DISASTERS, CALAMITIES, AND


OTHER CRISIS SITUATIONS. In disaster, calamities, and other crises, the

City Government of Ormoc and the agencies concerned in all phases of
relief, recovery rehabilitation and reconstruction effort shall:

a.) Ensure a more coordinated and gender-sensitive culturally-


appropriate response in all stages of the emergencies;
b.) Timely, adequate and culturally-appropriate provision of relief
goods and services such as food, water, sanitary packs,
psychosocial support, livelihood, education and comprehensive
health services at the early stage of the crisis;
c.) Proactive adoption of measures by camp managers to prevent
sexual violence in evacuation centers and relocation sites which
includes: (a) security and safety of women and children as key
criteria for the selection of evacuation sites, (b) separate functional
amd well-lit latrines for men and women with locks, (c) bathing
facilities with privacy, (d)regular security patrols preferably by
female police officers; and (e) prohibitions of alcohol, drugs and
gambling, among others; and
d.) Strengthen meaningful participation and representation of women
in disaster risk reduction and management (DRRM) councils and
processes, DRRM-related programs, projects and activities.

SECTION 62. WOMEN IN SPORT. The City Government of Ormoc shall


establish and strengthen programs for the participation of woman and girl-
children in competitive and non-competitive sports as means to achieve
excellence, promote physical and social well –being, eliminate gender-role
stereotyping, and provide equal access to the full benefits of development
for all persons regardless of sex, gender, and other similar factors.

SECTION 63. INTER-AGENCY COUNCIL AGAINST TRAFFICKING IN


PERSONS. The City Council for Women shall assume the powers and
functions of the Inter-Agency Council against trafficking in persons to wit:

a. formulate a comprehensive program to suppress the trafficking of


men, women and children;
b. conduct massive information campaigns;
c. undertake guidance and counselling for women going abroad as
fiancées of foreign nationals;
d. make representations to schools and colleges for the inclusion of
migration and its implications for all levels of curricula;
e. refer trafficking victims to appropriate agencies;
f. formulate a programs for returning victims in cooperation with local
offices of DOLE, TESDA and other government agencies involved in
training and livelihood development;
g. secure assistance from any of the local government units, departments
or bureaus of the National government;
h. exercise other powers and functions necessary to attain its purposes
and objectives.

SECTION 64. CONTINUING EDUCATION AGAINST SEXUAL


HARASSMENT. To foster a culture against sexual harassment, all
government or private agencies and offices within the jurisdiction of the shall

conduct continuing education against sexual harassment. For the purpose,
the City Council for Women shall ensure that:

64.1. At least one (1) activity designed to equip workers and employees with
the critical and practical knowledge on gender issues and concern is
conducted each year in these offices/establishments or workplace.
64.2. The provisions of RA 7877 otherwise known as the Anti-Sexual
Harassment Law, Civil Service and other provisions of the Labor Code
affecting women are faithfully implemented, especially the formulation
of necessary policies and procedures are resolving complaints for
sexual harassment.
64.3. Monitoring and assessment tools are in place to ensure compliance to
relevant laws on sexual harassment.

SECTION 65. LEGAL EDUCATION AND COUNSELING. The City Legal


Office shall (a) in coordination with CSWDO and compered government
organizations (GO’s), undertake legal education and training for the
community leaders, barangay official and members of the Lupong
Tagapamayapa on legal counselling and arbitration to capacitate community
workers in resolving cases of family conflicts at the barangay level; (b) in
partnership with the liga ng mga Barangay and other non-government
organizations (NGOs), undertake a special para-legal training on gender
issues and related matters for member of the Lupong Tagapamayapa for all
barangays in the city.

SECTION 66. SUPPORT FACILITIES TO WOMEN AND THEIR


CHILDREN IN DETENTION. The City Government of Ormoc shall assist the
concerned National Government Agency in the establishment of appropriate
structure and facilities for detention and rehabilitation for women and care
for their children.

SECTION 67. THE REFERRAL PATHWAY SYSTEM FOR GENDER-BASED


VIOLENCE. The city Council for Women shall review and strengthen the
referral pathway system for gender based violence and shall recommend to
the City Mayor the reconstitution of the Ormoc City Referral Pathway Core
Team shall perform the following functions and responsibilities:

a.) Ensure that a standard referral pathway system shall be


implemented;
b.) Conduct meeting and case conferences with agencies within the
referral network on operational issues and concerns;
c.) Ensure that the referral pathway system is carried out and observed
properly even in the barangays and other stakeholders; and
d.) Conduct monitoring and evaluation on the implementation of the
Referral Pathway System.

CHAPTER III
FINAL PROVISIONS

SECTION 68. APPROPRIATION. At least five percent (5%) of the total


budget appropriations authorized under the annual appropriation ordinance

shall correspond to activities supporting GAD plans and programs. The GAD
budget shall be drawn from the city’s maintenance and other operating
expenses (MOOE), capital outlay (CO), and personal services (PS).

SECTION 69. IMPLEMENTING RULES AND REGULATIONS. The City


Mayor, through the assistance and recommendation of the City Council for
Women, shall formulate the implementing rules and regulations necessary to
carry out the provisions of this Code. The IPGDO shall serve as secretariat
and ensure that the Council shall be convened immediately after the passage
of this passage of this Code to facilitate the formulation of the implementing
rules and to submit this to the City Mayor within 90 days from affectivity.

SECTION 70. REVIEW. The City Council for Women shall review this
ordinance five years after the enactment to ensure responsiveness and
relevance to the evolving/emerging gender issues and concerns and shall
recommend to the Sanggunian those matters that acquire legislation.

RULE IV. FINAL PROVISIONS

SECTION 71. SEPARABILITY CLAUSE – If for any reason, any part or


provisions of these Rules and Regulations shall be held unconstitutional or
invalid, other sections or provisions hereof which are not affected thereby
shall continue to be in full force and effect.

SECTION 72. EFFECTIVITY– These Rules and Regulations shall take effect
fifteen (15) days after posting.
