Sir,

Under instructions and authority from my client Mr. Pradeep Dilip Jangam (Ziddi
Maratha Pratisthan) having office at shop no 10, Ganesh Bhavan, Narmada Nagar,
Bhayander (East) we serve upon you the following show cause notice, with reference to
irregularities in granting and rejecting process, whereby eligibility norms are evidently
manipulated for personal gains.

1. That in the year 2022, Tenders were invited by the commissioner, MBMC, Bhainder
through E – Tender for works in Mira-Bhainder area. The said Tenders were floated on
official website i.e https://mahatenders.gov.in

2. That in response to which various contractors had filed their tender bid as per the
guidelines mentioned in the tender form.
3. That the contractors bidding for the tender were required to comply with the
following checklist :

Online Form Fee Receipt

Online Earnest money deposit Receipt

Attested copy of certificate as registered contractors in appropriate class by Govt. of

Maharashtra or any other Govt. or semi Govt. Organization

Balance Sheet of last 3 years (2018-19, 2019-20, 2020-21)

GST Registration Certificate

4. That my client had made an RTI demanding detailed information in all the relevant
documents with reference to the selection and granting of BID of the above mentioned E-
Tender.

5. That on 15/11/2022, my client was provided with detailed documents as demanded.

6. That as per the documents provided on 21/102022 the Selection committee in the
presence of Commissioner, MBMC after discussion findings were enlisted, whereby the

eligible (पात्र) bidders and not eligible (अपात्र) bidders were Listed with reasons for being not

eligible (अपात्र)

7. That in the said list of Findings at point no 14. Was related to MBMC क्षेत्रातील

नाल्या मधून खाडीत कचरा जात असल्याने नाल्याच्या शेवटी Garbage Screening Guard

बसविणे टेंडर आयडी क्र MBMC 837634_1. For the same 7 bidders had filled the tender
1. M/s J. R. Enterprises

2. M/s Kanchan Construction Co.

3. M/s. Shivam Enterprises

4. M/s Shobha Enterprises

5. M/s Shrusti Infrastructure

6. M/s Tirupati Balaji Enterprises

7. M/s Yogesh Narayan Ghamre

8. That as per the findings mentioned therein four bidders were rejected with reasons as
follows

1. M/s Kanchan Construction Co. GST Certificate not submitted

2. M/s. Shivam Enterprises Registration Certificate Not submitted

3. M/s Shrusti Infrastructure Balance sheet for last 3 years not submitted

4. M/s Tirupati Balaji Enterprises Balance sheet for last 3 years not submitted

9. That My client is surprised to find that the above reasons was rejection (अपात्र) was
completely erroneous and wrong. That as per documents provided under RTI the said 4
Bidders have submitted all the documents as per checklist guided in the tender.

10. That my client is further surprised to find that the same 4 Bidders have been declared
eligible under the other tender work by the same committee.

M/s Shivam Enterprises is declared eligible Bidder (पात्र) for the टेंडर आयडी क्र MBMC

837611_1, टेंडर आयडी क्र MBMC 837608_1, टेंडर आयडी क्र MBMC 837602_1,
10. That the other 3 Bidders have also submitted and complied with all the checklist
documents guided in the tender.

11. That it is evident and crystal clear and beyond doubt that the selection committee has
been biased and the selection of the Bidders has been done erroneously, self contradictory to
make favours and to earn personal gains.
 Under the circumstances, we call upon you to reply in writing, showing the cause of
such irregularities in granting and rejecting tender process, whereby eligibility norms are
evidently manipulated for personal gains, within a period of 15 (fifteen) days from the date of
receipt of this notice, failing which my client will be constrained to take the matter to higher
Authorities for clarification.

This is without prejudice to all other legal rights and remedies available to our client for the
above-stated purpose.
